ment of her funeral expenses and after payment of all expenses incident to
the management of the Trust and the discharge of the Trustee,any principal
or income remaining in the hands of the Trustee shall be payable in equal
shares to our five children,Elizabeth Martin Gray,Arthur D.Martin,Jr.•

County,Pennsylvania,hereby declare this to be my last Will and revoke all I
'Vills which I have previously made.
ITEM 1..I direct that my body be buried in the Washington
Cemetery in a grave which has been arranged for by me.
ITEM II.I direct that the expenses of my last illness and
funeral be paid as soon as practicable after my death.
ITEM III.If Anna May Martin,my wife.survives me,I give.i
devise and bequeath all the rest,residue and remainder of my property,real I,and personal and wheresoever situate to the Mellon National Bank and Trust I
Company,Trustee,to expend out of the income and the principal so much of !
the same as may be necessary,in the opinion.of the Trustee,for the care,f
comfort and support of Anna May Martin during her lifetime,and at her death I
for her funeral and internment in the space in the Washington Cemetery which I
I have provided.Such amounts may be applied directly or may be paid to the i
person with whom or the institution in which Anna May Martin resides,or whd
shall be supplying to her the care,comfort and support which she requires.I
without the intervention of a guardian.In the event that Anna May Martin is !
a patient in a hospital operated by the Commonwealth of Pennsylvania,when I
the funds on hand are approxim.ately equal to the estimated Trustee's compen-!
sation and the estimated costs of filing a final account,including counsel fees I
,and $1,200.00.then I direct that the total of such sums shall be retained by I
my Trustee for the purpose of providing a suitable funeral for Anna May Mar-.
tin at an approximate cost of up to $1,200.00,and for the purpose of provid-I
ing for the final account and discharge of the Trustee.
(b)To invest in any real or personal property without
restriction to legal investments.

Corporate Trustee.
To invest in any common trust fund maintained by

ITEM VII.I constitute and appoint Mellon National Bank and
Trust Company,Executor and Trustee hereunder,and I authorize such Ex-
ecutor and Trustee to pay all estate,inheritance,succession and other death
taxes,'imposed or payable by reason of my death,and interest and penalties
thereon with respect to all property comprising my gross estate for death tax
purposes,whether or not such property passes under this Will,out of the
principal of my general estate,as if such taxes were administration expenses.

The Petition of ELIZABETH McGUIER respectfully represents.
1.Your petitioner is the guardian of Anna May Meyer
Martin a/k/a Anna May Martin,a weak-minded person,your petitione
having been appointed guardian by Decree of the Court of Common
Pleas of said County dated June 2,1952,at No.5005 in Equity.
2.The said Anna May Meyer Martin a/k/a Anna May Martin,
the ward of your petitioner,is the surviving widow of Arthur D.
Martin,who died June 23,1970,a resident of the City of
Washington,Washington County,Pennsylvania,leaving a Will dated
July 3,1962,which was duly probated on September 9,1970,in
the Office of the Register of Wills for said County in Will Book
110,page 457.
3.Letters Testamentary thereon were granted to Mellon
National Bank and Trust Company,Executor named in said Will,on
September 9,1970.
4.The names,addresses and relationship of those
interested in said estate and the extent of their respective
interests in said estate are as follows:

5.Your petitioner is informed and,therefore,avers
that the Executor has not completed its investigation of the
assets of the estate and consequently has·not filed its Inventory
of th~assets of said estate.
6.In the absence of an Inventory of the assets of said
estate,the petitioner is unable to ascertain whether it is in
the best interest of the ward to elect to take under or against
the Will.
WHEREFORE,petitioner prays your Honorable Court under
Section 11 of the Wills Act of 1947 (20 P.S.180.11)to extend
the time for making the election for a period of thirty (30)
days after the filing of the Inventory of the assets of the
estate by the Executor.

