To the Hon.P.V.Marino,President Judge of said Division: The petition of Martin R.Hallam respectfully represents,to wit: 1.Petitioner resides at Washington,R.D.2, Washington County,Pennsylvania,and is a first cousin,once remove~of the above named Mae Hallam Flinta,whose place of residence is No.760,East Maiden Street,Washington,Washington County,Pennsylvania. 2.Said Mae Hallam Flinta,also known as Mrs.J. Frank Flinta,is believed to be upwards of 80 years of age; she is a childless widow;her domicile is in Washington County, Pennsylvania,at the address above stated;and she is presently a patient and has been a patient for more than three weeks in a general hospital,to wit,Washington Hospital,Washington, Pennsylvania,on account of physical weakness and general debility. 3.Petitioner believes and avers he is the nearest of kin of said Mae Hallam Flinta residing within the jurisdiction of your Honorable Court.The parents of the said Mae Hallam Flinta are deceased,she has no brothers,and her only sister,Dollie Hallam Riggle,residing at Akron,Ohio,is older than said Mae Hallam Flinta,and is bedfast.Two nieces of said Mae Hallam Flinta are Iona Marshall,of Akron,Ohio,and Romaine Marshall, of the State of New Mexico,and a nephew,Merle Riggle,resides at Akron,Ohio.A grandniece,Anna Mae Hallam,and a grandnephew, -1- ''-J. Jo Henry Hallam,are believed to reside at or near Columbus, Ohio.Edward E.Gardner,who has lived in the home of said Mae Hallam Flinta,for many years,and is sometimes referred to as her foster nephew,is not in fact related to her in any way. 4.The said Mae Hallam Flinta,because of the mental infirmities of old age,is unable to manage her property,or is liable to dissipate it,or is liable to become the victim of designing persons. s.The said Mae Hallam Flinta by reason of her condition has been unable to give any information relating to her income or personal property or other resources,so that her hospital bill or the charges of a convalescent home or other institution where she may become an inmate may be paid. Petitioner on inquiry has been unable to discover that she has a bank account or securities or a safe deposit box or other personal property (other than the household furniture and equipment in her said home,and possibly a small social security monthly payment).The income she may have had from payments for board and room made by the said Edward E.Gardner cannot continue. 6.The said Mae Hallam Flinta is sole owner of the residence in which she h~s made her home,at No. 760,East Maiden Street,Fifth Ward,Washington,Washington County,Pennsylvania,believed to have a market value of about $12,000.00. 7.Persons who would be entitled to take as heirs if said Hae Hallam Flinta should die intestate are named in paragraph 3 above,all sui juris,but none residents of Pennsylvania.The same persons are the only persons,other than your petitioner,known to your petitioner to be interested in the welfare of said Mae Hallam Flinta or as possible beneficiaries under any existing 'l.'1ill. -2... • 8.The said Mae Hallam Flints was never a member of the Armed Services of the United states and is not receiving benefits from the United states Veterans Administration. 9.No other court has ever assumed jurisdiction in any proceeding to determine the competency of the said Mae Hallam Flinta,and she has no guardian already appointed of her estate. 10.Petitioner is willing and hereby consents to act as guardian of the estate of the said Mae Hallam Flinta, if no other suitable person or corporation is available.His name,address,and relationship to her is stated above.He has no interest adverse to her or her estate. 11.There is urgent need for the appointment of such guardian to ascertain liquid assets or to liquidate and make available other assets,for the care and maintenance of the said Mae Hallam Flinta.It does not appear that she will ever be able to care for herself in her home~as she has in the past,but must be cared for in some sort of convalescent home. 12.Petitioner does not anticipate said Mae Hallam Flinta will be able to appear at a hearing on this petition, and may at such hearing offer the affidavit o~Dr.Benjamin Super,of Washington,Pennsylvania,personal physician of said Mae Hallam Flinta,as to her mental and physical condition,in support of this petition. Gardner,who for many years lived with said incompetent in her said residence and is now living therein to preserve it and its contents,and who is sometimes referred to as said incompetent's foster nephew,is not in fact related to her.Two close friends of the incompetent are Lillian Seik,of Eighty-four,R.D.2, and Lorna G.Braden,31 East Katherine Avenue,Washington,both