PETITION FOR PRIVATE SALE OF REAL ESTATE UNDER
SECTION 543 of FIDUCIARIES ACT OF 1949)AS AMENDED
To The Honorable)The Judges of Said Court:
Your petitioner,ANN KACZMAREK,now known as,ANN
YERKEY,respectfully represents:
1.That Cecelia Kaczmarek,also known as,Celia Kaczmarek,died
testate,February 27,1967,a resident of Donora,Washington County,
Pennsylvania.
2.That your petitioner,was appointed Administratrix,C.T .A.of the
estate of Cecelia Kaczmarek,also known as Celia Kaczmarek on March 14,
1967 by Josephine M.Douglas,Register of Wills of Washington County,
Pennsylvania.
3.That the decedent by paragraph 'iSECOND"of her Last Will and Testa-
ment dated June 23,1959,a copy of wtIich is attached hereto as Exhibit "All
devised to her son,Walter Kaczmarek;his heirs and aSSign,one-half
interest in the residue of her estate and the other one-half interest to
Walter Kaczmarek in trust for her other son,Theodore Kaczmarek.,The
said Walter Kaczmarek,predeceased his mother,the testatrix,having died
on December 3,1966 and was survived by his wife,Ann Kaczmarek,your
petitioner and his two sons,Walter F.Kaczmarek and Franklin Kaczmarek.
In addition she was also survived by her other son,Theodore Kaczmarek,
who presently resides in the real estate,which is the subject of this petition,
All of the heirs are sui juris.
4.The decedent at her death possessed a personal estate of inventoried
value of $1,039.87 being a savings account in the Mellon National Bank and
Trust Company,Donora Office,Donora,Pennsylvania;and the following
real estate to wit:
ALL those certain pieces or parcels of land situate in the
Borough of Donora,Washington County,Pennsylvania,and
described as follows:
Lots numbered 5 and 6 in Block numbered 61,lying between
Kenyon Alley and Thirteenth Street;fronting on McKean Avenue
60 feet,together,and running back 100 feet and having a rear
of 60 feet,together,on Linden Alley.
Said lots being in and more particularly shown by the Union
Improvement Company Plan of Lots and designated as the Second
Addition to the Town of Donora,which plan of lots is recorded
in the Office for recording Deeds,etc.,for Washington County,
in Plan Book Volume 2,page 124.
Excepting and reserving all the natural 'gas and oil underlying
said land but no wells shall be drilled on the same for either.

BEING the same property as was conveyed to Frank Kaczmarek
and Cecelia Kaczmarek,his wife,by Mrs.Margaret G.Laird and
James Laird,her husband,by deed dated July 17,1924 and recorded
in Deed Book Vol.524,page 314,records of Washington County.
The said Frank Kaczmarek predeceased Cecelia Kaczmarek and title
vested in her by operation of law.
5.That no real estate of the decedent has been sold.
6.That your petitioner has procured and attached hereto a certificate of
assessed valuation,a copy of the inventory as Exhibits IIB II and "CII.
7.That your petitioner deems it necessary and proper in the administration
of the decedent's estate that the above described real estate of decedent be
sold under the provisions of Section 543 of Fiduciaries Act of 1949,as
amended.
8.That your petitioner deems it necessary as alleged in the preceeding
paragraph to sale this real estate.Theodore Kaczmarek,an heir and
son of the decedent,is in possession of the property and has refused to
cooperate with your petitioner in any matter whatsoever,particularly
ascertaining a fair and reasonable rent for the property,if he so desires
to remain there,or to consider purchasing the remaining interest,or to
even pay the current real estate taxes.That-your petitioner has had to
advance the sum of $50.00 to stay the sale of this property by the Washing-
ton County Tax Claim Bureau and entered into an agreement to pay the
remainder of the real estate taxes,a copy of which is attached hereto as
9.That your petitioner is desirous of being permitted to purchase,at
private sale,the real estate of decedent and believes and therefore avers
that her hereinafter offered price is a better price than can be obtained at a
public sale thereof.
10.That your petitioner;subject to the approval of this Court,has entered
into written articles of agreement,copy of which is attached hereto as
Exhibit "E'i with herself,personally to purchase the real estate as a whole
for the price or sum of $3,500.00,which price she believes is a full and
fair price therefore and a better price than can be obtained at a public sale
thereof;as will appear by affidavits of two competent and disinterested
persons familiar with the values of real estate,which affidavits are attached
hereto as Exhibits "F"and "Gil.
WHEREFORE,your petitioner respectfully prays your Honorable
Court,under and by virtue of the provisions of Section 543 of the Fiduciaries
Act of 1949,as amended,for permission to become a purchaser,at private
sale,of decedent's real estate;and for a further order fixing time and place
for the final consideration and disposition of the private sale of such real
estate to her.

