PETITION TO FIX SECURITY
The petition of MRS.EVELYN J.HAMPTON respectfully
represents:
1.That ROBERT R.CHAPMAN,a/k/a ROBERT ROYAL
CHAPMAN,residing at 167 Walnut Street,Smith Township,Washington
County,Pennsylvania died testate on September 28,1970.
2.That Letters Testamentary were granted to your petitioner,
MRS.EVELYN J.HAMPTON,on November 18,1970 by the Register of Will
of Washington County.
3.That an inventory was filed on March 26,1971 showing the
total value of the decedent's property as $3,749.33;the value of premises
known as 167 Walnut Street,Burgettstown being $2.500.00.which it is
being .
desired to be sold/inc1uded in the sum of $2,500.00.
4.That no security has been \entered by your petitioner.
5.That decedent died siezed owning one piece of real estate
at 167 Walnut Street,in Smith Township,Washington County,Pennsylvania,
consisting of a one-story frame house which is unoccupied and which is
described as follows:

ALL that certain lot of ground situate in Smith Township,
Washington County,Pennsylvania,and known and designated as part of Lot
No.167 in a plan of lots laid out by J.Winfield Reed in said Township
called Grandview Plan of Lots which said plan of lots is recorded in the
Recorder's Office of Washington County,Pennsylvania,in Plan Book No.4,
page 165,being described as follows:
Fronting 51.3 feet on Walnut Street,thence running a distance
of 154 feet along the dividing line of Lots Nos.166 and 167,having a back
measure on Oak Alley of 51.3 feet and running a distance of 150.5 feet
between said Oak Alley and Walnut Street.
6.That your petitioner has entered into an agreement of
sale of the aforesaid premises to John R.Babyak and Kathy Babyak,his
wife,of the Borough of Burgettstown,Washington County,Pennsylvania,
for the sum of $2,500.00 free and clear of encumbrances,of which sum
$200.00 has been paid and the balance is to be paid at settlement on or
before April 15,1971.A copy of the agreement of sale is attached hereto.
7.That there are no liens of record,mortgages,delinquent
taxes or judgments against the said premises.

values in the locality of said premises are attached hereto.
WHEREFORE,your petitioner prays -your Honorable Court
under section 541 of the fiduciary act of 1949 for final decree requiring the
entering of security in such amount as the Court may determine,upon the
entry of which your petitioner to have authority to receive the proceeds of
sale of the premises aforesaid and she will ever pray.
