And the said Derpartment of Health,Education and Welfare;Social Security l/ Administration,is authorized and directed to effect the distribution of said sum of One hundred thirty-three and 50 !lOOths ($133.50)Dollars as set forth hereinabove;said distribution to be made without the grant of any letters in the Estate of William Duke, Deceased,or further notice,and that this Decree shall be sufficient warrant for so doing, ~ and that,upon making such payments in distribution,the Department of Health,Education and Welfare,Social Security Administration shall be released and discharged of and from any further liability and accounting to anyone,for or on account of the same. PETITION FOR SETTLEMENT OF SMALL ESTATE TO:THE HONORABLE,THE JUDGES OF SAID COURT: The petition of Charles Duke respectfully represents: 1.That your petitioner is the son of William Duke,Decedent,and resides in Sob.,thview,Washington County,Pennsylv3.nia. 2.That decedent,William Duk:=,died intestate and unmarried,on April 20,1970,a res,ident of Washington,VTashington County,Pennsylvania,being eighty-five years of age. 3.That decedent:s entire estate at the time of his death consisted of the following assests: .P,ERSONALTY: a.Benefit payments under :he Federal Coal Mine Health and Safety Act of 1969 in the total Eum of One hundred thirty-three and 50/100ths ($133.50)Dollars, REALTY: NONE 4.That the said William Duke,Deceased,was survived by the petitioner Charles Duke as his only heir-at-1aw. 5.All of the creditors of decedent have been paid in full. 6.That petitioner paid funeral expenses for burial of decedent to Robert Wylie,Funeral Director,Houston,Pennsylvania the sum of Four hundred seven and 60/l00ths ($407.60)Dollars in payment of the balance of the funeral bill which totaled Six hundred fifty ($650.00)Dol:.l1rs. ·,.- 7.Petitioner claims of the Estate of the decedent the sum of One hundred thirty-three and 50l100ths ($133.50)Dollars as partial reimbursement for funeral expenses paid. 8.That this petition for settlement is made pursuant to the provisions of Section 202 of the Fiduciaries Act of April 18,1949,P.L.512,as amended. WHEREFORE,petitioner prays that the Court direct the Department of Health,Education and Welfare,Social Sel~urity Administration to pay to petitioner the sum of One hundred thirty-three and 50/100ths ($133.50)Dollars due decedent as benefit payment under the Federal Coal Min=Health and Safety Act of 1969.
