The provisions of the Inheritance and Estcte Tax laws of the Commonwealth of Pennsylvania
have been violated and I recommend that the following legal action be taken to compel compliance:

A proper investigation has disclosed:This estate was su::>ject to enforcement under Dirv.5,and a
request for legal action RCC 48 was sent to Harri3burg on Dec.18,1975.Since the admin-
istretix Eva M Banks cannot be located and any fu~ther actions on the part of the local
Inheritance Tax would be costly.It is recommended that this case be marked closed.
The real property in this estate was sold for $2,000.00 per Orphan's Court proceedings
cited in O.C.Dkt.VoL 123 Page 571.Accordingly the funeral expenses,costs of admin...
istratix transfer taxes and attorney and administ~tors fees would render this estate
insolvent.Further attempts were made for the local attorne~9~to file on RCC 103,so
that the purchasers would have a better title,but again our attempts have been fruitless.

SECTION 541 OF THE FIDUCIARIES ACT OF 1949

The Petition of Eva M.Banks,Administratrix of the
Estate of Gladys Thomas,de~eesed,respectfully represents:
1.Gladys Thomes,late resident of North Strabane
Township,Washington County,CEennsylvania,died intestate on
July 14,1970.
2.Letters of Administration were awarded to your
petitioner by the Register of Wills of washington County,Pennsyl-
vania,on July 22,1970,at Nc.63-70-767.
3.The said decedent died seized of the following
described real estate which is the subject of this Petition:
ALL that certain tract of land situate in
North Strabane Township,Washington County,
Pennsylvania,bounded and described as follows:
BEGINNING at corner stake of land deeded to
Richard Lofton by B.R.Rush and Inez P.Rush,
his wife,and in line of land of former Ada B.
Reed,thence North 57°East a distance of 315
feet;thence South 33°East to a stake,a dis-
tance of 420 feet;thence South 57°West to a
point in line of lands of Richard Lofton,a dis-
tance of 315 feet;thence North 33°West,420
feet by land of Richard Lofton to the point of
begim1ing.
containing 3.03 acres according to survey
made by Herschel Day,October 1944.
Excepting and reserving the Pittsburgh or
River Vein of coal with mining rights as con-
veyed to James Lyle by deed dated July 6,1900
and recorded in the Washington County Recorder
of Deeds Office in Deed Book Vol.245,page 179.
EXCEPTING and RESERVING from the above
described property the following two conveyances:
1.Parcel conveyed by Gladys Thomas to
Hermon L.Pierce and Eleanor Dolores Pierce,
his wife,by deed dated February 15,19,68,
recorded February 19,1968 in the Washington
County Recorder of Deeds Office in Deed Book
Vol.1273,page 447.
2.Parcel conveyed by Gladys Thomas to
Charles Perry and Tillie Perry,his wife,by
deed dated January 27,1968,recorded January
30,1968,in the Washington County Recorder·of
Deeds Office inDeed Book 1272,page 535.
4.Decedent died seized of no other real estate or
personal property.
5.Attached hereto and made a part hereof,and
designated as Exhibit "A",are the affidavits of two (2)respon-
sible persons familiar with real estate values in said area,as
to the fair market value of said premises.
6.Attached hereto and made a part hereof,and
designated as Exhibit liB",is the assessment certificate of the
Board for the Assessment and Revision of Taxes for Washington
County,Pennsylvania,showing the present assessed value of said
premises.
7.The said real estate has beep valued for
Inventory purposes in'the estate at Four thousand and no/IOO
($4,000.00)Dollars,but due to depreciation and deterioration of
the property,the offered price of Two thousand and no/IOO
($2,000.00)Dollars,as set forth in the attached Agreement
between Eva M.Banks,Administratrix of the Estate of Gladys
Thomas and Samuel Richardson,Frank Richardson'and Caleb Richardso

dated July 28,1970,and here:.n designated as Exhibit "C",is a
fair and full price for the subject real estate and a better
price,in the opinion of your petitioner,than can be obtained at
public sale.
8.At the time your petitioner was awarded Letters
of Administration,she filed a Bond in the amount of One Thousand
and no/IOO ($1,000.00)Dollars with United States Fidelity
Guaranty Company.
WHEREFORE',your ?etitio~er prays,your Honorable
Court to fix such additional bond as it may require of your
petitioner as Administratrix,prior to completing such sale"in
accordance with the provisions of the Fiduciaries Act of 1949,

Township,Washington county,Pennsylvania,bounded and described as fol~

BEGINNING at corner stake of land deeded to Richard Lofton
by B.R.Rush and Inez P.Rush,his wife,and in line of land of former
Ada B.Reed,thence North 57 0 East a distance of 315 feet;thence South
33 0 East to a stake,a distance,:oI 420 feet;thence SO,uth 57 0 West to a
point in line of lands of Richard Lofton,a distance of 315 feet;thence
North 33 0 West 420 feet by land of Richard Lofton to the point of
beginning.

and Eleanor Dolores Pierce,h~s wife.by deed dated February 15,1968,

9.H Buyer defaults in payment or performancf;for 30 days,Seller may,at Seller's election,
.use one or more of the foilowing remedies in addition to or instead of any other remedies provided by law:

(a)rescind this agreement and retain all sums paid on account hereof as liquidated damages,in
which case Seller shall retain title to the real estate free and clear of any obligation or duty to Buyer and Buyer
shall surrender ~Agreement for cancellation;
(b).'eject Buyer from said real estate,.fir which purpose Buyer hereby authorizes any attorney
of any Court of Record to appear for Buyer and confess jUdgment against Buyer in an amicable action of ejectment,
with immediate writ for possession of the real estate and for damages,to include attorney's commission of 10 %
or $and costs,hereby waiving stay of execution,exemption and inquisition,with release of all errors;
.(c)affirm this agreement by delivery of'deed to Buyer,declare all sums due hereunder to be
forthwith due and payable,and cause judgment to be ertered therefor,for which purpose Buyer hereby authorizes
and empowers any attorney of any Court of Record to E.ppear for Buyer and confess judgment against Buyer for
the whole balance due,together with interest,attorney's commission of 10 %or $.,and costs,
and hereby agrees to immediate execution thereon,waiving stay of execution,exemption and inquisition,with re-
lease of all errors.
10.This Agreement shall extend to and benefit and bind the heirs,executors,administrators,successors and
assigns of the parties.Whenever used herein,the singu1!U'number shall include the plural,the plural the singular
and the use of any gender shall include all genders.
NOTICE -THIS DOCUMENT MAY NOT SELL,CONVEY,rRANSFER,INCLUDE OR INSURE THE TITLE TO THE COAL
AND RIGHT OF SUPPORT UNDERNEATH THE SURFACE LAND DESCRIBED OR REFERRED TO HEREIN,AND THE
OWNER OR OWNERS OF SUCH COAL MAY HAVE THE COMPLETE LEGAL RIGHT TO REMOVE ALL OF SUCH COAL
AND,IN THAT CONNECTION,DAMAGE MAY RESULT TO THE SURFACE OF THE LAND AND ANY HOUSE,BUILD-
