PETITION FOR SETTLEMENT
OF ESTATE UNDER SECTION 202 OF FIDUCIARIES ACT
TO THE HONORABLE,P.VINCENT MARINO,JUDGE OF SAID ORPHANS'COURT
D;I:VISION:
The p€!tition of Madeline Belfiore of Cecil Township,
Washington County,Pennsylvania,respectfully represents:
1.The decedent,Victor Belfiore,died on March 20,
1970,at which time he resided in Cecil Township,Washington
\\.
2.Your petitioner is the wife of the deceased and the
.family relationsh:ip was maintained at the time of his death.
3.Deeedent died testate,a copy of his Last Will
and Testament being hereto attached;however,there has been no
app.lication for the grant of Letters Testamentary in this case.
4.The!decedent was survived by your petitioner,who
according to the provisions of said Will,is the sole devisee
thereunder.
5.The only unpaid debt of the decedent is a balance of
$120.12 to Fryer Monument Company on account of a tombstone,which
your petitioner is prepared to pay and has ample funds for this
purpose.
6.The only property or interest in property of which
the decedent died seized were:
a)A death benefit from the United Mine Workers of
America.
b)A death contribution from members of Local Union
No.1198 of said Union.
c)Benefits due decedent under the provisions of
the F'ederal Coal Mine Health and Safety Act of 1969.
The amount of the foregoing items is less than
$1,000.00.
7.This petition is presented pursuant to the provisions'i
of Section 202 of the Fiduciaries Act of 1949 P.L.512,as
amended.
WHEREFORE,your petitioner prays your Honorable Court
to enter a Decree of Distribution directing distribution of the
entire assets of the said estate to your petitioner without
further notice or hearing.

and says that the facts set forth in the foregoing Petition are tnue

LAST WILL AND TESTAMENT---
I,VICTOR BELFIORE,of Cecil Township,Washington Count ,
Pennsylvan:1.a,do hereby make my Last Will and Testament and revoke
all wills by me at any time heretofore made.
I direct the payment out of my estate of all
my Just debts,funeral expenses,costs of administering my estate
and transfer inheritance taxes as soon as convenient after my
decease.
.Ieath the estate hereby devised and bequeathed to her shall vest in
er absolutely and in fee simple,free of all conditions.I
uthorize my executrix to payout of the income or principal of my
state reasonable amounts for the support and maintenance of my
aid wife,and as well the reasonable expenses of her funeral and
rave stoneJI should she die within said period of three.(3)months.
SECOND:All the rest,residue and\remainder of'my
estate,real,personal and mixed,I give,devise and bequeath to
my beloved wife,Madeline Belfiore,however,that in the event of
her death in my lifetime,or in the event of.her death within the
period of three (3)months after my death,the said devise and be-
quest of residue shall lapse or be divested and in either event,I
ive,devis,e and bequeath the said residue of my estate to my eight
children,Mary Volovich,Cecelia Petras,James Belfiore,Eleanor
anger,Agnes Belfiore,Edward Belfiore,Raymond Belf~ore and Larry
elfiore,the~r heirs and assigns,share and share alike.I de-
lare it to be my intention that should my Wife,Madeline Belfiore;
e living at the expiration of three (3)months from the date of my

DECREE OF DISTRIBUTION

AND NOW,to wit,this JrC/--day of Ocboeer 1970,the foregoing
petition for Settlement of an Estate Under Section 202 of the
Fiduciaries Act hav:i:rig '.been presented in open Court,upon considera-
tion thereof and upon motion of Zeman and Zeman,Attorneys for the
petitioner,it is adjudged and decreed that the entire amount of
the estate of Victor Belfiore,deceased be,and the same is hereby,
distributed and transferred without grant of Letters Testamentary,
to Madeline Belfione,wife of the decedent.
THIS decree of distribution shall constitute sufficient
authority to transfer any and all the right,title,interest claim
and demand of the Estate of Victor Belfiore,deceased,of,in and to,
all benefits to w·hich the said decedent or his estate wa~,is,or
will be,entitled under and by virtue of the provisions of the
Federal Coal Mine Health and Safety Act /.of 1969;and this Decree
of~jDistribution shall in all respects have the same effect as a
decree of distribution,~fter an accounting by a personal representative.
