PETITION 'h1S~J?7cJ TO THE HONORABLE,THE PRESIDENT JUDGE OF SAID .COURT: The Petition of Virginia T.Gebhardt,Administrator of the Estate of Owen McGinn,Sr.,Deceased,respectfully represents that: 1.Your petitioner is an individual West Virginia. who resides at Valley Grove, 2.The said Owen McGinn,Sr.,died intestate on October 12th,1967. 3.Letters of Administration were granted to your Petitioner on March 31st,1967,by the Register of Wills of Washington County,Pennsyl- vania,and the usual Estate Notice was advertised by the Administrator in the Washington County Heports and The Washington Observer.Attached hereto, marked Exhibits A,Band C.are the Letters of Administration and the proofs of publication of the Estate Notice. 4.At the time of his death decedent owned no personal property,except, a right of action for personal injuries.Subsequent to his death your petitioner filed a Complaint including a wrongful death and survival action against Brownsville General Hospital in the United States District Court for the Western District of Pennsylvania at Civil Action No.67-753.One Daniel E. Lester,a physician,was brought in as an additional defendant in this case. ., This case was settled prior to trial on petition to the District Court and your petitioner received the sum of $2,082.34 as Administrator of the Estate of Owen McGinn,Sr.,this amount being the net proceeds of the survival action after payment of the attorneys'fees,costs and medical expenses. 5.The total personal property now in the hands of the Administrator for.. distribution is $2,082.34. 6.No wages were paid to the petitioner or any other person under the provisions of Section 201 of the Fiduciaries Act of 1949,as amended. 7..Martha McGinn,the widow of decedent,has made claim for and is entitled to the family exemption of $1,000.00. 8.Attached hereto,marked Exhibits D and E,are photostats of the following bills: Bill of The Catholic Cemeteries Association, Bill of Leonard M.Pavlic Funeral Home, $167.00 703.00 These bills were paid by Martha McGinn,the widow of the decedent. 9.There are no other creditors of the decedent to your petitioner's knowledge.
