PETITION TO REMOVE PERSONAL REPRESENTATIVE
AND NOW,,comes George Bindi,by his attorneys,Murphy and France,and
petition your Honorable Court as follows:
1.Petitioner is an individual who resides at 800 Casanova Avenue,
Apartment 101,Monterey,California,93940,and is a brother of.and a beneficia-
ry of B.Gene Bindi who died intestate on October 1,1970.
2.Letters of Administration were issued to Thomas Bindi and Victor
Bindi by the Register of Wills of Washington County,Pennsylvania,on October
9,1970.The said Thomas Bindi resides at R.D.#,1,Belle Vernon,Pennsylvania,
and the said Victor Bindi resides at 1245 Country Club Road,Monongahela,
Pennsylvania.'
3.The Administrators filed an Inventory on August 26,1974 listing
the value of the Estate at $20,000.00 real estate with a supplemental inventory
including an additional $862~32.
4.On or about M~rch 26})974'the sum of ~8,122.40 was paid into the
Estate by Pert Sa1es,P.O.B?x 81,Monroeville,Pennsyl~ania,15146 for the sale

of 10,153 cubic yards of clay at $.80 per cubic yard,'.
5.The Administrators in this Estate have made an advance distribu-
tion from the cash proceeds of the'aforesaid sale of clay in the amount of
$1;068.60.However,the share of George Bindi was improperly and illegally
paid by the Administrators to Thomas Bindi,one of the Administrators on an
alleged claim that the said George Bindi owed Thomas Bindi an amount in excess
of the said $1,068.60.
6.A sale of the real estate listed in the Inventory is contemplated
in an amount of approximately $32,000.00.On September 14,1978 the said
Thomas Bindi advised the Attorney for the Petitioner George Bindi that he
intended to apply whatever share of the proceeds of said sale,whi&h may be
distributable to the said George Bindi to himself Thomas Bindi as an individual.
Said Thomas Bindi acknowledged that any debts of George Bindi were dissolved in t,l

a Bankruptcy filed by him in the United States District Court for the Western
District of Pennsylvania on October 4,1968 at No.68-292 and that an indebted-
ness listed therein to Thomas Bindi in the amount of $20,000.00 is discharged.
.7.The said Thomas Bindi further acknowledged that any other claims
he mayehave against the said George Bindi are beyond the Statute of Limitations.
8.Petitioner believes that both Administrators,Thomas Bindi and
Victor Bindi,should be removed and an impartial Administrator appointed by the
Court to carry out the proper Jegal and orderly di str'ibuti on of the Estate.
WHERERORE,petitioner pl1ays your Honorable to terminate and discharge
Thomas Bindi and Victor Bindi as Administrators in the within Estate and to
appoint an Administrator in their place to complete the administration of this
Estate.

1.That B.Gene Bindi,a resident of East Main Street,
Monongahela,Washington County,Penrtsylvania,died intestate on
October 1,1970,and Letters of Administration thereon were
granted to Victbr Bindi and Thomas Bindi on October 9,1970,b~
the Register of Wills,Washington County,Pennsylvania.
2.That the assets of this estate consisted of real
estate valued at $20,000.00,insurance proceeds in the amount
of $86i.32,and proceeds from the s~le of clay in the amount
of $8,122.40.

WHEREAS,certain conveyances of record have been made
from and out of the foregoing tracts \vhich are ex cepted and re-
served from the operation of this agreement as they appear of

granted a right of way to John Kirschner,et ux.,et al.,his
heirs and assigns,which is acknowledged in this agreement and
declared to be outstanding.
NOW THEREFORE,in consideration of the mutual promises
hereinafter made and intending to be legally bound hereby under
the Pennsylvania Uniform Written Obligations Act,the parties
agree as follows:
1.Seller agrees to sell,convey,grant

clear of all liens and encumbrances,a good
and marketable title in and to the premises
described in Exhibit "A"att·ached hereto
and made a part hereof;subject only to the
following:

2.Buyer agrees to pay the total sum of
$35,000.00 for the premises described in
paragraph one payable as follows:

approving the terms of this agreement in the
amount of $500.00 without interest.
The entire balance shall be due and payable on

3.Buyer may demand and receive a deed for

permit has been acquired at the cost and expense

to file an application or petition to the Court
under Section 3353 of the Probate Estates and
Fiduciaries Code for the purpose of providing
a good and marketable title fa the Buyers.

of the Buyer on and after January 1,1979 for

eluding this agreement to fulfill its spirit and
intent.
12.The parties understand and agree that all
money paid pursuant to the terms of this agreement
shall be paid to the Sell~rs through the Merico S.
Lignelli Real Estate Agency,who shall be entitled
to deduct a cormuission of seven per cent (7%)on
all monies paid.
13.The Sellers heieirt agree to do and perform
all things required necessary to vest good ahd
marketable title pursuant to this agreement in-
eluding payment of all taxes (ad valorem and
inheritance);to present petitions for approval
of this agreement under the Probate Estates and
Fiduciaries Code and to do all other things
necessary within a period of sixty (60)days
following the date of this agreement;and to ex-
peditiously cause the approval of this agreement
so that the intent and purpose thereof may be
fulfilled.

