by Evelyn R.Rabe or her attorney,to conv~y the real estate

presently owned by the parties hereto into the names of David
Leroy Rabe and Evelyn R.Rabe,as joint tenants with the right
of survivorship and not as tenants in common;
5.It is agreed that Evelyn R.
Rabe shall continue to live in.the jointly owned real estate for
her lifetime if she so desires and that neither of the parties
shall sever any joint tenancy nor bring any partition proceeding
during t~erespectivelifetimesof the parties.It is agreed
that Evelyn R.Rabe shall pay the taxes,insurance and other
expenses relative to said real estate and shall have theexclusiv.e
right to live therein;
6.In the event that Evelyn R.
Rabe in her lifetime desires to sell the said real estate,.
David Leroy Rabe shall join in the Deed so long as fair market
value is obtained for said real estate.;.
7.In the event that :the said
jointly owned property is sold in accordance with the provisions
set forth in Paragraph 6 above,theliens of the Commonwealth of
'Pennsylvania for the Department of Public Assistance and thecla'm
of Torrence State Hospital for the treatment of David Leroy Rabe
shall be paid out of said sale pricefirst,so ,that each of the
parties shall pay one half of the same.Any excess over and
above these said claims and the,necessary expenses of sale shall
be divided equally between the parties;
8.It is agreed that each of
the parties will sign any necessary legal documents.to implement
this said agreement;

In the above matter a hearing was scheduled for January 14th,1970,
at 10:00 oTclock,A.M.When you made the order setting the date of
hearing you informed me that if our medical testimeny was not available
we would go ahead with the hearing at the scheduled time and then
adjourn to a subsequent date convenient to the physician who would
testify.
I have been informed by Dr.Saul Greizman,a physician whe has treated
Dr.Rabe,that he could not be available until some time after
January 17th,the date on which he will again examine Mr.Rabe.
I would like to fellow your suggestien that we begin the hearing on
the date scheduled with the idea that it would be continued to permit
me to arrange for the medical testimony at a later time.

Leroy Rabe.the former incompetent,and makes the following Answer to
the Rule issued by the Honorable Thomas D.Gladden,J ••on June 13th,
1974.directing this Respondent to show cause why a distribution of the
assets in the former incompetent~s estate should not be made according
to a scheme of distribution proposed by Evelyn Ruth Rabe.the Respondentts..'
wife,in the above proceeding:
1.The scheme p~esented by 60unsel for Respondentts wife fails to
follow the directive of the Supreme Court of Pennsylvania.at No.79

March Term.1972.in that Cour4which specifically Orders a distribution
of the amounts held by the former guardian of Respondent to distributees
designated in that opinion.
2.The scheme proposed by Respondent's wife prevents the applicati n
of Respondent's assets.held by Respondentts former guardian.to the
payment of Respondentts debts.
3.The scheme proposed by Respondent's wife would apply assets
available for payment to unsecured creditors to the P?yment of a mort-
gage on a residence owned by Respondent and his wife by the entireties,
which has been occupied for many years by Respondentts wife to the exclu
sion of Respondent.which residence itself is ample security for the
mortgage debt.

4.The scheme proposed by Respondent's wife does not provide a
release of Respondent from the obligation to the Commonwealth of Penn-
sylvania arising out of Welfare payments made to and for the benefit
of Respondent's wife,which payments Respondent verily believes are a
Judgment against the real estate owned by Respondent and his wife.
5.The scheme proposed by Respondent's wife does not provide,
according to the information available to Respondent,for a release of
Respondent from his obligation to the Commonwealth of Pennsylvania for
the balance due for Respondent's treatment at Torrance State Hospital,
and will leave substantial claim against him for that balance,which
balance would be paid in full if the Order of the Supreme Court was
complied with.
WHEREFORE,Respondent prays your Honorable Court to disapprove the
arrangement for distribution of Respondent's funds proposed by Respon-
dent's wife,and further prays that distribution"of the Respondent's
funds be made to the persons entitled thereto under the provisions of
the Decree of the Supreme Court of Pennsylvania.
And he will ever pray,etc.

2.The balance for Distri'bution shall be in accord with

paid to Frank C.Carroll,Attorney,as additional fee.
Included in the inventory was a car valued in the amount
of $200.00 and the Title to this car shall be mailed to Arnold
Hirsch,the attorney for Davi:d L.Rabe,the i'ncompetent,at Mr.
Hirsch's office in Donora,Pennsylvania.
4.Notices of any hearings and of the Stipulation having
been received by the creditors,the attorney and the gua~dian do
not have to give any further notice of thi:s Decree and Order.
The balance for distri>buti:on in th.e hands of the account-
ant is presently as of September 20,1974 the sum of principal
in the amount of $10,159.60 and income in the amount of $111.38,
and the account,set forth above and in the Stipulation and Order
of July 8th,1974 is accordingly confirmed.