in Washinr,ton County,Pennsylvania.The Mt.Pleasant Presqyterian Church,in South Strabane Township,Washin~ton County,Pennsylvania, is a religious body to which said incompetent has had close ties. s.Said incompetent's estate,at the time of the appointment of petitioner as guardian as aforesaid,as shown by inventory and appraisement filed,consisted of ~90.71 cash, $883.50 household goods,a $25.00 diamond ring,and two group Prudential Insurance Company policies on the life of said incompetent,in which the said Edward E.Gardner was named beneficiary,and which were in the possession of the said Enward E.Gardner.Petitioner has now received the cash surrender value of sAid policies,inrhe sums off~7 99.96 and ~3S79.47,respectively. Petitioner has not paid legal fees and costs,and no other bills except for the preservation of said residence property.Petitioner now has in his hands cash in the sum of ~1,326.05.Said incompetent receives $42.70 monthly socia:2!eCurity payments. But I presented the claim because of Mr.Anderson's absence for illness at that time.I wanted to protect our client. I might state also that our claim is a judgment which is on record.It is a preferred claim ,, 6 then in the Extended Care Facility for quite ~number of years. A Arrangem ents were made to take her to the hos pital. Q Washington Hos pital ? A Yes. Q How long was she there? A She was there 38 days. 4 Q And then where did she go? A To Was hington Manor. Q Is that what is now called the Extended Care Facility of the Washingtlon Hospital? Yes. Who arranged to take her to the Manor? Well.I think the answer to that is Attorney Anderson and mys elf. Are there any relatives that you know of in this area related to her more closely than yourself? No. Haveyou talked to Mrs.Flinta about the necessity for paying for her care and her bills? Yes. Have you been able to find whether she has any bank accounts? No.sir. Do you mean that she hasn't any? If she had she hasn It told me where they are. You have asked about it? Many times. Do you know the amount of her monthly Social Security check? Right around $50.00. Do you know of any other income she might have? No,sir. What was her occupation? Well,at one time s he did practical nursing by keeping people in her own horne.Other than that,I'd say housewife. Q Are you willing,if the Court appoints you,to act as guardian for Ml s. Well,everybody called her Aunt Mae.That was the natural thing fo some reason.No matter where she went. Did she call you her nephew? At times,yes. Now would you know whether Mrs.Flinta was ever a member of the Arm ed Services of the United States? .1I A Not to my knowledge. Q Would you say no? A I would say no. Q Do you know whether she had been receiving any benefits from thle United States Veterans Adm inistration? A No.She doesn't get nothing like that. Q Do you know what her income has been? A Well,outside of before she got her Social Security she had---there was three of us boys boarded and roomed there.That was about the only income she had at that time. Q At the present time what does she have? A Social Security and whatever I pay for board and room and outside of the work I do. Q Outside of what? A The work I do for her around the house. Q Does she have any bonds at home oc stocks? A I wouldn't know that . .Q Were you at home about the time in August when she went to the 11 hospital? A Yes. Q What was her condition then? A Well,I'll tell you,when I sleep upstairs and I came downstairs in the morning she was pretty much t.9,tllused,I would say.She was q confUSed. Q You mean mentally? A Yes. Q Physically,what was her condition? A She was in very good shape. Q Why did you take her to the hospital? A That's w here the doctor wanted her. Q How long was she in the hospital? A Ei12he,rr 37 or 38 days,if I remember correctly. Q Who was the doctor? A Dr.Super and Dr.Hess. Q Then where did she go? A She went from the hospital to the Manor. Q Is she still ther e ? A Yes. Q When did you see her last? A Yesterday ,about 11:00 o'clock. Q Was she up and around or was she in a wheel chair? A When I was there she was eating her lunch. 