1.That Thomas B~ndi 'does owe to George Bindi the sum of One thousane!

sixty eight and 00/100 ($1,068.00)Dollars,being the pro-rata share of the
proceeds of certain clay rights as sold from the Estate of B.Gene Bindi.
2.That Thomas Bindi shall repay this debt owed to George Bindi in
the amount of One thousand sixty eight and 00/100 ($1,068.00)Dollars by fore-
going any advance distributions from the Estate of B.Gene Bindi,from the
proceeds obtained under Agreement for Sale between the Estate of B.Gene Bindi
and the Pelissero Brothers,said Agreement dated the 1sC day of 'Dtcl5~ee;t,1972.
At such time as this debt owed by Thomas Bindi to George Bindi is repayed,then
Thomas Bindi shall share equally with George Bindi,Victor Bindi and Richard
Bucchianeri,Assignee of Gena Bucchianeri,their heirs,successors or assigns,
as the sole surviving heirs of laws of B.Gene Bindi,deceased,in any future
advances or distributions made in 'the Estate of B.Gene Bindi.
3.In order that George Bindi be guaranteed his future pro?rata shar~
of any future advances or distribution,it is agreed that S.Barry Anderson,
or his successor,b.e a co-signatour to any checks or other commercial instru-
ments representing advances or distributions in the Estate of B.Gene Bindi.
Further,S.Barry Anderson or his successor is to retain direct control over al

assets of the Estate of B.Gene Bindi.In no event shall Victor Bindi or Thomas
Bindi individually or together be permit~ed to assigQ,set over and advance or
distribute any assets from the Estate of B.Gene Bindi without the full know-
ledge and control of S.Barry Anderson,Esquire or his successor.Any successor
to S.Barry Anderson is to be approved by George Bindi.
4.That George Bindi or his legal representative be furnished with
an accounting of the Estate of B.Gene Bindi to date,showing such assets
received and liabilities paid or incurred,further,that George Bindi or his
legal representative is to be advised and kept informed of increase of assets
or the decrease or increase of past or to be incurred liabilities.
5.As future advances or distributions are made from the Estate of
B.Gene Bindi,then,such advances or distributions are to be distrmbuted in
equal 1/4 shares to Victor Bindi,Thomas Bindi,George Bindi and Richard
Bucchianeri or their successors,heirs or assigns.However,in no event,unless
agreed to.otherwise in writing,shall George Bindi receive any amount less than
an equal 1/4 share of the advance distributions as made from now and into the
future.

6.That George.Bindi,will have no objection to the continuatihon of
Victor Bindi and.Thomas Bindi as Co-Administrators of the Estate of B.GeneI
Bindi,so long 'as the provisi~ns of these Stipulations are continued and abided
with,and so long as George Bindi is maintained as a heir of law of B.Gene
Bindi,with the full rights to a 1/4 share in the advances or distributions from
the Estate of B.Gene Bindi.

BILL OF SALE AND ASSIGNMENT made and executed by GENA BUCCHIANERI,
residing at 326 East Main Street,Monongahela,Pennsylvania 15063,to RICHARD
BUCCHIANERI residing at 301 Barbara Drive,Monongahela,Pennsylvania 15063.
WHEREAS,B.GENE BINDI died intestate a resident of Monongahela,
Washington County,Pennsylvania on the 1st day of October,1970,leaving no
known Will,and
WHEREAS,Letters of Administration were granted by the Court of Common
Pleas of Washington County on the 9th day of October,1970 to Thomas Bindi and-Victor Bindi,and
WHEREAS,the said B.Gene Bindi,at his death,left four surviving
heirs:Victor Bindi (brother),Thomas Bindi (brother),George Bindi (brother),
and Gena Bucchianeri (sister),and
WHEREAS,by virtue of the death of the said B.Gene Bindi,Gena
Bucehianeri acquired an undivided one-fourth (1/4)interest in the Estate of
B.Gene Bindi,and
WHEREAS,the records of the Recorder of Wills office of Washington
County,Pennsylvania,at Estate No.63-70-992,reflect the aforementioned
facts,and
WHEREAS,Gena Bucchianeri desires to assign,give,and sell her entire
interest in,to,out of and from the Estate of B.Gene Bindi to Richard Bucchianeri,
INOW,THEREFORE,KNOW ALL MEN BY THESE PRESENTS,that I,GENA BUCCHIANERI,
a citizen of the United States,for in consideration of the sum of $1.00,and
other good and valuable considerations,to me paid by RICHARD BUCCHIANERI,
receipt of which is hereby acknowledged,have granted,bargained,sold,released,
conveyed,assigned,transferred,and set over and by these presents do hereby
grant,bargain,sell,release,convey,assign,transfer,and set over unto
RICHARD BUCCHIANERI,his heirs,successors,and assigns,my entire interest and
all of my right,title,and interest,property,claim,and demand of me,of
every kind and nature whatsoever in law or equity,vested or contingent of,in
and to the Estate of B.Gene Bindi,

