Petition Asking That The Personal Representative Be
Excused From Filing Additional Security Before Receiving
Proceeds From The Sale Of Real Estate
To the Honorable,P.Vincent Marino,Judge:
Your petition~r respectfully represents:
1.That your petitioner,Mary Elizabeth Winters Klatman,
is a citizen of the State of Ohio,residing at 396 Perkinswood
Blvd ..I\f.E.,ltlarren,Ohio,and she is the daughter of Charles E.
tifinters and Executor of his Last Will and 'restament.
2.That the said Charles E.Winters,a resident of
Washington,Washington County,Pennsylvania,died,testate,at
Warren,Ohio,on the 29th day of June,1970,aged eighty-seven.
3·That Letters Testamentary upon his estate were
granted to your petitioner on July 16,1970,by Russell Marino,
Register of Wills for Washington County,Pennsylvania;that at
that time your petitioner gave security in the amount of $5,000.00
with United States Fidelity and Guaranty Company as surety;that
a copy of decedent's Will is attached to this Petition.
4·That no Inventory and Appraisement has as yet been
filed in this estate;that decedent's personal estate will amount

to approximately $30,000.00;that his interest in real estate
will amount to $6,500.09.
5.That decedent died seized of an undivided one-half
interest in the following real estate,situate in the Eighth
Ward of the City of Washington,Washington County,Pennsylvania,
which real estate is more fully described as follows:
Lots Nos.1 and 2 -Block A of the \'Jest End Land Company
Plan of Lots,which plan is of record in the Recorder's Office
of Washington County,Pennsylvania,in Plan Book No.2,at Pages
12 and 13 (also Plan Book No.2 at Pages 26 and 27).Said lots
front 30 feet each on the Northern side of West Chestnut Street
and extend back therefrom of an even width a distance of 150 feet
to Basset Alley.Upon which lots are erected one frame building
containing three separate apartments fronting on McCarrell Avenue
and one frame building fronting on West Chestnut Street,Wash-
ington,Pennsylvania.
6.The owner of the other undivided one-half interest
in the aforesaid real estate is Edward H.l'linters,a brother
of the decedent;the only other real estate in which the decedent
had an interest at the time of his death was a lot of ground on
South College Street in the name of the decedent and his wife as
tenants by the entireties.
7.That your petitioner,with Edward R.Winters joining,
has entered into an agreement to sell the above described real
estate to Donald F.West and Helen R.West,his wife,for the
sum of $13,000.00 and a down paYment of $1,000.00 has been paid
to the Benne~Real Estate Agency to be held by them in escrow
until the deal has been consummated.One of the two original
Agreements is attached hereto and made a part hereof.

8.That the only party in interest is decedent's wife,
Mary W.Winters,and by paper filed herewith she consents to
this sale.
9.There is attached the affidavits of two real estate
experts as to the fair market value of the real estate proposed
to be sold•.
10.That your petitioner has already paid decedent's
funeral and medical bills and the sum of $1,L~25.00 on account
of the Direct Inheritance Tax upon his estate;other than her
accountant's commission,attorney's fee and grave monument the
outstanding bills of the estate are not large.
11.Your petitioner,therefore,.requests the Court to
waive the filing of additional security before she may receive
the proceeds from the sale of the real estate herein described.

of any sum of principal or interest,taxes herein agreed to be paid or premiums on insurance here-

and deductions claimed for and on behalf of this decedent's estate,including funeral expenses paid;
family exemption,where applicable;costs of administration of this estate;counsel fees and fudiciary's
commissions paid or to be paid;cost expended for burial trusts,tombstones or gravemarkers,and reli-
gious services,in consequence of the death of.the decedent;debts and claims owing and Impaid at time of
