KNOW ALL MEN BY THESE PRESENTS:Whereas,at Washington,in the County aforesaid
on the 26th.day of October A.D.19 70 ,before me,
Russell Marino ,Register for the Probate of Wills and Granting
Letters of Administration in and for the County of Washington,in the Commonwealth of Pennsylvania,
the last Will and Testament of
Signa A.Bedillion
late of South Strabane Township in the County aforesaid,deceased,
(a tree copy whereof is to these presents annexed),was duly admitted to probate;and
Anthony J.Bullotta and Mary M.Bullotta

owners..and that for inheritance tax purposes,the proper assessment
in the estate of Signa A.Bedillion on the said account should be for a

Dear Mrs.Leo:
We are in receipt of a Stipulation and Order of Court,
Court of Common Pleas of Washington County,signed by Judge
Marino on september 14,1971,wherein it has been stipulated
that Joint Savings Account No.TB-06710,deposited in the
First National Bank and Trust Company,Washington Office,
registered in the names of the decedent and Mary M.and Anthony
J.Bullotta,will change the decedent's interest in said
account to one-third (1/3)or $1,541.17,rather than the full
amount or $4,623.52 as appraised on an RCC-134 appraisement
issued on November 23,1970.
Accordingly,we hereby authorize you to adjust your
records and our Bureau file will be amended to reflect the fore-
going change.Item # 2 on the RCC-134 changes to one-third
(1/3)value,hence,the total value of the Jointly Held Property
changes from $4,991.74 to $1,909.39,with tax assessed at the
15%rate.

that the appeal be heard before'Your Honorable Court.We were.as
a matter of fact.Mr.and Mrs.Bullotta claimed that the entire
funds were their own personal funds.It was just a matter of conveni nce.
But it's also clear fr<?,m our viewpoint that it was nit created in con-
templation of death anyhow,that it was just merely transferred fron
a previous account in the'same amo'unt from Certificates of Deposit n
the same three names.which were more than two years old.over
to this account 'bearing more interest:There{ore,we affected.just
in the last couple days.a compromise with the Commonwealth of
Pennsylvania.Mr.Keller's office called this morning and said he
represents the'Commonwealth in this matter.
THE COURT:Yes.Mr.Keller,I bel~eve,~poke to me about
this and said that he would be present to enter into a stipulation witt
counsel.
MR.GOLDFARB:His secretary called this morning and said he had

car trouble and couldn't get,here.But he would bring over a,stipula ion

In the above estate,the Pennsylvania Inheritance Tax Return was
filed with you,including therein a joint savings account opened
August 25,1969 in the First National Bank &Trust Co.,Washington,Pa.,
in the name of the above decedent or Mary M.Bullotta or Anthony J.
Bullotta,$4,623.52.Said item is reported therein as not taxable,
because all of the funds were and are Mr.and Mrs.Bullotta's,and
none were decedent's,being made joint for convenience only.
The Inheritance Tax Division of the Department of Revenue had as-
sessed said item as 100%taxable at the rate of 15%,as per the enclosed
copy of their Notice thereon.
We protest said assessment by the Department of Revenue and main-
tain that said item is not taxable at all as aforesaid.
In accordance with 72 PS 2485-1001 (2),unless the Department of
Revenue withdraws its assessment of said item,we hereby notify you
that Anthony J.Bullotta and Mary M.Bullotta elect to have the cor-
rectness of the action complained of determined at the Audit of the
Account of the personal representatives.

1.Ralph A.Craig died,a resident of the City
of Washington,Washi.ngton County,Pennsylvania.,on June 28,1963.
2.The said Ralph A.Craig left a will of
record in the Office of the Register of l,vills of Hashington
County,Pennsylvania,in will Book 96,at page 475.
A copy of the said will is attached hereto,marked Ex:hibit II A",
and made a part hereof.
3.The said Ralph A.Craig died owning the
following described real estate:
That certain lot of ground situate
in the Seventh Ward of the City of Washington,
iilashington County,Pennsylvania,knmvn as Lot No.
94 in the Hess Plan of Lots and on which is located
a seven room,two-story frame house known as 1150
Summerlea Avenue,Washington,Pennsylvania,and
bounded and described as follows:
BEGINNING at the Southeast corner of Lot No.
93 in the plan of lots laid out by John F.Hess
and Grant E.Hess recorded in the Recorder's Office
of washington County,Pennsylvania,in Plan Book
2,at Pages 38 and 39,thence,East along the North
line of Summerlea Avenue 40 feet to an alley;thence,
along the West line of said alley,148.4 feet to an
alley;thence,West 88.5 feet to the Northeast
corner of Lot No.93;thence,South 140 feet to the
place of beginning.
4.The said real estate was awarded,inter
alia 1 to Eleanor C.~,liehman,testamentary trustee,by adjudication

