The will directs the properties be sold -and then goes on and says "and be divided equally between,11 and then the various,several names.I have them listed in the Audit Petition. After that,the decedent says,"Before the division of the money is made a marker is to be placed on the grave of William S.Bigler by Kurtz Monument Company,East Maiden Street,Washington,Pa " This caused a lot of trouble,but I came up and I have on another lit Ie note for the Court,the statement that Mr.Hammond of the Kurtz Monument Company investigated and tells me that a man by the nan e of O.P.Bigler of R.D.#1,Marianna,in October of 1967,caused a marker to be placed at the graves of William S.Bigler and Lydia Baker Bigler;and at this time the old white marbke~marker at the grave of William S.Bigler was removed.That's what is supposed to have been done according to the Will.And it was not done by thE Executrix.And whether the Court feels that Mr.O.P.Bigler should be reimbursed in some portion for that,I do not know.I did not get from Mr.Hammond the cost or what he paid for this 3 -I..----......U---------'-------------------------ll---I ins tallation,but if the Cou rt feels you want it,I can get it.Mr. Hammond told me he would give it to me.That,I think,depends on the interpretation of the Will. THE COURT:Mr.Donaldson,has Mr.Bigler made any claim for reimbursement? Then we come to another matter.The Will says also in the final settlement the First Baptist Church of Washington, Pennsylvania is to get $1,000.00.Someplace it must come out of th s, what we have in our hands now.It'snever been paid out before.I will leave that to the Cou rt as to how it's to be done. In the Audit Petition I have s"et forth that the Inheritance Tax is paid iirnfull.At the time the real estate was sold the attorney that repres ented the purchaser took that position. But sinceJIpave again gone over the papers,preparatory to this audit,I am not completely sure.And I ha ve with the papers a copy of the Court's Adjudication and Decree of November 23,1955 and a copy of the last Inheritance Tax receipt,I imagine.I imagine Mr. Hana will have to check that matter. Mr.Crumrine,I believe represents or is here for Mr.Mc Creight,representing the life tenant and the church.