investigation of the assets of the estate but your petitioner is
informed that the assets of decedent's estate will appraise at
approximately $15,000.00.
6.That the assets of the incompetent's separate
estate of which your petitioner is guardian consists of the
following:
First Federal Savings and Loan Association
of Washington -Savings Account
House and lot at 109 Church Street,
Washington,Pennsylvania rents at $80.00
per month,having an estimated value of
$2,880.91

7.That under ITEM III of the Will of Arthur D.
Martin,the residue of said estate is devised and bequeathed unto
Mellon National Bank and Trust Company,Trustee,to use the
income and so much of the principal as may be necessary for the
care,comfort and support of the incompetent during her lifetime
and at her death,to provide for her funeral and burial and
under ITEM IV of said Will,whatever remains of said estate at
the death of the incompetent shall be payable in equal shares to
the decedent's five (5)children named in Paragraph 4 hereof.
8.That the incompetent is 74 years of age,is
confined to Dixmont State Hospital and has been a patient at
mental hospitals in the Commonwealth for upwards of thirty-five
years.The cost of maintaining the incompetent at Dixmont
Hospital to the bes~knowledge,information and belief of your
petitioner is $5.00 per day a portion of which is being defrayed
by a Social Security Allotment of $133.00 per month payable
directly to Dixmont State Hospital.

9.Petitioner believes and therefore,avers,that it s
in the best interest and welfare of incompetent,considering her a e,
and physical and mental condition that she be permitted through
her guardian to elect to take against her husband's Will.
WHEREFORE,petitioner prays that a Citation be
awarded directed to Mellon National Bank and Trust Company,
Executor under the Will of Arthur D.Martin a/k/a Arthur Daniel
Martin,to show cause why the prayer of this petition should not
be granted.

between Mr.Martin and the Commonwealth for maintenance charges
far his wite's confinement at Dixmont State Hospital.Mr.Martin
never paid one hundred and fifty dollars ($150.00)a month on
maintenance charge.
However,Mr.Martin made a verbal agreement in 1954
to contribute forty cIollars ($40.00)per month toward cost of
JIl!d.ntenance and later increased this amount to eighty five ($85.00)
mcmt..bly lthen Social Security benefits were pqable.
You are correct concerning the Social Secur:l.ty payment
be1111 sent to the Dixmont State Hospital for Mrs.Martin's main-

is the widow of Arthur D.lVlartin?
Yes.I am.
And you were appointed her guardian by the Court of Common Pie s
of this ,county.

How long ago were you appointed guardian?
In June of 1952.
And at that time Mrs.lVlartin was adjudicated a weak-minded pen on
by the Court.

And you have acted as guardian of your sister since your appointrr ent.

Dixmont Institution.
How long has she been there?
Approximately 38 years.She was home a short year or so in bet",een

A No.The boy doesn't,He lives in Fort Lauderdale"Florida.

A Yes.
Q I ask you to tell the Court the situation of Elizabeth Gray,the
daughter.
A The oldest daughter is a widow with no living children.And she
is practically blind with cataracts and glaucoma.And she lived
with her father before he died.He furnished a home and kept her
And right now her income is a very small amount of Social Securi y,
something around $70.00 is all the income she has.
Q How old is Elizabeth?
A She will be 49.
Q Is she employable?

A No.She is not able to work at all.

A Yes.
Q And are their husbands of the girls employed?
A Well,the one isn't right now.He's had his hand hurt.He's been o"f
three months,Mr.Lerby,that's Elma's husband.

A 74.
Q Do you know how the cos t of her maintenance at Dixmont is being
defrayed?,
A Well,to my last knowledge,what Mr.martin had told me was
approximately $5.00 a ~ay.And her Social Security went in and h
sent so much in then when he died.The Social Security they told
me would lIre $133.00,which goes direct to Dixmont.And the res L,
as far as I know,is standing.
Q Mrs.'lV1cGuier,from the assets of Anna Martin that are in your
hands,doyou feel that you have enough funds in your hands to

A·Well,I would figure at her age it should.
Q What is her physical condition,do you know?
A Well,as far as I know her physical condition is fairly good.
She had that one cataract operation since her husband died.
But other than that,as far as I know it's good.
Q fOU feel that with her Social Security and with the ass ets that you

have in your hands and if the Court would permit her to elect
against the Will,the share that would come to her out of her hus
band's estate would be sufficient for her maintenance?
A I feel it should.
Q Do you think it would be in the best interes ts of Mrs.martin as w ~ll
as for the rest of the family that the Court permit you to elect to
take against the Will?
A I feel it should.