-and decree dated May 26,1964 and filed in the Office of the
Clerk of the Orphans'Court at No.101 at 1964 A.A.
5.James E.Craig,life tena.nt under the will
of Ralph A.Craig with respect to the above-described real
estate,died on June 29,1970.
6.Your petitioner proposes to sell the said
're'al estate to ,James R.Craig and Josephine Liggett Craig,his
wife,£~r 'Eighi Thousarid Five Hund~ed ($8,500.00)Dollars.
7.A copy of the agreement of sale entered
into by your petitioner and James R.Craig and Josephine Liggett.0..•,
Craig,his wife,is attached hereto,made a part hereof,and
designated Exhibit "B".
8.Your petitioner proposes to sell the said
real estate rather than dist~ibute it in kind because your
petitioner is required under the provisions of the will of
Ralph A.Craig to divide the principal of the trust among
several nieces and nephews of the decedent.The property which
is the subject of this petition is improved with a single
residence.It is impractical to divide the said real estate
among the several nieces and nephews who are the beneficiaries
of the trust.
9.Your petitioner proposes to secure execution
of and to deliver to the purchasers a deed which shall be
in the form indicated by a copy thereof attached hereto marked
Exhibit "C",and made a part hereof.
10.Your petitioner proposes to execute the
said deed pursuant to the authority vested in her by section
961 of the Fiduciary's Act of A,pril 18,1949,P.L.519,20 P.S.
320.961 giving a trustee the power to sell real estate at
public or private sale for the purpose of distribution.
11.The attorney for the purchaser has requested
an order from your Honorable Court determining that the sale has
the effect of a judicial sale under the provisions of section 963
of the said act,20 P.S.320.963.
12.Your petitioner was named executor in the
will of Ralph A.Craig .and has,therefore,not been required to
file any bond.
WHEREFORE,your petitioner prays that your Honorable
Court authorize and direct her to carry out the agreement for
the sale of real estate \I,hich is Exhibit "B II attached to this
petition and make an order stating that the sale shall have the
effect of a judicial sale.

8.If Buyer defaults in payment or performance for 30 days,Seller may,at Seller's election
use one or more of the following remedies in addition to or instead of any other remedies provided by law:
(a)rescind this agreement and retain all sums paid on account hereof as liquidated damages,in
which case Seller shall retain title to the real estate free and clear of any obligation or duty to Buyer and Buyer
shall surrender this Agreement for cancellation;
(b)eject Buyer from said real estate,for which purpose Buyer hereby authorizes any attorney
of any Court of Record to appear for Buyer and confess judgment against Buyer in an amicable action of ejectment,
with immediate writ for possession of the real estate and for damages,to include attorney's commission of 1 (")%

1.Ralph A.Craig died,a resident of the City of
Wa~hington,Washington County,Pennsylvania,on June 28,1963.
2.The said Ralph A.Craig left a wiil of record
in the Office of the Register of Wills of Washington County,Penn-
sylvania,in Will Book 96,at page 475.-A copy of the said will i c
attached hereto,marked Exhibit "A",and made a part hereof.
3.The said Ralph A.Cra~g died owning the follow-
ing described real estate:
ALL that certain lot of ground situate in
the Seventh Ward of the City of Washington,
Washington County,Pennsylvania,on which is
located a five room,two-story frame house
known as 1064 S~mmerlea Avenue,Washington,
.Pennsylvania,bounded ~nd described as follows:
BEGINNING at a point on the Northeastern
side of Summerlea Avenue on the dividing line
of Lots Nos.409 and 410,thence,along the
dividing line of said lots,a distance of 150
feet t6 the line of certain reserved property;
thence,along the rear line of Lot No.409,
a distance of 25 feet to a point;thence,
through Lot No.409,by line parallel with the
dividing line between Lots Nos.409 and 410
and 25 feet distant therefrom,a distance of
150 feet to Summerlea Avenue;thence,along
Summerlea Avenue,a distance of 25 feet t6 the
place of beginning.

the Orphans'Court at No.101 at 1964 A.A.
5.James E.Craig,life tenant under the will of
Ralph A.Craig with respect to the above-described real estate,
died on June 29,1970.
6.Your petitioner proposes to sell the said real
estate to Michael J.Turk and Mary L.Turk,his wife,for Six
Thousand Two Hundred Fifty Dollars ($6,250.00).
7.A copy of the agreement of sale entered into by
your petitioner and Michael J.Turk and Mary L.Turk,his wife,is
attached hereto,made a part hereof,and designated Exhibit "B".
8.Your petitioner proposes to sell the said real
estate rather than distribute it in kind because your petitioner
is required under the provisions of the will of Ralph A.Craig to
divide the principal of the trust among several nieces and nephews
of the decedent.The property which is the subject of this
petition is improved with a single residence.It is impractical
to divide the said real estate among the several nieces and nephe s
who are the beneficiaries of the trust.
9.Your petitioner proposes to secure execution
of and deliver to the purchasers a deed which shall be in the for
indicated by a copy thereof attached hereto,marked Exhibit "C",
and made a part hereof.
10.Your petitioner proposes to execute the said
deed pursuant to the authority vested in her hy section 961 of
the Fiduciary's Act of April 18,1949,P.L.519,20 P.S.320.961
,giving a trustee the power to sell real estate at public or priva e
sale for the purpose of distribution.

