PETITION TO FIX ADDITIONAL SECURITY
To the Honorable,the Judges of the said Court,the petition
of Julia M.McChancy respectfully represents:
1.That Stephen Joseph Paytors,a/k/a Stephen J.Paytors,
residing at R.D.#4,Box 233,Burgettstown,Washington County,Penn-
sylvania died intestate on May 25,1970.
2.That letters of administration were granted to Y0ur
petitioner on July 31,1970,by the Register of Wills of Washington County.
3.That an inventory was filed on October 9,1970 showing
a total value of the decedent's estate as $8,975.00,the value of premises
being a lot of ground containing 0.30 of a acre,more or less,and having
erected thereon a mobile home,which property petitioner desires to sell,
being included in the amount of $7,000.00.
4.That security has been entered by your petitioner with
the Register of Wills in the amount of $4,000.00 with United States Fidelity
and Guaranty Insurance Company as surety on the bond.
5.That decedent died seized of one piece of real estate
being the aforesaid lot of ground having erected thereon a mobile home which
is currently assessed for taxes at $1~865.00 and which is described as
follows:
ALL that certain lot of ground situate in Hanover Township~
Washington County,Pennsylvania,bounded and described as follows:'
BEGINNING at the Northwestern corner of the herein
described lot,said point of beginning being set from a point on the West line
of land formerly of Mildred Crider and the West line of a 15 foot alley and
the extension of the center line of State Route No.346 (known as Devils Den
Road)and crossing said alley South 43.°19'40"East for a distance of 150.20
feet to a point at the place of beginning;thence from said place of beginning
by land now or formerly of Paul L.Grace,et ux.,North 46°52'22"East
a distance of 195 feet to a point on the South side of a 30 foot street (Main);
thence by said street,South 43°19'40"East a distance of 70.81 feet to a
point on the West line of property formerly of Virginia Lashhorn,known as
Lot No.4;thence by said Lashhorn property,South 47°44'52"West a
distance of 195.02 feet to a point in aforesaid State Route No.346;thence
in said State Route,North 43°19'40"West a distance of 67.60 feet to the
place of beginning.CONTAINING 0.30 of anAcre~more or less,and being
part of Lot No.5 in an unrecorded plan laid out for the late J.M.Arnold.
UNDER AND SUBJECT to reservations,exceptions,etc.as
contained in prior deeds in the chain of title.
6.That your petitioner has entered into an agreement of
sale of the aforesaid premises to Betty J.Paytors,179 Denese Drive,
Weirton,West Virginia for the sum of $7,000.00 free and clear of encum-
brances,of which sum $500.00 has been paid and the balance is to be paid
at settlement on or before February 1,1971,a copy of the agreement of
sale is attached hereto.
7.That Steubenville Building and Loan Association holds an
encumbrance on the title of said mobile home in the form of aGnate,the
balance due as of the date of decedent's death being $3,861.56.
8.That Frank Paytors,Sr.,Weston State Hospital,Weston,
West Virginia,decedent's father,is the sole heir and sole party in interest.
Said Frank Paytors,Sr.in incompetent,his guardian is Betty J.Paytors,
who has been given notice of the details of the sale and whose consent to
this petition is attached hereto.
9.That affidavits of two persons acquainted with real estate
values in the locality of said premises are attached hereto.
WHEREFORE,your petitioner prays your Honorable Court
under section 541 of the fiduciary act of 1949 for final decree requiring the
entering of security in such amount as the Court may determine,upon the
entry of which your petitioner to have authority to receive the proceeds of
sale of the premises afo'resaid and she will ever pray,etc.

WITNESSETH,that for the consideration hereinafter set forth and intending to be legally bound the Seller and
Buyer mutually agree as follows:
1.Seller agrees to sell and convey to buyer on or befor,e February I,1971
by special warranty deed in fee simple absolute,clear of all mortgages,judgment liens
and tax liens and other encumberances affecting its marketability (except as hereinafter set forth )all the real.property

2.Buyer agrees to'purchase said real property and to pay Seller therefor the sum of Seven thousand

dollars on delivery of deed as hereinafter provided.

This sale is subject to approval by th Orphans'Court of Washington County,
Pennsylvania and if subject approval is not obtained this agreement shall be null and
void.
4.At settlement Seller shall pay for or be charged with the cost of all federal documentary taxes and
state and local realty transfer taxes payable upon this transaction,but real estate taxes for the year of settlement,sewer
charges °and rents and royalties shall be prorated on a calendar year basis between Seller and Buyer as of date of
delivery of possession of the premises;except as hereinafter set forth:
5.From and after the date of this agreement,insurance shall be provided and paid for as follows:
Seller shall provide for and pay insurance until delivery of deed.
6.Time is of the essence of this Agreement.
7.The real property which is the subject of this Agreement is described as follows:
ALL that certain lot of ground situate in Hanover Township,Washington
County,Pennsylvania,bounded and described as follows:

8.If Buyer defaults in payment or performance for sixty days,Seller may,at Seller's election
use one or more of the following-remedies in addition to or instead of any other remedies provided by law:
(a)rescind this agreement and retain all sums paid on account hereof as liquidated damages,in
which case Seller shall retain title to the real estate free and clear of any obligation or duty to Buyer and Buyer
shall surrender this Agreement for cancellation;
(b)eject Buyer from said real estate,for which purpose Buyer hereby authorizes any attorney
of any Court of Record to appear for Buyer and confess judgment against Buyer in an amicable action of ejectment,
with immediate writ for possession of the real estate and for damages,to include attorney's commission of 10 %
or $and costs,hereby waiving stay of execution,exemption and inquisition,with release ,of all errors;
(c)affirm this agreement by delivery of deed to Buyer,declare all sums due hereunder to be
forthwith,due and payable,and cause judgment to be entered therefor,for which purpose Buyer hereby authorizes
and empowers any attorney of any court of Record to appear for Buyer and confess judgment against Buyer for
the whole balance due,together with interest,attorney's commission of 10 %or $,,and costs,
and hereby agrees to immediate execution thereon,waiving stay of execution,exemption and inquisition,with re-
lease of all errors.......
9.The Buyer agrees not to record this Ag~eeinent and recording by the Buyer shall constitute a breach
thereof.
