committing unto her the administration of all and singular the goods and

1.I direct my Executrix.hereinafter named.to pay all my just debts
and funeral expenses as soon after my derease as convenient.
2.I give,devise and bequeath to my wife.Laura E.Houston,my
automobile to be hers absolutely.
3.I give.devise and bequeath all the rest.residue and remainder of
my estate.real.personal and mixed.to my wife,Laura E.Houston during
her natural life with the right to consume any or all thereof.if necessary,
for her comfortable maintenance and support.Should she.in her discretim1on,
determine that it was necessary to sell any or all of my real estate for

her maintenance and support.then I do empower her to sell the same at
either public or private sale and to sign.acknowledge and deliver a deed
or deeds for said real estate with the same force and affect as though I
had delivered said deed or deeds in my lifetime.She.my wife,is not
required to give bond,at any time for the proper application of the purchase
money or any part of my estate.
4.At the death of my wife.I give.devise and bequeath to my step-
daughter.Helen Shea,the sum of one-hundred ($100.00)dollars.
5.At the death of my said wife allthat remains of my estate,real,
personal and mixed,I give.devise and bequeath to my daughter.Lucile
Wylie.and whereas Kenneth A.Houston.my son,has been serving 1nethe
Armed Forces of the U.S.A.and has been reported killed in action.Should
this report be unfounded and he be alive.then I give,devise and bequeath the
one half of the residue of my estate to the said Kenneth A.Houston.other-
wise the whole thereof shall be disposed of as above set forth.
I hereby nominate.constitute and appoint my-daughter,Lucile Wylie.

estate in EXHIBIT"A".Laura E.Houston,widow of William C.Houston,who,under the
terms of his Will was given a life estate in the residue of his estate,with power to consume,
died on October 30,1966,without having consumed any of his estate.She and her daughter,
Lucile Wylie,advanced monies for the payment of decedent's debts,funeral expenses,
expenses of administration,and inheritance tax,in order to preserve the real estate for
distribution in kind,as set forth and itemized at Page 1.of the Account heretofore filed.
'The said Lucile Wylie,AccouJiltant-Petitioner herein,and who is also the sole residuary
beneficiary of the unconsumed balance of her father's estate remaining at the death of her
mother,hereby elects to take,in kind,said residue,consisting solely of the real estate

in Buffalo Township,and a fifth contiguous parcel which the decedent
had a very mere interest.It was conveyed for school purposes,and
I understand the school has since abandoned it.Whether they have

decedent died in 19.50,and by his Will he devised all of the estate wl ich

Department,so that the full res idue of the estate under the terms
of the decedent's will does go to Lucile Wylie,the daughter.The
life tenant,mother life tenant,died in 1966,tE:rminating her life
estate,and without having consumed any of thE:estate.The m othe r
and daughter,after the death of the decedent,caused an Inventory .a~d
oj~Apprais'ement to b'e filed and Affidavit of Debts and Deductions to be
It:oII.~filed and at that"time around 1951,the Inheritance Tax on the whole

$3,026.00 and the Commonwealth raised it up to $4,000.

up for audit is to have the real estate awarded to the residuary bene
ficiary.the daughter.in kind in accordance w.ith a.-request she has n ade

The $100.00 bequest to the stepdaughter was paid
and there is a receipt filed of record evidencing the payment of that.
I refer to the place of record in the Audit Petition.The accountant
wants to be surcharged with money I had advanced for filing the acc(unt
and any costs or fees that would arise subsequent to the filing of
the account.It would be audit costs and the costs of recording the,
award of real estate.The only problem here.the life tenantr.and
her hus~and.I believe,visited Your Honor in chambers some time
ago,you probably don't reco;ule1ct.:t all that happened.Seemingly,

since the decedent died.the school district has abandoned this schoel
tract which evidently consists <:>f three tracts.two of which they
acquired by deed and the third which is a part of this estate by a
conveyance for and during the time to be used for school purposes.
After abandonment,I understand the school district conveyed
these two tracts that they acquired by deed to a certain party and in
accordance.evidently with t1:le survey that was made and which survey
apparently overlapsed according to the Wylie's.overlapsed the
property to be awarded"here.I have contended that that is a matter
for them to take up and have properly disposed of by judicial pro-

ceedings to be instituted following the ,award of real estate here by
Your Honor:They seem to think that you had told them this could be
taken care of either at the audit or after the C'audit.I really don't kn )wat
what you said',I indicated in my convlersation with you yesterday

to see just what your idea of the thing was.And for that reason it
