PETITION FOR GUARDIAN OF MINOR'S ESTATE
The Petition of AGATHA JOANNE DIAZ,a minor under the age
of 14,by ALBERT S.DIAZ AND MILTON P.DIAZ,her next friend,who
are her uncle and brother respectively respectfully represents:
1.That Agatha Joanne Diaz was born on February 6,1959,
presently 11 years of age,and resides at 7 Sunset Drive,Rabe
Manor,Donora,Washington County,Pennsylvania.
2.That the parents of said minor are both deceased;her
~ather,Milton C.Diaz,died March 19,1970,and her mother,Anna
biaz,died May 20,1970.
3.That Albert S.Diaz is the uncle of the Petitioner
~nd resides at Mar-Rick Manor,R.D.#1,Monongahela,Washington
bounty,Pennsylvania,and Milton P.Diaz is the oldest brother of
~he minor and resides at 7 Sunset Drive,Rabe Manor,Donora,Wash-
'ngton County,Pennsylvania.
4.That a guardian of her estate is necessary because the
ninor has become entitled to receive certain assets which cannot
De paid directly to her but to a guardian appointed by the Court.
5.That the nature of the assets which the minor is entitlec
o receive is Social Security Monthly Benefits of One Hundred Forty
two and 40/100 ($142.40)Dollars during her minority and the sum
of One Hundred Fifty ($150.00)Dollars a month payable by the
Transition Survivor Income Insurance and Benefit of the Fisher
.-
Body Division,General Motors Corporation Benefit Plan for a
period of twenty-two (22)months.
6.One of the proposed guardians,Milton P.Diaz,is
twenty-nine (29)years of age and resides at 7 Sunset Drive,Rabe
Manor,Monongahela,Pennsylvania,and is the oldest brother of
ihe minor.The other proposed guardian is Albert S.Diaz,resid-
ing at Mar-Rick Manor,R.D.#1,Monongahela,Pennsylvania,and
is the uncle of the minor.Attached hereto as Exhibit Nos.1 and
2 are.their acceptance to act as said guardian of the minor.
7.The proposed guardian,Milton P.Diaz,has no interest
adverse to the minor and is not the fiduciary or an officer
or employee of any corporate surety of an estate in Which
the minor has an i~terest,nor the surety nor an officer or em-
ployee of a corporate surety of such a fiduciary.
8.That the proposed guardian,Albert S.Diaz,is presently
Executor and Attorney of the Estate of the late Anna Diaz,the
mother of the minor,and has no interest adverse t6 the minor.
9.That notice has been given to the United States Veterans
Administration,since the minor is the child of a veteran and
the minor may be entitled to a monthly benefit from the United
States Veterans Administration,or its successors.Said.notice
was given by registered mail,Certificate No.II I>S ,which
is attached hereto as Exhibit No.3.
10.That the minor has been residing with Milton P.Diaz,
one of the Petitioners herein,and.shall continue to reside with
the said Milton P.Diaz until her majority.
11.That the immediate family of the minor consists of
two brothers,one of whom is Milton P.Diaz,one of the Petition-
ers herein,and the other is Dale W.Diaz,age twenty-eight (28),
who resides at 102 Alexander Avenue,Fisher Heights,Monongahela,
Washington County,Pennsylvania.
12.That the said Dale W.Diaz joins in the Petition and
consents to the appointment of Albert S.Diaz and Milton P.
Diaz as guardians of the estate of his younger sister,Agatha
Joanne Diaz,the minor.

WHEREFORE,the minor under the age of 14,by ALBERT S.DIAZ
and MILTON P.DIAZ,her next friend,prays the Court to appoint
the said Albert S.Diaz and Milton P.Diaz as guardians of her
estate.

The Petition of Albert S.Diaz and Milton P.Diaz respect-
fully represents:
1.That they are the guardians of the Estate of Agatha
Joanne Diaz by Decree of this Honorable Court,dated the 8 /~

2.That Albert S.Diaz resides at R.D.#1,Monongahela
(Mar-Rick Manor),Washington County,Pennsylvania,and the other
Petitioner,Milton P.Diaz,resides at 7 Sunset Drive,Rabe