I.POWER OF ATTORNEY

Richard Bucchianeri~his heirs~successors and assigns~my true and lawful
attorney forever~for me and in my name~to ask~demand~sue for~recover and
receive from the Administrators of the aforementioned Estate~any and all sums
of money or property of any nature now or hereafter due~owing~payable of
distributable to me by the said Administrators~their successors or assigns~
out of said Estate~and valid receipts~releases and acquittances to make~exe-
cute and deliver~with authority to endorse and/or sign my name on any securitie
and on any checks or other documents of any character~distributed by said
Administrators~their successors or assigns~for or on account of my interests
in said Estate herein assigned and conveyed~with the same force and effect as
if the said sum or sums of money had been paid to me directly~and as if such
makings~endorsements~receipts~releases and acquittances had been made by me~
giving and granting unto the said Richard Bucchianeri~full power and authority
to do and perform all and every act and thing whatsoever requisite and necessary
to be done in and about the premises~as fully to all intents and purposes as
I might do personally~with full power of substitution and revocation~hereby
ratifying and confirming all that the said Richard Bucchianeri~his heirs or
substitutes shall lawfully do and cause to be done by virtue hereof.This
power is irrevocable~being coupled with an interest.
II.DIRECTION TO THE ADMINISTRATORS
I~Gena Bucchianeri~hereby irrevocably authorize~empower and direct
the Administrators of the abovementioned Estate of B.Gene Bindi~their successors
and assigns~to pay~transfer and deliver to the said Richard Bucchianeri~his
heirs~successors and assigns~my entire share of the .Estate and any distribu-

tion hereafter to accrue or to be made in connection therewith,and not to make
any payment,conveyance,transfer or distribution to me.The receipts,releases,
accords and satisfactions of said Richard Bucchianeri,his heirs,successors
and assigns,shall be accepted as my receipts,releases,accords and satisfac-
tions and as full and sufficient evidence of the payments,distribution and
delivery of the cash and other property covered thereby,with the same force
and effect as if such payments,distributions and deliveries had been made to
me directly.I do hereby waive my right to receive notice of the time,place,
payment,distribution or delivery thereof,and waive my right to consent or
object to said payments,distributions and/or deliveries and assign said noticesl
and rights to consent or object to Richard Bucchianeri,his heirs,successors
or assigns.
III.AGREEMENT AS TO THE INTENTION OF THE
PARTIES
The interests in the abovementioned Estate of B.Gene Bindi which I
hereby assign are intended to include any and every interest I may have in the
Estate,no matter how derived,in Lt_s entirety.
This assignment is being executed by me in duplicate and I hereby
agree that each and everyone of the two executed copies shall be considered
an original.
This assignment shall be binding upon me,my heirs,executors,admin-
istrators and assigns.
This assignment and all of its terms shall inure to the benefit of
Richard Bucchianeri,his heirs,successors and assigns.
IN WITNESS WHEREOF,and intending to be legally bound hereby,I have

