This was not the usual estate anq our office commenced with the handling of the same on June 30,1974,when an Ancel J.Fleming came into the office.Mr.Fleming came in at that time to inquire into the estate of his father,William J.Fleming,who died in 1951.In checking the records,I found that Letters of Administration were issued in June,1952,to Mr.Fleming's sister, Mrs.Lucy Price,of West Virginia. Mr.Ancel Fleming came to see us as a referral of the Lawyer's Referral Service and,prior to this time,had been in contact with several other lawyers in the Washington County area, including Charles Sweet,who was then a Judge,and Sam Rodgers and his partner at that time,Mr.Roney.It appears that,while Mrs. Price was administratrix,Charles Sweet had commenced the handling of the estate by obtaining some sort of a settlement for gas rights. Actually,we were never able to trace this settlement. Mr.Fleming informed me that it was his sister's philosophy that if she were named administrator and paid the taxes on the property that,after a ,certain number of years,the property would be hers and would no longer be a part of the estate.I contacted Mrs.Price by telephone.That'is to say,I actually contacted her husband by telephone and fairly well confirmed that this was her belief.I told Mr.Price that there would be an action filed in Washington County to compel her to proceed with the administration of the estate. I .....~.• Chris Vlachos,Esquire Page Two September 21,1976 I might mention,too,at that time,that Mr.Ancel Fleming,who had come to see us,was here from the State of Louisiana,where he lived.After contacting his brother-in-law,Mr. Price,I then made efforts to trace what had transpired in the estate through Rogers &Roney,successors to Judge Sweet's practice. Sam confirmed that there had been some work done in the Fleming estate,but very little,and that he had no claim for fees or costs and advised us to proceed as we would in the handling of the same.I asked him if he would contact Mrs.Price or if he would represent her in any proceeding which I would bring,and he declined,indicating that he had no further desire to·proceed in that case. Certain correspondence followed with Mrs.Price,including a threat to have her removed as administratix unless she moved forward with the estate.She continued to decline any activity whatsoever. Some time later,I believe in the next year,Mr.Fleming returned and announced that his sister,Lucy Price,was now dead. We applied for Letters of Administration on the same day that Mr. Fleming was here,with the request that Ancel Fleming be appointed as administrator.I believe that he was actually appointed admin- istrator cta. The first problem in the estate would be to dispose of the realty,which Mr.Fleming figured was worth between $5,000 and $10,000.We contacted a realtor by the name of Joseph DeMaria and Mr.DeMaria appraised the property..That property consisted of approximately 145 acres in West Finley Township. From this time on,began a steady period of meetings, correspondence,telephone conferences with Ancel Fleming,and the following people,all of whom are heirs to the estate. Marian Newcombe,Lafferty,Ohio;Charles Price,Blaine,Ohio; Eileen Duffy,.Saint Clairsville,Ohio;Joseph Price,18th street, Wheeling,West Virginia;John Price,650 Fairmont Pike,Mount Olifant. They had a prospective buyer for us,apparently.A Mr.Anderson,located at Anderson's Texaco,at 232-9247.There were several calls made to Mr.Anderson at that number and,at the end,it appeared that he did not have the means or the desire to purchase the property. .." Chris Vlachos,Esquire Page Three september 21,1976 Joe DeMaria was able to locate a buyer for the property; Mr.and Mrs.Milton Kosanovich,of the City of Pittsburgh.The actual sales price was $5,000 and,after the payment of the realtor's commission and costs of sale,the estate neted $4300 from the sale of that land.I would like to mention that there were many meetings of the heirs both at the property and at my office prior to the sale of this land.One of the factors which held up the sale was the fact that some of the heirs were toying with the purchase, themselves,of this family acreage.At the end,none could afford it and we proceeded with Mr.DeMaria who was able to consummate the sale,finally. Some of these estate papers,such as the RCC and the Debts,show the attorney's fees as $300 and I assume,looking back,that this is likely what I had contemplated as fees at the beginning of the handling of this estate.Under some other circumstances,this might have been a proper fee.However,as this estate progressed,with the many meetings and toll calls, I informed the heirs at an early stage of this proceeding that the attorney's fees would be considerably increased over the amount that I had originally contemplated. There were many disputes between the heirs.No two of the heirs got along,it seemed.Mr.Fleming,my client,was at odds with practically all of them.This is one of the reasons why there