LAST WILL AND TESTAMENT
I,CECELIA KACZMAREK,also known as CELIA KACZMAREK,
of Donora,Washington County,Pennsylvania,do hereby make my Last Will
and Testament and revoke any and all Wills heretofore made by me.
FIRST:I direct that all my just debts and funeral expenses be paid as
soon as conveniently may be after my deat.h and,for the purpose of paying
my funeral expenses,I give,devise and bequeath unto my son,Walter
Kaczmarek,my Savings Account No.12739,Union National Bank,now Mello
National Bank and Trust Company,Donora Office;the remainder to be retain d "
by my son,Walter Kaczmarek.
SECOND:I give,devise and bequeath all the rest,residue and remainder
of my estate,whether real,personal or mixed and wheresoever the same
may be situate,as follows:
(A)One-half thereof to my son:,Walter Kaczmarek,his heirs and
assigns.
(B)One-half thereof to Walter Kaczmarek,in trust,however,for my
son,Theodore Kaczmarek,provided my son,Theodore Kaczmarek,is livinl
at the time of my death,and in the event my son not be then living,then I
give,devise and bequeath this one-half interest to my grandchildren,namel)
Walter Kaczmarek,Jr.and Franklin Kaczmarek,
This one-half interest is to be held in trust by my son,Walter
Kaczmarek,for the above named party or parties,as the case may be,and
is to be disbursed and paid out by my son,as said trustee,in his sole
discretion and as he feels is right and proper under the circumstances.
THIRD:

I nominate and appoint my son,Walter Kaczmarek,as Executor
of this my Last Will and Testament and as Trustee or Testamentary Guardian
as the case may be,of the above named trust,and he shall have the right to
retain any or all of the assets of my estate,real or personal,without regard
to any principle of diversification,risk or productivity,and it shall be in his
sole discretion whether to sell or rent the real estate which at any time may
form a part of my estate.

(hereinafter called "Buyer"),
Between ANN KACZMAREK,Administratrix,c.t.a.of the estate of Cecelia Kaczmarek,
a/k/a Celia Kaczmarek,deceased,late of Donora,Wash.Co.,(\..Pa.aft 11 d "S 11")dueremercae e er an
.ANN YERKEY,of Monongahela,Wash.Co.,Pa.
WITNESSETH,that for the consideration hereinafter set forth and intending to be legally bound the Seller and
Buyer mutually agree as follows:
1.Seller agrees to sell and convey to buyer on or before
by general warranty deed in fee simple absolute,dear of all mortgages,judgment liens
and tax liens and other encumberances affecting its marketability (except as hereinafter set forth)all the real property
described in Paragraph 7 hereof.
2.Buyer agrees to purchase said real property and to pay Seller therefor the ,sum of Three Thousand

of above named decedent,a petition was presented at the above captioned
number fbr approval of the proposed private sale of real estate of said
decedent,described as Lots Nos.5 and 6,in Block No.61,Union Improve-
ment Company's Plan of the Borough of Donora,Washington County"Penn-
sylvania,and more fully described in the attached petition,to Ann Yerkey
for the sum of $3,500.00;it further appearing,upon the date and at the time
fixed for the Court's final consideration of said petition,that,in conformity
with the Court rules,upon the filing of the required proofs of publication
together with affidavits of notice to interested parties,there being no one
present in open Court interested in same,the sale is hereby confirmed.,
to Ann Yerkey for the following described real estate:,
ALL those certain pieces or parcels of land situate
in the Borough of Donora,Washington County,Pennsylvania,
and described as follows:
Lots numbered 5 and 6 in Block numbered 61,lying
between Kenyon Alley and Thirteenth Street;fronting on McKean
Avenue 60 feet,together,and running back 100 feet and having
a rear of 60 feet,together,on Linden Alley.
Said lots being in and more particularly shown by the
Union Improvement Company Plan of Lots and designated as the
Second Addition to the Town of Donora.which plan of lots is
recorded in the Office for recording Deeds,etc.,for Washington
County,in Plan Book Volume 2,page 124.
Excepting and reserving all the natural gas and oil
underlying said land but no wells shall be drilled on the same for
either.
BEING the same property as was conveyed to Frank
Kaczmarek and Cecelia Kaczmarek,his wife,by Mrs.Margaret G
Laird and James Laird,her husband,by deed dated July 17,1924
and recorded in Deed Book Vol.524,page 314,records of Wash-
ington County.The said Frank Kaczmarek predeceased Cecelia
estate.
Kaczmarek and title vested in her by~operationof law.
That the purchaser being the sole representative of decedent's
Russell Marino,Clerk of the Orphans'Court is ordered to
execute a deed conveying the above described premises to Ann Yerkey with
no responsibility on the Clerk of the Orphans'Court to collect or account
for any or all of the purchase price.

I would like to call the Court's attention in the will tbey dreate:
a trust with a half interest to Theodore Kaczmarek.But I discussed
that with the Court.He is sui juris and I see no reason to continu
the trust.And there is very little balance if any due him because
this real es tate was sold in Orphans'Cp}lrt private sale.And
?
the necessary funds to pay the bills in this estate were advanced
by Ann Kaczmarek,the Administratrix,and the two sons.And I
felt that Theodore Kazcmarek should be charged with at least one
half of the cash advanced by the other individuals to settle Le estc te.

was the cost of evicting Ted Kaczmarek from the real estate:

Ted owed rent from the -date of his mother's death through August
1971.a total of 39 months at $35.00 ($1365.00).
The rent shown in the account was paid by one of the Kaczmarek boys
who resided there for a short spell.He paid $35 per month for the
house.so Ted is charged with same rent.
Ted moved into the house after his mother's death.He lived in
Clairton before that.
