PETITION FOR ADDITIONAL BOND The petition of JON MICJAN respectfully represents: 1.That John Thomas Micjan died intestate on August 12,1970,and was a resident of the Borough of Centerville, washington County,Pennsylvania,P.O.address Box 385,Denbo, Pennsylvania,15429. 2.That your petitioner,Jon Micjan,was appointed Administrator of the Estate of John Thomas Micjan, deceased,by the Register of Wills of Washington County, Pennsylvania,on December 23,1971,said proceedings being of record in Bond Book 64,at Page 283. 3.That the said John Thomas Micjan was survived by the following heirs: a.Jon Micjan,son. b.Gregory Micjan,son. 4.That the Estate of the said John Thomas Micjan consisted only of a tract of real estate situate in Centerville Borough,Washington County,Pennsylvania,being Lot No.18 in the Denbo Plan of Lots laid out by Jones &Laughlin Steel Corporation.The said premises were conveyed to the said John T.Micjan and Anna Micjan,his wife,by Alex J.Shurzinske et ux.by Deed dated the 26th day of March,1951,and recorded in Deed Book 775,at Page 567. 5.That the said John Thomas Midjan,by appropriate proceedings in the Court of Common Pleas of Washingto' County,Pennsylvania,at No.6562 in Equity',was adjudicated to b mentally ill,the said order for commitment being dated January 14,1970.As a result of such order,the said John Thomas Micjan was committed to Torrance State Hospital where he eventually died on August 12,1970. 6.That the certificate of the physioians' filed in the Equity proceeding above referred to,d~monstrate that the said .John Thomas Micjan was mentallY ilIon ,January 8, 1970. 7.That the said John Thomas Micjan,on the 8th day of January,1970,executed a Deed for the said premises to his son,Jon Micjan,and said Deed was recorded in the Recorder's Office of Washington County,Pennsylvania,in Deed Book 1324,at Page 652.A copy of said Deed is hereto attached and made a part of this Petition. 8.That the said Jon Micjan sold the said premises to Katherine Deems also known as Katherine Deems Staley, the said Katherine Deems having paid the sum of $2,000.00 to the said Jon Micjan for the said premises. 9.That the Attorney for Katherine Deems, also known as Katherine Deems Staley,declined to certify the title to said premises as good liind marketable,on the basis that the Deed from John Thomas Micjan to his son,Jon Micjan,as hereinabove recited,was a nullity,inasmuch the records in the Equity proceeding above recited demonstrated conclusively that the said John Thomas Micjan was mentally ill at the time of the alleged conveyance. 10.That the said Jon Micjan,as Administrator of the Estate of his father,John Thomas Micjan,deceased,has agreed to sell the said pI'"emiseS to the said KatheI'"ine Deems, now known as Katherine Deems Staley,for the sum of $2;000.00. 11.That your petitioner believes that the said sum of $2,000.00 represents the fair market value for the said propeI'"ty. 12.Affidavits as to the value thereof by two competent and disinterested persons who are not in the employ of the petitioner,are attached hereto and made a part hereof as EXhibits "B"and "C". 13.That your petitioner believes that the proposed sale to Katherine Deems Staley is in the best interest of and for the benefit of the Estate of John Thomas Micjan,deceased. 14.That yOUI'"petitioner,in order to comply with Section 541 of the Fiduciaries Act of 1949,as amended and supplemented,desires to give additional security in an amount to be determined by your Honorable Court,said amount to be given by Bond with sufficient corpoI'"ate surety.
