To the Honorable Judge,P.V.Marino,President Judge of said
court:
The petition of Harry Sohyda respectfully represents:
1.That Annie Sachayda a/k/a Annie Sohyda,late of
Cecil Township,Washington County,Pennsylvania,died intestate
on November 29,1969.
2.That said decedent died seised of no personal pro-
perty and of Real Estate situate in Cecil Township,Washington
County,Pennsylvania being more particularly bounded and de-
scribed in Exhibit "A"attached hereto and made part hereof.
3.That the names and addresses of the decedent's
surviving children and issue of one deceased child (all of whom
are adults),being her sole heirs at law,are as follows:

That attached hereto is a Joinder as Exhibit liB"of all
the Heirs except Betty Jane Rosmus of Canonsburg,Pennsylvania.
4.That your Petitioner is desirous ·of purchasing the
aforesaid real estate and of paying therefor the sum of $4,500.0
with credit for the shares of those heirs who have renounced the r
shares.That attached hereto is Appraisal of Anthony L.Colaizz(
Realtor as Exhibit "C".
5.That all creditors of the Estate have been paid in
full.
6.That your Petitioner has filed with the Register of
Wills his Surety Bond in the sum of $1,000.00.
7.That pursuant to Section 541 of the Fiduciary Act of
1949,your petitioner may not accept any por tion of the purchase
price until this Court has made an order either excusing him
from entering additional security or requiring additional security.
8.That pursuant to section 546 of the Fiduciary Act of
1949,your petitioner may purchase Real Estate belonging to the
Estate subject to the approval of the Court;and the Court may
make an Order directing its Clerk to execute the Deed to your
petitioner.
9.vfuerefore,your Petitioner respectfully requests that
an appropriate Order be made directing a Rule to issue upon Betty
Jane Rosmus to show cause why the Sale to the Administrator,
Harry Sohyda,may not be consumated upon and under such condition3
as the Court may impose.

ALL that certain lot of ground situate in Cecil Town-
ship,Washington County,Pennsylvania,known as Lot No.9-A in
a plan of Lots laid out by James M.Colaizzo,et ale c~lled
the Muse Plan,recorded in the Recorder's Office of Washington
County,Pennsylvania,in Plan Book Vol.7,page 188,and more
particularly bounded aho-described as follows:
BEGINNING at a point on the westerly side of Hickory Al ey,
said point marking a corner common to Lots 8-A and 9-A;thence
along Hickory Alley by the westerly side thereof,N.09°06 'W.,
a distance of 40 feet to a point at the corner of Lots No.9-A
and 10-A;thence by the line dividing said lots,S.80°54'W.,
a distance of 134 feet to a point on the easterly side of Main
street;thence along Main street by the easterly side thereof,
S.05°04 1 E.,a distance of 29 feet to a point at the corner of
Lots 8-A and 9-A;thence by the line dividing said lots,N.85°
08'E.,a distance of 136.30 feet to the place of beginning.
BEING the same property conveyed to Nick sachayda and
Annie Sachayda,his wife,by J.M.Colaizzo et ux.et ale by
deed dated July 26,1948,of record in Deed Book Vol.748,page
522,Washington County Records;and being subject to the excep-
tions,reservations,conditions and other provisions set forth
therein and in prior conveyances.
The said Nick Sachayda died on November 14,1948,where
by the entire Estate vested in fee simple in Annie Sachayda as
the surviving tenant by the entirety.
The said Annie Sachayda a/k/a Annie sohyda died intesta e
on December 18,1969,seised of th~above described property.0
August 28,1970,Harry Sohyda,Il$':'h$;l he •a -.\fim was appointed
Administrator of her Estate.

Harry Sohyda located at 9 Locust Street,Muse,Cecil Twp.Washington
County,Pennsylvania for the purpose of estimating the fair market
value,and it is my opinion that the value of the said property,as
of the 19th day of September,1970 is as follows:
Four Thousand Five Hundred Dollars ($4,500.00)
I further certify that I have no present or contemplated future
interest in the property appraised or the result of this appraisal.
The opinion of value expressed above is the result of the inspection
of the said property.
No responsibility is assumed for matters of a legal nature concerning
the appraised property,nor of questions of survey.
Neither all nor any part of the contents of this report shall be

the averments of the Petition filed at the above number and it
appearing that Betty Jane Rosmus,the heir,who did not assign
her interest and share to Harry Sohyda,did corne for the hearing
scheduled for May 31,1972,at 1:30 p.m.and expressed her ap-
proval of the Sale of Real Estate to the Administrator,Harry
Sohyda,additional bond being suggested as $1,000.00,upon
motion of George J.Modrak,Esquire,the Administrator,Harry
Sohyda,is directed to file an additional bond as such Adminis-
trator with corporate surety in the penal sum of $1,000.00,be-
