SPECIFICALLY DEVISED
TO THE HONORABLE,THE PRESIDENT JUDGE OF SAID COURT:
The Petition of Roy Fielder,Executor of the Estate of
Gertrude Fielder a/k/a Gertrude L.Fielder,deceased,respect-
fully represents:
1.That the said Gertrude Fielder a/k/a Gertrude L.
Fielder died testate on the 9th day of March,1970,at the
WaShington Hospital,Washington,Washington County,Pennsylvania.
2.That the Last Will and Testament of said decedent
was probated on the 7th day of August,1970,and Letters Testa-
mentary were issued to your Petitioner;
3.That the only asset of the Estate is Lot No.78
and part of Lot No.79 in the Scottdale Plan of Lots located in
Canton Township,Washington County,Pennsylvania,and upon which
is erected a one story frame house.
4.That the property herein described is in the estate
of said deceased but was specifically devised in Paragraph 3 of
her Last Will and Testament to her two sons,Roy Fielder and
Elmer Fielder.
5.That said property has been appraised at a value of
$3,000.00 by two competent Real Estate Brokers as appears
from the appraisements marked Exhibits "A"and "B"and attached
hereto and made a part hereof.

6.That said real estate is assessed for tax purposes
as follows:

7.That the property above described is presently
occupied and rented but is badly in need of repairs.
8.That your Petitioner has not offered to sell said
property to his brother Elmer Fielder for the reason that he is
incompetent and does not a sufficient estate to purchase said
property.
9.In order to get cash with which to settle the
Inheritance Tax and to pay funeral expenses and other debts and
other administration expenses said real estate must be sold.
10.That there are no other assets in the estate.
11.That your Petitioner is desirous of selling said
real estate at Public Sale for the best price or prices that may
be bid at said sale.
WHEREFORE,your Petitioner prays your Honorable Court
under the Provisions of the Wills Act of 1947,its supplements
and amendments,for leave and authority to sell the real estate
described herein at Public Sale and to apply the purchase money
to the payment of the debts and expenses,including Inheritance
Tax and administration costs of the estate,and to distribute
any balance remaining according to the Order of this Court.

having spent the last five years of her life in Washington
County Home for Aged Women,and had a small amount of Soci~l
Security,Which,of course,was required for her care down
there.And when she died she left only a six-room with bat~
house that is in extremely bad condition and needs repair,

and consisting of Lot Number 78 and part of Lot Number 79 jn
the Scottdale Plan of Lots in Canton Township,Washington
County.We have attached to our Petition the statements
from Ernest R.Weltner and Albert E.Dicks,both real
estate brokers and salesmen,in which they state that they
have checked over the property and ore of them app:raised ii at
$2950.00,that is Mr.Weltner;and Mr.Dicks appraised it
at $3,000.00.We have the funeral expenses and four bills
that have been sent into the Executor for bills that Mrs.
Fielder owed prior to the time that she went to the County
Home.But all within the six-year period.
And of course,there will be the Inheri-
tance Tax,the costs of the Court for this proceeding unde
the estate.And we are asking leave to sell the specifical y
devised real estate in order to take care of all these ex-
penses.
In t he Last Will and Te stament of GertruUe
Fielder in paragraph three,she says,ttl give,devise and
bequeath all of my real estate,household furniture and
furnishings to my two sons,Roy Fielder and Elmer Fielder,
share and share alike.tt Well,of course,at the time of her
death,the furniture which ·had been quite old had been dis~
posed of by giving away or throwing over into the junk heap
because it was not worth anything.
The notice of this petition to sell was
served upon Elmer Fielder at R.D.l,Marianna,Pa.,wherE
he is now on leave from Torrance Swte Hospital and is at

the home of Mrs.Frances Bercosky.We sent it to him by
certified mail and we have the return receipt signed by
Elmer Fielder,showing that he had received it.Mr.Fieldpr,

This is the property in the Estate of Gertrude Fielder at Number 760
of 1970.And we have here a Petition for Confirma tion of tqe sale:
And it is my recollection that this ,property was advertised for public
sale and that the attorney reported to the Court that there were no
bidders at the sale thus advertised.So that it was exposE1d then to,
private sale and that they now have a bidder who is 'willing to pay
$2500.00 for this property described in the Petit'ion.The ~nQp~'~~y.;y
.appears to be'that to be known as Lot Number 78 and part of Jlot Num;er
79 in the Plan of Lots laud out in connection with the Washington St el

and/Plate Mills Enterpris e,which plan of lots is known as Scottdale.
I think that will suffuciently identify the property.Although in the
advertisement that appeared in the newspa per and in the Legal JourraL
a full description was given.

this account until the middle,I believe,or shortly after the
death---the middle of 1970 or right after the death of Mrs.
Fielder.This claim is presented or is being presented by Mr.
Ecker.I aElvised him that we would not admit the claim and that
we would present the sar:qe .to the'Cou'rt for its'determinahon .
Now as I say,Elmer'Fielder has been in Torrance for several
years.

I don't know how long,possibly,.maybe a year,something like th t.
THE COURT:The claim seems to come up to July 22,1970.

So that is probably the date.
MR.BANE:That's the time that they probably put him out
in a foster home.But I couldn't quite understand and I thought tha
the law \o/as most unfair that the mother's estate could then,follo'ing
her death,be held accountable for all of this without having had
some prior arrangement with the state relative to taking acare of
this man.And as I understand it,there was never any agreerrie ~

or any signed papers of any kind or has never been a claim filed·
in the office of the Prothonotary.And I just---I felt it was a matte'"

Mr.Keller,who is a Deputy Attorney General in this case,And
essentially,the position of the Department of Revenue is that the

.estate of Mrs.Fielder is liable for the support and maintenance 0
her son,.Elmer Fiel<;ler,who evidently was a patient at Torrance
State Hospital.I don't know whether he was released.I assume hE
was released on the date Mr.Bane said,I think the law is very
clear-under both the Act of 1915 as amended,which would be 71
.Purd6hs,Section 1783,and also under the more recent enactment
t,!•
under-the 1966 Mental Health and Mental Retardation Act,50
Purdons,'Section 4G02:I think it is clear that the estate of a pare It

is liable,for the support of an incompetent who is maintained in a
state institution.
Now there is not a great amount of money here.
I think there is $316.19.',And the claim of the Commonwealth is
substantial~$11,717.70.Evidently,Mr.Bane believes that becat:s e
there was no prior agreement ,with either Of the parents that the
Commonwealth's claim should not be recognized.However,I
don't think that is the law and I think the cases state pretty clearl
that the Commonwealth~s clatm exists irrespective of any previous

agreement among the,parties.
