PETITION FOR PRIVATE SALE OF REAL ESTATE UNDER SECTION 543 of FIDUCIARIES ACT OF 1949)AS AMENDED To The Honorable)The Judges of Said Court: Your petitioner,ANN KACZMAREK,now known as,ANN YERKEY,respectfully represents: 1.That Cecelia Kaczmarek,also known as,Celia Kaczmarek,died testate,February 27,1967,a resident of Donora,Washington County, Pennsylvania. 2.That your petitioner,was appointed Administratrix,C.T .A.of the estate of Cecelia Kaczmarek,also known as Celia Kaczmarek on March 14, 1967 by Josephine M.Douglas,Register of Wills of Washington County, Pennsylvania. 3.That the decedent by paragraph 'iSECOND"of her Last Will and Testa- ment dated June 23,1959,a copy of wtIich is attached hereto as Exhibit "All devised to her son,Walter Kaczmarek;his heirs and aSSign,one-half interest in the residue of her estate and the other one-half interest to Walter Kaczmarek in trust for her other son,Theodore Kaczmarek.,The said Walter Kaczmarek,predeceased his mother,the testatrix,having died on December 3,1966 and was survived by his wife,Ann Kaczmarek,your petitioner and his two sons,Walter F.Kaczmarek and Franklin Kaczmarek. In addition she was also survived by her other son,Theodore Kaczmarek, who presently resides in the real estate,which is the subject of this petition, All of the heirs are sui juris. 4.The decedent at her death possessed a personal estate of inventoried value of $1,039.87 being a savings account in the Mellon National Bank and Trust Company,Donora Office,Donora,Pennsylvania;and the following real estate to wit: ALL those certain pieces or parcels of land situate in the Borough of Donora,Washington County,Pennsylvania,and described as follows: Lots numbered 5 and 6 in Block numbered 61,lying between Kenyon Alley and Thirteenth Street;fronting on McKean Avenue 60 feet,together,and running back 100 feet and having a rear of 60 feet,together,on Linden Alley. Said lots being in and more particularly shown by the Union Improvement Company Plan of Lots and designated as the Second Addition to the Town of Donora,which plan of lots is recorded in the Office for recording Deeds,etc.,for Washington County, in Plan Book Volume 2,page 124. Excepting and reserving all the natural 'gas and oil underlying said land but no wells shall be drilled on the same for either. '...~I.. BEING the same property as was conveyed to Frank Kaczmarek and Cecelia Kaczmarek,his wife,by Mrs.Margaret G.Laird and James Laird,her husband,by deed dated July 17,1924 and recorded in Deed Book Vol.524,page 314,records of Washington County. The said Frank Kaczmarek predeceased Cecelia Kaczmarek and title vested in her by operation of law. 5.That no real estate of the decedent has been sold. 6.That your petitioner has procured and attached hereto a certificate of assessed valuation,a copy of the inventory as Exhibits IIB II and "CII. 7.That your petitioner deems it necessary and proper in the administration of the decedent's estate that the above described real estate of decedent be sold under the provisions of Section 543 of Fiduciaries Act of 1949,as amended. 8.That your petitioner deems it necessary as alleged in the preceeding paragraph to sale this real estate.Theodore Kaczmarek,an heir and son of the decedent,is in possession of the property and has refused to cooperate with your petitioner in any matter whatsoever,particularly ascertaining a fair and reasonable rent for the property,if he so desires to remain there,or to consider purchasing the remaining interest,or to even pay the current real estate taxes.That-your petitioner has had to advance the sum of $50.00 to stay the sale of this property by the Washing- ton County Tax Claim Bureau and entered into an agreement to pay the remainder of the real estate taxes,a copy of which is attached hereto as 9.That your petitioner is desirous of being permitted to purchase,at private sale,the real estate of decedent and believes and therefore avers that her hereinafter offered price is a better price than can be obtained at a public sale thereof. 10.That your petitioner;subject to the approval of this Court,has entered into written articles of agreement,copy of which is attached hereto as Exhibit "E'i with herself,personally to purchase the real estate as a whole for the price or sum of $3,500.00,which price she believes is a full and fair price therefore and a better price than can be obtained at a public sale thereof;as will appear by affidavits of two competent and disinterested persons familiar with the values of real estate,which affidavits are attached hereto as Exhibits "F"and "Gil. WHEREFORE,your petitioner respectfully prays your Honorable Court,under and by virtue of the provisions of Section 543 of the Fiduciaries Act of 1949,as amended,for permission to become a purchaser,at private sale,of decedent's real estate;and for a further order fixing time and place for the final consideration and disposition of the private sale of such real estate to her.
