As there is no balance for distribution,the Court is respectfully requested
to make a Decree closing out the Estate and direct that final audit costs
be paid~and Inheritance Tax on abovementioned joint account,with credit requested
to be allowed as a deduction against said taxable balance of said joint account
for funeral expenses paid by the Executrix from these funds,said funds being
the property of the said Executrix by survivorship,and which funeral expenses,
along with other expenses considered to be preferred,do appear in the duly
filed Account for the total of $3,121.60.

her First and Final Account in the administration of the above Estate,and

no exceptions are filed thereto within the period provided by law.Audit

TO THE HONORABLE P.VINCENT MARINO,PRESIDENT JUDGE:
The Petition of MARY HIDEK FLORKA respectfully represents:
1.That JOSEPH HIDEK of the Borough of Charleroi,vashington
County,Pennsylvania,died testate on the 17th day of September,1970.
2.That Letters Testamentary were issued to your Petitioner
by the Register of ~ills of Washington County,Pennsylvania on the 23rd
day of September,1970,which Letters are still in full force and effect.
3.That the Last Will and Testament of the said JOSEPH
HIDEK,copy of which is attached hereto,was duly proven before the
Register of Wills of Washington County,Pennsylvania on the 23rd day
of September,1970,and was recorded in the Office of the said Register 0
Wills in Will Book Vol.110 521
4-.That there has been no specific devise of the real
property of the decedent hereinafter mentioned.
5.That your Petitioner has filed security with the Register
of Wills of Washington County,Pennsylvania,in the amount of $1,000.00
with United States Fidelity and Guaranty Company,as surety.
6.That the only asset of the above Estate consists of
two parcels of real property,situated in the Borough of Charleroi,

Washington County,Pennsylvania,described in Exhibit fTA fT consisting of
two pages,which is attached hereto and made part of an Agreement of
Sale hereinafter mentioned.
7.That said asset of real property comprises the residuary
estate under the Last Will and Testament of the said JOSEPH HIDEK,deceasEd.
8.That your Petitioner has entered into a written Agreement
with Amour Michaux and Mary D.Michaux to convey said two parcels
of real estate to them for the price or sum of $1,000.00.A copy of said
Agreement is hereto attached and made a part hereof.
9.In view of the small size of this estate,your Petitioner
finds it too expensive to submit affidavits of two responsible real estatl
appraisers,but does attach hereto a copy of the appraisal of the subject
real property,in the amount of $850.00,made by Martin Wehousie,duly
licensed Pennsylvania Real Estate Broker,who is owner and operator of
the C.S.Bateman Agency of Charleroi,Pennsylvania.
'~EREFORE,your Petitioner prays your Honorable Court pursuant
to Section 54-1 of the Fiduciaries Act of 194-9 as supplemented and amended
for an Order excusing her from filing additional security with relation
to the sale of the real estate hereinbefore set forth and authorizing
her to receive the proceeds of said sale.

AND WHEREAS,the said Seller herein,as Executrix of the Estat

Section 541 of the Pennsylvania Fiduciaries'Act of 1949,P.L.512,as
amended,is authorized to enter into this Agreek.3nt for the sole of the
subject premises hereinafter deocribed.
NOW THIS AGREEMENT WITNESSETH:
That the said Seller,in consideration of the covenants and
agreements hereinafter contained on the part of the Buyers to be kept
and performed,has agreed,and does hereby agree,to sell and convey

the preparation of this Agreement of Sale and also for the preparation
of the Daed of Conveyance;
4.That it is the obligation of the Buyers to nee to the
recording of their deed at their expense,and any title examination io
also to be at their expense.
S.In the event the said Buyers,for no valid or legal
reason,fail to consummate this Sales transaction,then the herQinb~fore