were so many meetings involved. The closing of the sale of that real estate became quite complicated because of the various heirs involved and their contacting of the prospective buyers.In fact,this office had considerable periods of negotiation with Attorney Jon Botula, of Grant Building,Pittsburgh,Pennsylvania,relative to the closing.The closing was handled through this office without any fees being charged to the estate,separately,for the handling of the closing,the preparation of the Deed,etc. Additional reference to my file indicates that,by July 7,1971,we were still trying to locate the gas royalties. These were never found.We were also looking for royalties which were supposedly obtained by the administratrix,Mrs.Price,from Manufacturer's Heat and Light Company~-It appears that there was never a separate account kept of the royalties and we were unable to find them..I tried to locatetheIri throughthePx.:ice ts,through Samuel Rodgers,but to no avail,In the meanwhile,there were .many calls,to and frQm,Longstreet,Loui~>iana~Jncl.ud.ed tn my bill of $850 •.00 was probaJ;lly a sUlTl Qf $10.0..to $1.50.~Or;(e;i:mburse... merit for telephone toll cC3,J..ls~ Chris Vlachos,Esquire Page Four September 21,1976 Also,there was the matter of the settlement of a claim against the estate by the Ohio Valley Hospital.This was done with no charge being made,separately,to the estate.That claim was settled for $800.'There was also a claim put against the estate by Joseph Price,widower,of Lucy Price,for monies which Lucy had expended in keeping the real estate from being sold throughout the years.She wanted her taxes back,plus monies which she had spent for medical reimbursement for her father.In March,1972,this was compromised between Joseph Price and the various heirs.It was done through my office,with no separate charge being made.That reimbursement,it would appear from the correspondence,was ultimately made in the amount of $872.42 and this amount included an administratrices commission of $200. Early in the handling of the estate,as soon as it be- came evident that none of the heirs would be agreeable with each- other,I explained to each of them at one of our meetings that the attorney's fees would be considerably more than normally charged,percentage wise,in an estate,this being for the reason that I had already expended many more than the usual number of hours in the handling of the same and a great deal of money in telephone toll charges.There was absolutely no objection from any of the heirs;in fact,they felt that it would be proper. By way of further review of this file,I have noted that it was necessary,in the sale of the real estate,to answer many questions which appeared after a prospective buyer had been located,that this office searched th~title to the real estate. This was done at the request of the various heirs and this re- quest was made at one of the meetings of the heirs.I explained to them,at that time,that there would be an approximate charge of $100 for the title search.There was no resistance to this at all. Included in the title difficulties was a claim by the Tax Claim Bureau and possible,eventual sale.The matter was worked out with the Tax Claim Bureau and I subsequently worked it out with Attorney Botula,attorney for the buyers,that each of us shared the tax claim responsibility. Among the many other problems in this estate was the fact that there was also a D.P.A.lien against Mr.Fleming.The amount of the lien escapes me at the present time,but my file does indicate that we were ultimately able to compromise the lien with a Mr.Wakefield Hexon,of the Pennsylvania Department .. Chris Valachos,Esquire Page Five September 21,1976 of Public Welfare.The actual settlement amount was $164.26, and there were many phone calls to Mr.Hexon's office and a considerable period of negotiation before any settlement would be accepted by D.P.A.Then,as the estate was being wound up, finally,some additional controversy erupted in the form of Mrs.Mildred Duffy,who was one of the heirs of the above estate by being the daughter of Lucy Ruth Price. It appears that she also objected to the sale of the farm.She hired Attorney John J.Malik,of Bell Aire,Ohio,to represent her interests.We had subsequent correspondence with Mr.Malik. In addition to the many additional hours which were involved in the handling of this estate,there was also a great deal of correspondence involved,many,many long distance tele- phone toll charges,conferences and correspondence with several lawyers and state agencies and,moreover,the heirs all agreed upon the attorney's commission of $850 long before the estate was totally settled.And,there was no resistance to that figure as a fee,whatsoever. I trust that this is ample information which you require in approving the $850 charge which I have listed as attorney's fees.If there is any further information which you require, please let me know.The item of fees,as set forth in the account,also includes costs advanced.
