Mr.Ramsey died June 5,1968.He had been acting as guardian of the estate of Robert Vankirk prior to the death of John Eagleson, in posses~don of a small amount of money at that tim e.The Will of John Eagleson provided for a trust of $50,000 placed in the hands of <.Mr.Ramsey as trustee for the m~intenance.and care of Robert E. Vankirk.Mr.Ramsey made an accounting at 224 of 1962,O.C. at a time vh en he had received from the Exec:utor of the Eagleson es ate the sum of $1,000 on account of the trust principal.And sinc«:t tbIat time until the time ofhis death Mr.Ramsey proceeded with the ad- ministration of the trust estate and intermingled with it the guardian't::; funds that he had previous in his hands. Als 0,the account indicat~s that during the course of the administration of the trust in 1966,Mr.Ramsey received $1509.93 from Margaret McCue,wJlJrrich\<\w;B.r..:e additional funds that she held for Robert E.Vankirk.One of the questions tha t has been placedJin the Petition Sur Audit,and a question in which Mr.Patrono,reEp resenting the remainderman,is interes<ted,is whether or not the funds that were in Mr.Ramsey's hands as guardi.n sgould be used for the care and maintemance of Robert E.Vankirk after the death of John Eagleson,inasmuch as the Eagleson trust wa~ quite broad in its terms and not only anticipated the usec.of income bl t 3 also the invasiori of principal for the purpos es of the trust. We suggested in the account or the Audit Petition in conneetion with the First and Partial Account of William C.Rams y in 1962 that some consideration ought ,to be given this matter.It is our recollection,however,that ~t that time the matter appeared to 0(z~.I>-VIZZIIIII. i~I!lZ XVI; ti~VIo .I0( ijo::l.., ~CII eliII:~II:oII.IIIII: l-II:::loU .I0( ij ii:...o be premature.And since there was no necessity or no division betwel:>n the estate of'Robert E.Vankirk and th.e remainderman at that time, the Court did not deal with the question. This same position may be 'true.at the present time since Robert E.Vankirk is still living and there is no present indication as to how long he will continue.His rate of use of assets i con- s iderably beyond the earning capacity of the balance 0 f the trust.This is further complicated by the fact that the principal of the trust consisted of bonds which were in a lock box not accessiBle to anyone but the testamentary trustee.He became ill.and somewhat incapacita ed. And a recent opening of the box under Court order disclos ed that some of the assets had matured.The bonds bore coupons which ShOlld . have been used as'!part of the income of the trust estate.And the bone s should have been reinvested. In the account,the accountant,for lack of particular knowledge as to the contents of the lock box,made an attempt in Schedules "c"and "D"to account for the stll9posed conten s of the box."In doing this,they claimed debits and credits which werE, I believe,improper in accordance with proper accounting principals ____________--'--~_l 4 ESlnce the contents of the box were not available to the accountant and would,.therefore,be reportable in this proceedi.ngs at the cost or carrying value of those particular ·assets..And that porrection has been made in the Petition for Audit and the exhibits attached to that. We call the attention of the Court to the fact that Robert E.Vankirk continues to have bills for maintenance and care accruing.His room and board has bem unpaid for two months now and there is an accruing bill,all of which is recited in the.Petition. There is also recited costs advanced by our firm in connection·with previous payments of bills during the'time that the testamentary trustee was incapacitated.And also a notation,testamentary trustee was not compensated at any time either in the prior account or in the present accounting period.And after consultation ~ith the Executrix of his .estate,·we have placed before the Court a figure of $500.00,in what we believe is nominal compensation for his services ~..- and have suggested compensation for our services as attorneys in thE.. amount of $750.00. It appears that this guardian received money belonging to the ward,Robert E.Vankirk,from other sou rces other than the trust set up under the WillM John Eagleson.The accountant is claiming that that money ought to be reimbursed to Mr.Vankirk from the John Eagleson trust.1Jhi's WIle object to because the effect of it is,of course,is to reduce the .potential value of the remainder. Now the question,of cour;e',whether or not the trustee was required to look principally for the maintenance of Robert E.Vankirk to this particular fund.And I would say,in supppr of our obj ection,nl.:lmber one,that the discretion by the will was rested on the fiduciary;And he apparently exercised it in the way he did,in other wor.ds,to use the sum of Mr.Vankirk's expenses,the funds other than the Eagleson trust fund and for use for some of therr to the Eagleson trust fund.aAnd it seems to me that his discretion, unless it's shown to be fraudulent or something like that,should not be disturbed. The second thing is,of course,that it seems to me that if Mr.Vankirk has funds available from different sources and the use of one will be to the disadvantage of the remaindermen, an:d1 the use .of the other will not,that the :aecountant or the fiduciar. 5 6 made a wise judgment when he would first use the ones that would no .impair the value to the remainderman. THE COURT:Well,it seems to the Court that he shouhifi havE 8 6 known whether or not he could continue in his duties and if he couldn' do what was required und.er the law,he should ha ve requested a termination of his fiduciary capacity and the appointment of a sub- stituted trustee.I don't feel that the reluctance of his wife to explair .~z~..J>-OlZ. His statement,I think,to his wife was that he felt that he didn't kno Iv how much of the money Robert Vankirk would need and that he didn't want to take any that might he necessary for Robert Vankirk's help. In this spirit,I expect he would resentlany claim for compensation at all. THE COURT:Well,we will take those matters into consideration.
