PETITION TO WITHDRAW APPEARANCE
TO THE HONORABLE P.V.MARINO,JUDGE OF SAID DIVISION:
AND NOW,J'alY I ~1970,comes Zeman and Zeman,a
partnership composed of Adolph L.Zeman and Robert L.Zeman,
your petitioner,and requests leave of Your Honorable Court to
terminate its representation,and to withdraw its appearance on
behalf of Martha L.Porco,Administratrix D.B.N.C.T.A.of the
Estate of Filomeno Porco,a/k/a Filomeno Palladoro Porco,a/k/a
Filomena Palladoro Porco,Deceased,in the captioned Estate,and
in support thereof avers as follows:
1.Filomeno Porco,a/k/a Filomeno Palladoro Porco,
a/k/a Filomena Palladoro Porco,died on September 11,1962,
testate,her Last Will and Testament being probated and on file in
the Office of the Register of Wills of Washington County,
Pennsylvania,in Will Book 95,page 475,and letters testamentary
in said Estate were issued to Constantino J.Porco.
2.The said Constantino J.Porco died on October 25,
1965,during the course of administration of the Estate of the said
Filomeno Porco,a/k/a Filomeno Palladoro Porco,a/k/aFilomena
Palladoro Porco.
3.Martha L.Porco was appointed Administratrix
D.B.N.C.T.A.of the Estate of Filomeno Porco,a/k/a Filomeno
Palladoro Porco,a/k/a Filomena Palladoro Porco,Deceased,by the
Orphans'Court of Washington County,Pennsylvania,and is still
acting as such fiduciary.
4.The completion of the administration of the Estate
of Filomeno Porco,a/k/a Filomeno Palladoro Porco,a/k/a Filomena
Palladoro Porco,Deceased,has been delayed by reason of the fact
that the major assets of said Estate are two parcels of real estate
which are involved in Eminent Domain proceedings pending in the
Court of Common Pleas of Washington CountY,Pennsylvania.
5.Your petitioner,Zeman and Zeman,has represented the
said Martha L.Porco as fiduciary in the adminiptration of said
Estate and as fiduciary and also the condemnee in said Eminent
Domain proceedings.
6.Your petitioner,Zeman and Zeman,has requested the
said fiduciary to approve of its withdrawal from the captioned
Estate and from said Eminent Domain proceedings and to terminate
its representation of her in the administration of the captioned
Estate and hen and the condemnee as counsel in the Eminent Domain
proceedings.The said fiduciary has ·approved and consented to the
withdrawal of your petitioner and has released your petitioner and
desires to secure other counsel.The duly executed Consent of the
fiduciary is hereto attached,incorporated by reference herein and
made part hereof.
.'7.Your petitioner,Zeman and Zeman,hereby waives any
fees which it has earned or to which it may be entitled by virtue
of the matters aforesaid.

WHEREFORE,your petitioner prays Your Honorable Court
to make an Order permitting it to terminate its representation of
said fiduciary in the administration of the captioned Estate and
to withdravJ any appearance on her behalf therein and to approve the
waivers and releases herein made or referred to.

CONSENT AND RELEASE
AND NOW,July 10,1970,the undersigned Martha L.Porco,
the duly appointed and acting Administratrix D.B.N.C.T.A.of the
Estate of Filomeno Porco,a/k/a Filomeno Palladoro Porco,a/k/a
Filomena Palladoro Porco,Deceased,does hereby consent to,and
approve,of Zeman and Zeman's terminating its representation of her
in the captioned Estate and withdrawing any appearance entered on
her behalf therein.'The undersigned desires to secure other counsel
to represent her.It is the understanding of the undersigned that
the said Zeman and Zeman has waived any fee which it has earned or'
to irlhich it may be entitled by virtue of any services rendered the
undersigned or the captioned Estate in the administration of said
Estate or in the Eminent Domain proceedings in the Court of Common
Pleas.The undersigned Martha L.Porco does,with the intent that
she and the Estate of Filomeno Porco,a/k/a Filomeno Palladoro Porco,
a/k/a Filomena Palladoro Porco,Deceased,be legally bound hereby,
release and forever discharge Adolph L.Zeman and Robert L.Zeman,
individually and as partners trading as Zeman and Zeman,from any
and all liability to her and to said Estate for or on account of all
acts,matters and things in the representation of her individually
and as fiduciary of the captioned Estate and the captioned Estate.