May I first make a statement so that you und r-
Very well.
lVlr.Ott is the local Trust Officer here of
lVlellon Bank,as is well known.He has contacted Pittsburgh and
gotten their view on this.I have been asked to briefly state it.
We do not object to the prayer of the Petition!i:;!~'We can't honestly
say that we dgree that it is correct,for the reason that the Will
gives the trustee power to consume all the assets in this estate if
necessary,both principal and income for the support of this wido Iv.
On the other hand,we do appreciate the position of some of the
remaindermen as to their need for money and 11:0 accelerate the
closing of this estate.I feel that the banik's work is made easier f
the prayer of the petition is granted,because then the es tate will
be closed,as they will have less work to do in a small estate.
That,briefly,is our position and Mr.Ott is>here to give you---y)U
will want information as to ass ets in the estate and income and
that kind of thing,which he is in a position to give you.No Invent ry
has been filed,for the reason that we did not have an election yet
by the widow.We didn't know which way to go.No real estate has
been sold and we didn't want to file an Inventory until after we
sold the real estate if we.could avoid it because of Inheritance Ta
No Inheritance Tax has as yet been paid.We estimate that it will be

around $1,000.Of course,·the discount period has long since
passed and weare now into a penalty situation after September of
1971.

A Arlie Ott.
Q You are the Trus t Officer for Mellon National Bank?
A That's correct.
Q In this city?
A Yes.

Q lVl.r.Ott,your bank was appointed Executor under the Will of Artl:ur
D.Martin.
A Yes.
Q And Letters Testamentary were granted to the bank?
A That is correct.
Q Under the terms of the Will,Mr.Ott,which is filed,is it correc
tha t the decedent left the entire estate in trust with the bank with
authority to use the income as well as the principal tbat may be
necessary to maintain and take care of the widow?
A Yes •.
Q And I believe it's stat ed that when the estate is reduced to suffici nt
to pay counse 1 fees and $1200.00 then the,trust is to be term ina te
and the $1200.00,as I understand,was to be a burial benefit for
the widow.
A Yes.The ~inal $1200.00 is to be reserved explicitly as stated for
her funeral needs.
Q If the widow died before the trust was terminated,then the Will
provides that the balance in the estate be divided equally among
the five children who have been named here.
A That's correct.
Q Mr.Ott,I understand you have not filed an Inventory for the
reasons stated by counsel.
A Right.
Q Could you tell the Court approximately the values of the ass ets of
t he estate and what the estate consists of?
A Yes.The initial assets of the estate consisted of cash or equivale t
items.Specifically,a checking account,a cou ple small Christma
Club accounts,an uncashed pension check.All these aggregate
eight hundred odd dollars.Market securities,being 50 shares of
City Service,valued slightly under $2300.00.A life insurance
policy payable to the estate for $1,000.And three houses situate en
one plot,which fronts on Church Street of Washington,Pa.,and
at the rear,fronts on West Walnut Street.These three properties
are designated as individual addresses as 133 Church Street,133
Wes t Walnut Street and 135 West Walnut Street.We have had thos 8
appraisep.But they have not been offered on the sale market.
The one property at 133 Church Street continues pres ently to be
occupied by Mrs.Gray who had lived with her father for some tin e.
And the two pro ~rties to the rear which front on West Walnut
Street are rented at the amount of $70.00 and $60.00 monthly.
There were only minor bills outstanding such as the real estate
taxes at the time of death and a very small amount was due on
the funeral bill because he had coming some 'small lodge benefits
that were paid it§!.l.Vll'J.t'••Barnhill and applied directly to that bill.
As mentioned by couns el,we have not made any payment on 1liJ.-
heritan~e Tax.But since the rental property was producing taxa le
income to the estate,we had made a partial payment on account
of fees in order to make those income tax deductions available