12 Q Was she in a wheelchair or was she up and around? A She was sitting at the table. Q Was she in a wheelchair? A No.She was sitting in the chair.When she goestfrom the diningroom to the table they take her in a wheelchair. A No. MR.ANDERSON:Haveyou paid any of her bills? A I paid all the utility bills. MR.ANDERSON:Did you pay anything at the Manor? A I paid her Social Security Check and $10.00.That would be about $50.70. MR.ANDERSON:Was that $10.00 your own money? A That was her money,yes?she had from the last check after I paid the bills. MR.ANDERSON:All You have paid her in th e last two months or paid for her benefit have been the utility bills. A Yes,about--well,fifty to sixty dollars.The utility bills runs about $30.00 a month. A I'm supposed to be divorced. Q Wlat is your occupation? A I was a clerk in a drycleaning.Now I'm unemployed. Q Do you know Mae Hallam Flinta? A Yes. Q How long have you known her? A I've known her for a good many years,but about the last 16,17 years it's 'jUSt been like my home.I've been in and out of it. Q Were you in the home early in August of this year? A Yes,I was. Q Did you come to see me at that time about her physical condition? A Yes.I was with her before she went to the hospital. Q What was her physical condition and mental condition? A Her mental condition was fairly good.But then she was off now and then.But on a Saturday on the 15th of August,she was real confused. Q What about her physical condition? A She was pretty weak and she wouldn't eat and that.And I figured she 15 needed medical care more than what she was getting at home. Q Do you know how long she had been without substantial food? Dr.Super was not called in until we put her in the hos pita!. He was the one who saw she went to the hos pital ? Nobody was allowed to admit her to the hospital,yes. Didcy-Ou visit her in the hos pital ? Yes,I did. Did you know that she is now in the Manor? I do. Do you know who her attending physician is now? No,I don't. V.'When did you see her last? It would be three weeks this coming Wednesday since I last saw her. What did you find 'out about her physical condition? Well,she was just sitting in the chair.They had her in a chair and she was confused. Q In what respett was she confused? 17 A Whenever I walked in there she had one of her rings off playing with it.And I said,"What are you doing with your ring?II She said,"I'm going to give it to the lady across the hall for her for her to go home " And I told her I \\Ould give it to her and she said,"Give me the monelY and you can have the ring.II I said,"1'11 take the ring and I'll keep it in my pocketbook until you want it.II She said,"Don't put it in the pocketbook;wear it.II So I never wore it until I contacted you last week and I've still got it in my purse. Did s he offer to s ell it to you? She gave it to me for $1.00. I think that's all,Mrs.Higginbotham.That's all we have,Your Hor:or, with the exception of the medical testimony.Dr.Super,I have bee n told,is ill.I'm not sure,but at any rate I don't think he has seen her since she went to the Manor.At the Manor Dr.Hess is the hom:e physician.But he has been (unrvacation all the time that Mrs.Flinta has been there.And Dr.M.W.Graham has attended her and he promised me that he would be here this morning.He told me that in his opinion she couldn't come to the hearing and in his opinion she should have a guardian on account of her inability to handle her prop::>rty. But we will produce him if Your Honor wishes to hear him.I think Your Honor has caught the significance of this.I forgot to ask anybcdy her age.Mr.Gardner,how old is Mrs.Flinta? MR.GARDNER:85.That is she will be85 the fifth of next Jun Thaf's what she told me. A She is quite forgetful as to recent events.Her memory is fairly goo for past events.She is confused as to time and place.She has a tendency to evade questions and is unable to carryon a reasonable conversation.By that I mean islhe will change the subject of a discus ion several times during the cou rse of quizzing. Q What about her physical condition? A PhysicallY-F,she has a senile or an arteriosclerotic heart disease with some irregularity of the heart,which is not unusual to find in an elderly person.Organically,she primarily has a progressive senile::}leterioration. Q I think I saw you and Mrs.Flinta in the Manor last Thursday and I noticed she was in a wheelchair.Is that customary for her or does s e get aroun<ili;? A She,will walk.You were seeing her after she had been to occupatio al 20 q therapy and they transport them to and from the therapy in a wheel- chair and they work down there in that wheelchair.It's more or less of a geriatric chair,we call it . Q Is she able to walk? A She is able to walk.We have not permitted her to have freedom, however.She walks with assistance. Q Are you able to form an opinion as to her ability to handle her own property? A From the standpoint that she,it would be my opinion that sinc~she is so forgetful that she wOuld not remember from one day to the next just what she has accomplished and what she may have determined ir one day. Q Well then,do you believe that she is unable to handle her prope rty and should have a guardian or what? A I think that she should have somebody act for her.
