That I,w~LLARD.J.MURPIIY,of Newark,Ohio,'desiring to indicate'in due

.legal form what disposition of my estate is to be made after my decease,do
this 5th day o'f November,1969,at Newark,Ohio,make,publish and declare
my Last Will and Testament in manner and form.following,hereby revoking all
Wills and Codicils uy me heretofore made.
Item 1..r direct that all my just debts,funeral expenses,Federal and State
succession and/or inheritance taxes,and likewise any inheritance and/or
succession taxes imposed because of insurance not a part of the assets
of ~estate ~ha11 be paid by my Executrix out of the residue of my
estate.

Item 28 I hereby give and bequeath to my wife'S niece,Irene Trench,the sum qf
Five Thousand Dollars ($5000.00)to belong to her absolutely and forever.
Item J.I hereby give and bequeath to Pearl Bennett the sum of Five Thousand'
Dollars ($5000.00)to belong to her absolutely and forever.
Item 4.",,',I hereby give,devise and bequeath to my wife,Elizabeth K.Murphy,
thirty per cent (30%)of my "Adjusted Gross Estate",as defined under
the Federal Estates Tax Provision of the Internal Revenue Code,to
belong to her absolutely and forever.My wife shall have the right
to determine what asset~of my estate she desires to select to equaltbasedontheappraisedvalueofmyestate,said thirty per cent (30%)
of my "Adjusted Gross Estate"~My Executors or their successor are
hereby required to select assets including cash that fairly represent
on the date or dates of distribution the appreciation or depreciation
of the value of all property that ~s available for distribution in
satisfac~ion of the dollar amount called for under this paragraph.

and I should die as the result of a common casu~lty or within thirty -
days of each other,such property as she would'have received under
this Item shall be and become a part of the residue of my estate and
shall be held,administered and distributed under the prpvisions of
Item 5 of this my.Last Wi~l and Testament.,'-','
All the rest,residue and remainder of my estate,wheth~r real,personal
or mixed,and wheresoever situated of which I may die s~ized or possessed
or be entitled to at the time of my death shall be divided into two
(2)equal parts:•I

John Willard Murphy,to belong to him absolutely land fOIjever:.I,,I

In the',event my son,.John vlillard Murphy,_should die betore the distribu-
tion of my estate,I hereby eive,devise and bequeath one equal part to
The Park National Bank of Newark,Ohio,in trust for the use and benefit
of my sonrs wife and his children,including any children bo~n after.the
date of the execution of this my Last Will and Te~tament.
Said Trustee is hereby'authorized to use the i:}come from this trust and
if it deems it necessary the corpus of tlus trust for the care,support,
maintenance,education and general welfare of my son's children and for
the care,support,maintenance and general welfare of his wife until
the oldest of his said children attains the age of twenty-five years;
at the.time my son's oldest child attains the age of twenty-five years
,said Trustee shall divide the assets then in said trust into as many ,
trusts as there are children,plus one,and.shall continue to use the
income and if necessary the principal of each separate trust for the
benefit of his wife and children as he~einbefore provided•

Each of ~aid separate trusts for the tenefit of his children shall
terminate an each child attains the age of twenty-five years,and
said Tru3tcc shall at that time distribute any assets in each
separate trust to each child to belong to him or her,as the case
may be absolutely and forever..,
The separate trust created for my son's wife shall continue for her
benefit until her death,at which time said Trustee shall distribute
any assets in said trust for the benefit of my son's wife to my son's
children,share and share alike,to belong to them absolutely and
forever.

In the event my son's wife should remarry all her rights under this
trust and/or the sepaxate trust shall terminate.
I hereby give,devise and beqoeath the other equal part to The Park
National Bank of Newark,Ohio,in trust for the use and benefit of
my'daughter,Sue Murphy Doyle..
Said Trustee shall pay at least quarterly and more often if it is
expedient the net income from this trust to my dauGhter,Sue Murphy
Doyle,until her youngest child attains the age of twenty-one years•
Said Trustee is also authorized in its sole discretion to use any
part of the corpus of this trust for her care,support,maintenance301generalwelfare,taking into consideration any income which she
may have received from this trust or from any other source.
Said Trustee is also authorized,in its sole discretion,to use any'
part of the corpus of this trust for the care,support,·maintenance,
education and general welfare of my daughter's children,regardless
of the portion of said corpus used for any of said children.Said
Trustee shall·take into consideration in the use of the corpus of
this trust for the use of said children any income received by my
daughter from this trust or from any other source.
This trust shall terminate when I'T\Y daughterr s yo ungest child attains
the age of twenty-one yeafs,at which time said Trustee shall dis-
tribute any assets then remaining in said trust to my daughter to
belong to her absolutely and forever.
In the event my daughter,Sue Murphy Doyle,should die before the
termination and distribution of this trust as hereinbefore provided
then said Trustee shall distribute all of the assets remaining in
this trust at the time of termination of this trust to her children
share and share alike to belong to them absolutely and forever~

them,of this my Last Will and Testament,and express the wish that
Letters Testamentary issue to them without bond.

for any-reason to'serve as Executors of this my Last Will and Testament
I hereby nominate,constitute and appoint The Park·National Bank of

son or the survivor of them as Executors,and express the wish that
Letters Testamentary issue to it without bond.

and Testament,and express the wish that Letters of Trusteeship issue

Executors and/or Trustee to change the nature from time to time as they see
fit of the investments which may represent the assets of said estate and/or
said trust,and full power to rrake and receive any and all instruments of
every kind and description to handle the fee simple and absolute titles to
any and all of the assets of said estate and/or trust,and to confer a full
and complete title upon any party to whom any such assets may be sold or
othenvlse transferred and no person who acquires any of the assets of said
estate and/or trust estate shall be .in any degree obligated to look after

TO THE HONORABLE,THE JUDGES OF SAID COURT:
The petition of Walter W.Gregory,Jr.respectfully represents:
1.That your petitioner,Walter W.Gregory,Jr.,is
an individual residing at Washington,Washington County,Pennsyl-
vania.
2.That on July 31,1970 Willard J.Murphy,deceased,
herein called decedent,died testate at Newark,Ohio.Ancillary
3.That on September 25,197o!Letters of Administratio
C.T.A.were granted by the Register of Wills of Washington County
to your petitioner.
4~That on September 24,1970 your petitioner filed with
the Register of Wills a bond in the amount of $1,000.00 with the
United States Fidelity and Guarantee Company as surety.
5.At the time of his death the decedent onned real
estate as follows:One-half interest in:
a.Building known as 144-148 N.M~in Street,in the
Third Ward of the City of Washington,Washington County.
b.Building known as 66 W.Chestnut street in the Seco

thence Southward along lot described as SECOND by a line parallel

30 feet to a point;thence westwardly along lot described at
SECOND by a line parallel with the southern side of Spruce Alley

The said John B.Murphy died December 31,1934,testate,and by
his will dated December 29,1932,duly probated in the Register
of Wills Office of Washington County,Pennsylvania in Will Book
52,page 282,he devised said lot inter alia in trust to his
widow,Anna G.Murphy,his son,Willard J.Murphy,and his
daughter,Katherine M.Burns.The said Anna G.Murphy died
August 27,1935 and fee simple title vested in said Willard J.
Murphy and Katherine M.Burns.