and eliminate the need for income tax payment last year.The thr ee
properties are jointly appraise.d at the value of $13.000,roughly
$14,000,which breaks down at the property of 133 Church Street
at $6500.00;the one known as 133 West Walnut Street at $3900.OO~;
and the one at 135 Wes t Walnut at $3500.00.These,for tax
purpos es.I be lieve,are all being combined in one bill or perhaps
two billings.They are part of an earlier acquisition which was
larger and they have been separated.

THE COURT:Are the houses on separate lots,Mr.Ott?
A No.Your Honor.The re is one plot of ground.At one time there tad
been a double lot as I understand it,which perhaps fronted on
Church Street and ran of even width to the rear to Walnut Street.
And it is my understanding that by reason of i.nmeritance to a Tela ive
of Mr.lVlartin of the property nextdoor on Church Street,that
.parcel was carved out,which now leaves an "L"shape.one plot
of ground.
Q lVlr.Ott,do you know how much Social Security is being receive
by.the widow?
A I have no concrete knowledge of this,but I understand the benefit
is roughly $133.00.
Q Itls being paid directly to the State Hospital where she is confine
A Presumably.I have never verified this.I have never had odcasi

A I have no knowledge as to this instant case.In similar situations
where we act as fiduciary for others who are confined at this
hospit,al,I just verified a recent billing for the month of October,
and the per diem charges on that billing was stated at $21.87 per

No,we have never received any correspondence either addressed
to us as Executor or to the deceased.And we could not establish
from the checkbook records any regularity of payments immediatl ly
preceding his death,if he was contributing.
I believe John Davidson of this Bar was\counsel for Mr.lVlartin ar d
had drawn lVl.r.lYlartin'sWill.
He had been the scrivener on the Will.I'm not certain iliFe was co nsel
at the time of death.
Did you or did you .hear either from Mr.lVlartin or lYl.r.Davidson
as to what the arrangements were for financial arrangements for
keeping Mrs.lYlartin in the State Hospital ?
No,I could not say.
c;Do you have any information as to what the arrangements were w'\,h
reference to the cost of maintaining her at the hospital?
A I have always understood largely through information furnished IT e
by some of the family members,apparently there was an agreemE nt

permitting an election by a guardian of an incompetent is strictly
a matter for the discretion of the Court.But among the guideline~
which are pointed out the text seems to indicate tha t the considellation

of the spousers welfare,of cours e,is a primary consideration,b ~t
that the Court should also consider the intention of the testator
with respect to the pers ons who should inherit from.him.And in
this case,if the Court should permit an election the decedent's
intentions would not be diverted becaus e this would accelerate the
life-interest and the estate would'pass to the five children whom h~
has de5'dgnated as remaindermen in the Will.

MR.SIEGEL:If the Court please,may I offer in evidence fbr
the record the Joinder signed by the five children where they havE

for this individual.She's been in there 30 some years and Lord
knows what their a ttitude is going to be.They might have enough bf
a claim there to eat up the whole estate.

leave this to the Court's judgment.But there is one thing that
hasn't been mentioned here that might have a small bearing on
this,and that is that there's been no Petition for family allowancE.
I think there might be some little problem there about who is
entitled to it,the daughter wh 0 lived with him at home,being
practically bli nd,or Jthe widow,who has a separate property
and is apparently pretty well taken care of under the WilL I
thought the Court,intrying to be fair to everybody concerned,might
feel that the daughter who lived in the house with the deceased at
home might be entitled to a family allowance which might relieve
her somewhat if the Court felt he had to follow the WilL