3.That the said minor is eleven (11)years of age and
resides with her brother,Milton P.Diaz,at 7 Sunset Drive,Rabe
Manor,Donora,Washington County,Pennsylvania.
4.That the parents of said minor are deceased.
5.That the assets of the minor's estate consists of
monthly benefits to be received from the Social Security
Administration in the amount of One Hundred Forty-two and.40/100
($142.40)Dollars per month until the minor attains her majority;
and.the sum of One Hundred Fifty ($150.00)Dollars per month

payable by the Transition Survivor Income Insurance and Benefit
of the Fisher Bod.y Division,General Motors Corporation Benefit
Plan for a period of twenty-two (22)months.
6.That there is no other provision for the support and
maintenance of the minor,and it is necessary that a suitable
periodical allowance be made for that purpose.
WHEREFORE,the Petitioners pray your Honorable Court to
direct an allowance of One Hundred Fifty ($150.00)Dollars
per month out of the minor's estate for her supPort and
maintenance.

TO THE HONORABLE JUDGE OF SAID COURT:
The Petition of Albert S.Diaz and Milton P.Diaz respect-
fUlly presents:~

1.That they are the guardians of the Estate of Agatha
Joanne Dlaz,by Decree of this Honorable Court,dated the
31st day of August,1970.
2.That Albert S.Dlaz resides at R.D.#1,Monongahela,
{Mar-RiCk Manor}Washington County,Pennsylvania,and that
Milton P.Diaz resides at R.D.,Hickory,Washington County,
Pennsylvania.
3.That the said minor is 14 years of age and resides
with her brother,one of the petitioners,Milton P.Diaz,at
R.D.,Hickory,Washington County,Pennsylvania.
4.That the parents of said minor are deceased.
5.That the fixed assets of the minorTS estate consists
of $2464.47 on deposit at Pittsburgh National Bank {Charleroi
Office},and an undivided 1/3 interest in the estate of her
late mother,Anna Diaz.
6.The current assets of the minor consists of a monthly
a~iotment,received from Social Security Administration in the
amount of $188.00 per month,payable to Milton P.Diaz,one of
the guardians of the estate of the minor.
7.That on August 31,1970,your Honorable Court was
presented with a Petition for the Appointment of a Guardian,r
wherein the Social Security benefits to the minor were
$142.40.On the same date,your Honorable Court issued an
Order paying to Milton P.Diaz,the sum of $150.00 per month
for the support and maintenance of said minor.
8.SUbsequent to the issuanc~.of said Court Order,
Social Security benefits to said minor were increased from
$142.40 to $156.60,on January 1,1971,and continued at that
rate until September,1972,when it was further increased to
$188.00 per month,which is now the present rate of monthly
allotment to the minor.
9.Attached hereto and made a part hereof,1s an
accounting of all funds received by the CO~Guardiail,(Milton
P.Diaz,since August 31,1970,including all Social Security,
Metropolitan Life Insurance Company benefits and survivor
benefits received from the U.S.veterans Administration.
10.Due to the additional needs,and maintenance and
support required by the minor,it was necessary that her brother,
Milton P.Diaz,her co-guardian,be given the full amount of
the Social Security checks from the time of their increase in Ja
uary,1971,to date.
11.That the recent change in Social Security legislation
with proposed changes in said regulations,indicates that there 11
be a fluctuation in the monthly payments to the minor and would
cause constant petitioning of the Court to set a fixed dollar
amount.
WHEREFORE,the petitioner prays your Honorable Court
to direct a monthly allowance to'the CO-Guardian,Milton P..'
Diaz,in the same amount to the Social Security benefits

payable for the support and maintenance of the minor,and
further,that the Court nU~pro tunc,approve the additional
payments received by the Co-guardian,which were merely the
monthly Social Security increased benefits received by the
minor since the date of the prior Court Order.

Diaz nor myself has charged any fees for acting
as Guardian and I have not charged any fees as
attorney in handling the guardianship.Further,
there is no intention on my part and on the part
of my nephew to charge any fees regarding this

Court,after consideration of the
hereto,ORDERS that Milton P.Diaz,CO-Guardian of Agatha Joanne
Diaz,receive as monthly support for the said ward.,a sum equal
to the amount payable each month by the Social Security Division
of the Department of Health,Education &Welfare;and further,
that the Court approves the additional payment of $790.00
to Milton P.Diaz for the proper maintenance and support of
the ward,said sum being the difference between the Court Order
of August 31,1970,granted said Co-Guardian,in the sum of
$150.00 per month,as compared to the increase above that amount
paid to him by the Social Security Administration for the
maintenance and support of said ward.
