That your petitioner is the mother of Joseph T.1.
The Petition of Mary W.Kelly,respectfully represents:

2.That the decedent,Joseph T.Kelly,died,intestate,I
on March 3,1970,at Washington Hospital,Washington,pennSy1VaniJ,II
his residence at that time being Westgate Apartment 18,Building B,
1290 Donnan Avenue,Washington,Washington County,Pennsylvania.
3.That the decedent's entire estate consists of the fol-
lowing assets:
Checking Account 06-02049-6-06 in First National
Bank &Trust Company,Washington,Penna.374.75
Checking Account in U.S.Bank &Trust Co,
Account #14427,Main at Franklin,Johnstown,
Pennsylvania 21.09
Refund due on decedent's 1969 Income Tax
Return in estimated amount -of 276.95
and subject to approval of Internal Revenue
Service

4.That decedent's only survivors are:

5.That the only creditors of the decedent of which your

6.That the funeral bill has been paid by petitioner,
Mary W.Kelly.
7.That no Letters of Administration have been
on the Estate of Joseph T.Kelly,deceased,and it is not
that any shall be applied for.

8.That no wages have been paid directly to members of
the decedent's family under Sectim 201 of the Act of 1949,and n
payment is anticipated.
9.That this Petition for Settlement is made pursuant
to the provision of Section 202 of the Fiduciaries Act of April
18,1949,P.L.502,as amended (20 P.S.320.202),and Section 211
of the same Act,as amended (20 P.S.320.211).
WHEREFORE,your petitioner prays your Honorable Court
enter a Decree of Distribution,awarding the entire balance in
this estate as follows:

payment of 1969 income tax to Mary W.Kelly,mother of decedent.

Kelly,petitioner,it appearing that the estate is insolvent and
further that Mary W.Kelly,petitioner,has paid all the bills of
said estate,with the exception of attorney's fee and costs ad-
vanced in connection with this Petition,IT IS ORDERED AND DECREE~
that this estate be distributed as follows:
1)First National Bank and Trust Company,Washington,
Pennsylvania,is authorized and directed to issue two
checks out of Account No.06-020£'.9-6-06,one payable
to Frank C.Carroll,Esq.,for costs and fee in the
amount of $110.00,and the other to Mary W.Kelly,fO~1
the balance in said account of $264.75,
2)The U.S.Bank &Trust Co.,of Main at Franklin Stree~s,
Johnstown,Pennsylvania,is authorized and directed tq
issue a check for the balance in the amount of $21.09 I'
