PETITION FOR LEAVE TO MAKE PRIVATE SALE OF REAL ESTATE
TO THE HONORABLE,THE JUDGES OF SAID COURT:
The petition of GLENN LIEBERT,Executor of the Estate of JOSEPH
LIEBERT,Deceased,respectfully represents:
1.JOSEPH LIEBERT,a widowe~,died testate on March 29,1970,
while residing'in'Mt.Pleasant Township,Washington County,Pennsylvania.
2.By the terms of his Last Will and Testament,dated November
20,1961,Glenn Liebert,petitioner herein,was named Executor.On September
11,1970,Letters Testamentary were granted by the Register of Wills of Wash-
ington County,Pennsylvania,without his being required to furnish Bond.A
copy of the said Last Will and Testament is attached hereto,made a part
hereof,and marked,Exhibit "A".
3.The descriptiop"of the real estate to be sold is as follows:
ALL that certain piece or parcel of land situate on the
McDonald-Midway Road,near Primrose in Mount Pleasant Township,
Washington County,Pennsylvania,bounded and described as follows,
to wit-:-
BEING known as the front "part of a lot being known as Lot No.
Six (6)in a Plan as laid out by L.Wright,Engineer,for
Frank Joseph Kriss near Primrose,Washington County,Pennsylvania,
and recorded in the,Recorder's Office 'of Washington County,Penn-
sylvania,in Plan Book Volume 5,page 105,dated April 15,1921.
HAVING erected thereon a dwelling house.

4.The property is presently vacant and no income is being derived
therefrom.
5.The value as shown by the Inventory is the sum of Five Thousand
Dollars ($5,000.00).A copy of said Inventory is attached hereto,made part
hereof and marked Exhibit "B".

6.The names of the parties in interest are Glenn Liebert,your
petitioner,Harry Liebert,Joseph Liebert,Jr.and Doris Zemon,all of whom
are sui juris,Sheila Libert,aged thirteen years,and Mark Liebert,aged
eight years.The Joinder to this petition of all of the said interested
parties as well as the mother and natural guardian of the said minors is
attached hereto,made part hereof,and marked Exhibit "C".
7.Glenn Liebert and Rose J.Liebert,his wife,have agreed to
purchase the said real estate for the sum of $5,000.00 in cash;and in view
of the intended purchase by the fiduciary,it is desirous to secure judicial
approval of the sale,pursuant to the Fiduciaries'Act of 1949,Section 546
(Purdon's Statutes,Sec.320.546).A copy of said agreement is attached
hereto,make part hereof,and marked Exhibit liD".
8.There are no lienholders or holders of any encumbrances of
record who will be affected by the granting of the within Petition.
9.It is the desire of your.petitioner that the said property be
kept and preserved within the immediate family of the decedent and for that
reason,it is requested that the sale to Glenn Liebert and Rose J.Liebert,
his wife,be approved.
10.There is attached hereto,a certified copy of the most recent
County Assessment,showing that the said real estate is assessed in the sum
of $1400.00.Said copy is made a part hereof and marked Exhibit "E".
11.The said real estate has been appraised by two competent
persons who have inspected the real estate immediately before the presenta-
tion of this petition,who are acquainted with the value of said real estate
and other properties in the vicinity of the above premises,and are not
personally interested in the proposed sale.Their appraisals are attached
hereto,made part hereof,and marked Exhibit "F".
WHEREFORE,pursuant to the Fiduciaries'Act of 1949,Section 546
(Purdon's Statutes,Section 320.546),as amended,your petitioner prays
your Honorable Court for leave to make private sale of the within described