parcels,the estimated market value thereof as of date of death of decedent.
That Schedule B attached hereto and made part hereof sets forth fUlly and in detail allpersonal
property wheresover situated owned by the decedent at the time of death;all moneys left by the decedent
at the time of death,Whether in decedent's immediate possession,standing to decedent's credit in banks
of deposit,saVings banks,trust companies,or other institutions,whether individually,or in trust for
any other person or persons giving also separately the accrued interest thereon,if any,down to the last
interest day prior to decedent's death in the case of savings banks,and to the date of decedent's death
in all other cases;all bonds,postal savings,treasury certificates or notes and other evidence of in-
debtedness of the United States to the decedent;all obligations,whether by statute or agreement they
are designated as tax free,of the Uni ted States,or any state,or political subdivision thereof,or of
any foreign country,which are owned at the time of death;all wearing apparel,jewelry,silverware,pic-
tures,books,works of art,household furniture,horses,carriages,automobiles,boats,and any and all
other personal chattels of whatsoever kind or nature,left by decedent,together with the fairly estimated
market value thereof;all bonds and mortgages held by decedent and of all claims due and OWing decedent
at the time of death,and all promissory notes or other instruments in writing for the payment of money
of which decedent died possessed,of whatsoever nature,with interest thereon,if any,giving the face
value and estimated fair market value thereof,and if such estimated fair market value be less than the
face value,it sets forth briefly the reasons for such depreciation as to each item;all moneys payable
to the estate from life insurance polici'es carried by decedent;all annuity and endowment contracts the
proceeds of which were payable upon the death of the decedent;and all the corporate stocks and dividends
due thereon and unpaid as of the date of death,bonds and accrued interest thereon to the date of dece-
dent's death and other investment securities owned by the decedent at the time of death,with the market
value thereof at such time.
In the case of securities of close or family .corporations,.'the values reported are as far as
possible substantiated by financial statements of the corporations,showing the assets and liabilities
thereof as of the date of death.The schedule also sets forth tl,1e interest of decedent at the time of
death in any co-partnership or business,and in support of the value of such interest there is annexed to
said schedule,'financial statements showing the assets and liabilities of said co-partnership or Qusiness.
A copy of the co~partnership agreement,(if oral,a statement setting forth the nature of the'agreement)
together with a statement setting forth the character of the business,its location,and such other facts
pertaining to the business as may be pertinent to a fair and just appraisal of the decedent's interest
therein must be submitted.It should also set forth in itemized form,together with the fair market value
thereof,any other property owned or bequeathed by the decedent at tl,1e time of death.
The Schedule C attached hereto and made part hereof sets fOrth a true answer to each inquiry
contained therein and in the case of transfers ofproperty,real or personal,.within two years of decedent's
death,in contemplation of decedent's death,or intended to take effect in possession or enjoyment at or
after death,said schedule sets forth the nature and value of such property,to whom transferred,the
relationship of the transferees to the decedent,the proportionate share received by each transferee and
all other facts of a pertinent nature regarding said transfers.In the case of transfers intended to
take effect in possession or enjoyment at or after death,there is also attached to the schedule a cOllY
of the deed,trust agreement or other instrument creating the trust••TherH is also set forth in said
schedule a list of all property,real and personal,with ,its value,,\yhich passes at decedent's death by
virtue of the exercise by decedent,either individually,or jointly with another,or any power of appoint-
ment vested in decedent,either individually or jointly,by the Will,deed,or other-instrument of another,
with a copy of the instrument creating such power attached to the schedule.
That Schedule 0 attached hereto and made part hereof sets forth the names and addresses of all
persons beneficially interested in this estate at the time of decedent's death,the nature of their res-
pective interests,their relationship,if any,to the decedent,together With the ages at the time of
decedent's death of all minors,annuitants and beneficiaries for life under decedent's Will.It also
contains a statement showing Which of the beneficiaries named in the decedent's will,if any,died prior
to decedent,the dates of their death,their issue,andthe relationship of suCh issue to the beneficiary.
That Schedule E attached hereto .and made a part hereof sets forth all property,real and per-
sonal,owned by the decedent jointly with another or others,inclUding intangible,standing in the name
of the decedent and others,plus the date and place of record of instruments effecting the vestiture of
real estate and the date of acquisition of personalty,plus the name,address .and relationship,if any,
of co-owners to the decedent.
That Schedule F attached hereto and made a part hereof sets forth fully and in detail all debts
and deductions claimed for and on behalf of this decedent's estate,including funeral expenses paid;
family exemption,where applicable;costs of administration of this estate;counsel fees and fudiciary's
commissions paid or to be paid;cost expended for burial trusts,tombstones or gravemarkers,and reli-
gious services,in consequence of the death of the decedent;debts and claims owing and lmpaid at time of
death;taxes accrued chargeable for period prior to decedent's death (except those allowed lIDder Section
651 of the Inheritance and Estate Tax Act);together with a statement of collateral pledged for obliga-
tions,if any.It is ag'reed that the fiduciary will present proof of said claimed obligations upon re-
quest,that if the amount actually paid in settlement of any fee,commission or debt is less than the
estimated amount claiming and allowed,that the same will be reported to the Register of WillS,and that
the amolIDt of tax assessed can be reassessed in accordance therewith.