11.The attorney for the purchaser has requested
an order from your Honorable Court determining that the sale has
the effect of a judicial sale under the provisions of section 963

9.If Buyer defaults in payment or performance for thirty days,Seller may,at Seller's election,
use one or more of the following remedies in addition to or instead of any other remedies provided by law:
(a)rescind this agreement and retain all sums paid on account hereof as liquidated damages,in
which case Seller shall retain title to the real estate free and clear of any obligation or duty to Buyer and Buyer
shall surrender this Agreement for cancellation;
(b)eject Buyer from said real estate,for which purpose Buyer hereby authorizes any attorney

with immediate writ for possession of the real estate and for damages,to include attorney's commission of 10 %

(c)affirm this agreement by delivery of deed to Buyer,declare all sums due hereunder to be

AND NOW this day of August,1971,it is Stipulated and Agreed
by Francis C.Patrono,of Counsel for the Estate of Ralph A.Craig;and
Francis C.Patrono and Harold V.Fergus both of Counsel,jointly for the
Estate of James E.Craig,that the claim of the James E.Craig Estate pre-
sented at audit of the Ralph A.Craig Estate is hereby withdrawn.It is
Stipulated and Agreed by and between counsel that the Orphans Court in the
Adjudication and Decree charge the Estate of Ralph A.Craig an amount of
$600,being the amount of exemptions taken on Federal Tax returns of the
life tenant,and award this amount to the Estate of James E.Craig,and
further in the Adjudication and Decree of the James E.Craig Estate divide
the same in distribution of that Estate.The aforementioned award is in
full and complete satisfaction of all claims of the James E.Craig Estate
against the Ralph~A.Craig Estate~

we have just talked about,James E.Craig,is a life ten~nt.The
reason for this account being filed is that James E.Craig died
and the live tenancy terminated and under the provisions of the Wil
of Ralph A.Craig,the trust that was established term inated.
Now there was a claim made by Mr.Fergus at

one time tothe effect that there had not been a proper distribution elf
income from the Ralph A.Craig trust to James E.Craig,life
tenant.This has to do primarily with aalculation of depreciation
and certain exemptions that were available under the Federal lncon e
Tax Return.Now if this claim were to be upheld,this would becon e
an asset of the estate of James E.Craig.'Now the same people

exemption wasn't distributed to the life tenant.Mrs.Craig is
presently in the hospital and does not want any problems with her
stepdaughter,so I was understanding this morning that possibly

wr-nm.EAS,Ralph A.~aig late of the City of vJashington,Washington
county,PEnnsylvania,died on the 28th day of June,1963,and
"J11'EREAS,the said Ralph A.Craig left a Will "Which was duly probated
and is of record in the office of the Register of ~vills of Washington County,
Pennsylvania,:in Will Book 96 ,at Page 1.175 ,and
WIIEREAS,the said Will granted the residue of the Estate of the
said Ralph A.Craig to a Trustee to hold for the use of James E.Craig for
life,with remainder to Eleanor C.Viehman,Jean C.Barrie (more properly
Jeane.Barre),William H.craig,Richard craig,Patricia C.'tJonsettler,and
Mary Ann courtwright,daughters and sons of the said James E.Craig,and
HHEREAS,the said James E.Craig has one other son,James R.Craig,
'tiho is not named in the said v.iill,and
ltJI-IEREAS,all of the other children of James E.Craig are certain
that the omission of their brother,James R.~craig,from the Will of Ralph A.
Craig was a regrettable mistake and that the said Ralph A.Craig intended to
include the said James R.'craig in the provisions of the said Will,to the
full extent that the others of the said children are included,and
VJHEREAS,the Estate of the said Ralph A.Craig :includes real estate,
thus making it necessary for the spouses of the children of James E.craig who
are married to join in·the execution and delivery of this document,
N~l,TdEREFORE,the undersigned do hereby agree,each in consider-
ation of the covenant and agreement of the other,:intending hereby to be
legally bound,as follows:
1.Each of the children of James E.Craig named in the Will
of Ralph A.Craig does hereby irrevocably assign,transfer,and set over unto
James R.Craig,his heirs and assigns,such portion of the share of each of
the said children of James E.Craig named in the Will of Ralph A.Craig as
shall be required to result in the said varnes R.Craig sharing equally with
them in the assets and property of the said Ralph A.f(;raig.The spouses of
all of the children of James E.Craig who are named in the Will of Ralph A.
craig have executed this Agreement in order to signify that they irrevocably
transfer,set over,and convey unto the said James R.Craig such portion of
the real estate left by the said Ralph A.'Craig as shall be required to con-
stitute the said James R.Craig a joint tenant in the said real estate with
the other children of James E.Craig,in equal shares.
2.The undersigned do hereby request the Orphans!Court of
Washington 'County,Pennsylvania,in any Adjudication and Decree made in
connection with the Estate of Ralph A.Craig hereafter to include the said
James R.Craig as a distributee to the full extent that the other children of
James E.Craig are named as distributees.
