L The petition=r,BOBBETTE S.HARBAUGH.is an
individual who resides at Box 368,Vestaburg,Centerville Borough,
Washington County,Pennsylvania.The petitioner has also been known
by the name of BOBBETTE S.MAYERS.
2.The Certificate of Birth of the petitioner's natural
son,Robert J.Harbaugh,issuzd by the Department of Health,Bureau of
Vital Statistics,is attached hereto,made a part hereof and marked
Exhibit "A".The Certificatei:"lcorrectly lists the name of the petitioner's
son as Robert J.Harbaugh and incorrectly lists the name of the father
as Marshall Lester Harbaugh.
3.The correct name of the petitioner's son,the name by
which he has been known since his birth and which is his correct name,
is ROBERT J.MAYERS,and the name of his natural father was Robert
Roy Mayers.
4.The petitioner's son is a male child and he is the
natural son of Bobbette S.Harbc..ugh,a/k/a Bobbette S.Mayers,and
Robert Roy Mayersl father.The petitioner and her former husband"
Robert Roy Mayersl now deceasedl lived together as husband and wife
in a common law marriage since 1961.
5.The name ::>f the natural father of the petitioner's son
is Robert Roy Mayers who W2S born on AprH 111 1931 at Pittsburghl
Pennsylvanial and he died on April 24"1970.
6.The natural father"Robert Roy Mayersl supported
the child who is the subject of this proceeding since the child's birth"
and continued to do so until the father's death on April 24"1970.No
other person ever supported this child.
7.The child and all persons involved in this proceeding
belong to the white race.
8.The occupation of the natural father"Robert Roy
Mayersl during his lifetime was the conduct and operation of an automobil
mechanic business at Rockvill~1 Maryland.
9.The natural mother is the petitionerl Bobbette S.,
Harbaughl a/k/a Bobbette S.TJIayers~who was born on May 16"1937 in
Vestaburg"Washington County,Pennsylvania.Sin!ce the death of the
natural fatherl she has suppor:ed the child who is the subject of this
petition and two other children of Robert Roy Mayers"namely Diane
Armeda Mayers and Bobbette Mayers.
10.The child"~obert J.Harbaughl was born in
Brownsville General Hospital,Fayette CountYI Pennsylvania"on
November 1"1962"and lived with his natural mother and natural father
until the death of his father"Robert Roy Mayersl on April 241 1970.
11.The Baptismal Record of this child states that he was
born on November 11 1962 at Brownsvillel Pennsylvanial under the name
of Robert J.Mayersl the son of Robert R.Mayers and Bobbette Mayers.
The Baptismal Record will be produced at hearing for inspection by the
Court.
12.The child who is the subject of this proceedingl Robert
J.Harbaughl has never heretofore been involved in or subject to any
proceeding for custody or adoption.Since the death of his natural
fathe rl this child has been in the sole and exclusive custody of his natural
motherl the petitioner herein.
13.From the time of his birthl through grade school
and to the present timel the child was always known as Robert J .Mayers

and has never been known by the name on the Certificate of Birthl
Robert J.Harbaugh.
WHEREFORE.the petitionerl BOBBETTE S.HARBAUGH,
a/k/a BOBBETTE S.MAYERS.respectfully :-equests your Honorable
Court to correct the Certificate of Birth No.3281 issued by the
Department of Healthl Bureau of Vital Statisticsl Commonwealth of
Pennsylvanial so that the correct name of the child shall be ROBERT J.
MAYERS and that the name of his natural father shall be ROBERT ROY
MAYERS.

.DECREE
AND NOW,OctobEr 1,1970,pursuant to a hearing duly held on
September 22,1970,after proper notice given,and at which all interested
parties were present and represented by counsel,this Court finds as follows:
1.That according to documentary and other substantial and
sufficient evidence presented to the Court,a male child known as Robert J.
Harbaugh,was born November 1,1962,in Brownsville,.Pennsylvania.
2.That the natura~mother of said child,then known as Bobbette.
S.Harbaugh,had been marriea to one Marshall Lester Harbaugh,but had beer
separated from her said husban.j for some time prior to the birth of said child
She had been liVing with the natura]father of the child,Robert Roy Mayers,
and had entered into a common '_aw marriage with said natural father.When
she went to the hospital for delivery of this child,her mother refused to
recognize her common law marriage to Robert Roy Mayers,and entered her
name at the hospital as Bobbette S.Harbaugh;consequently at the time of the
birth of the child,the mother's name was given as Bobbette S.Harbaugh and
the father's name was given.as Marshall Lester Harbaugh.However,these
were not the true facts and the natural mother and father of this child in
consequence of said common law marriage,were Bobbette S.Mayers and
Robert Roy Mayers.

3.The said natural mother of this child,Bobbette S.Mayers,
continued to live with the natural father of said child,Robert Roy Mayers,
by whom said child was supportej until the time of the father's death on .
April 24,1970.
4.That,after Bobbette S.Harbaugh had been living with her
husband,Robert Roy Mayers)th~said Bobbette S.Harbaugh instituted
divorce proceedings against Marshall Lester Harbaugh and a final decree in
divorce was entered by the courts of Washington County,Pennsylvania.
Bobbette S.Mayers continued to live with her common law husband,Robert
Roy Mayers,until the time of hiE death on April 24)1970.The said Robert
Roy Mayers was the natural fathEr of Robert J.Mayers as well as the father
of two other children,namely,D~ane Armeda Mayens and Bobbette Mayers)
all of which children he maintained and supported until the time of his death.
5.Although the mother of Bobbette S.Mayers refused to
recognize the common law marriage of her daughter to Robert Roy Mayers)
all o'ther persons who had contact with the family recognized the said marriag
and referred to this child as Robert J.Mayers.There are attached to this
decree photocopies showing the various instances,among others)where this

child has been recognized as Robert J.Mayers.We have the photocopy of thej
record of the pub lie schooIs of l\l[ontgomery County,Maryland for the year I
1969)showing the student's name in said schools to be Robert J.Mayers;we
have the c~rtificate of John B.I\ic..rtin,M.D.,Fredericktown,Pennsylvania,•lj..~I.-,r •.-
'dated August 10,1967,certifying that Robert J.Mayers was born in Brownsvi le,
P.en.nsylvania)on November 1,1g-32;we have the certificate of baptism for I.~.
this child shOWing the name to be 3..obert J.Mayers,a son of Robert Roy
Mayers ~and his wife,Bobbette Mayers,to be bO'~n on November 1,1962,at
Brownsville,Pennsylvania.The ·~ertificate shows that he was received in

That the Chief,Division of Vital Statistics and State Registrar of
the Department of Health of the Ccmmonwealth of Pennsylvania,shall correct
and amend the notification of birth registration No.328 of said Robert J.
Harbaugh so t hat the name of said child shall be changed to Robert J.Mayers;\
that the maiden name of the mothe::'of said child shall be listed as Bobbette
Summerson;that the name of the father of said child shall be changed from
Marshall Lester Harbaugh to Robe:ot Roy Mayers,and that the following shall
be added to the registration with respect to the father:Residence,FredericktJown,
Pennsylvania;Color,White;Tra(e,Auto Mechanic.
