the Administrator Clyde C.Porter,J ,and through his attorneys alleges
as follows:
1.The Petitioner is Clyde C.Porter,Jr.,who was granted
ancillary letters D.B.N.C.T.A.with reference to the above estate by the
Register of Wills of Washington County,Pennsylvania,on the Z?nd-day of
June,1970.
2.The Petitioner is a resident of Cabell County,West Virginia
whose exact mailing address is 1005~Minton Street,Huntington,West Virginia
3.Evidence of his appointment as Administrator D.B.N.C.T.A.
of the Estate of Clyde C.Porter,Sr.,deceased,in Cabell County,West
Virginia,is evidenced by the records and affidavits submitted under triplicate
seal to the Register of Wills Office for filing.
4.The decedent Clyde C.Porter,Sr.,at the time of his death
was the owner of an undivided one-third (1/3)interest in the Freeport Vein of
coal underlying property situate in Fallowfield Township,Washington County,
Pennsylvania.A more detailed description is attached hereto as Exhibit "A"
and made a part hereof.
5.The decedent may have been unaware of the fact that he had ~
this interest in the Freepor~Vein .of coal underlying this certain property in
Fallowfield Township,Washington County,Pennsylvania,and thus made no
specific devise in his Will.
6.There is no other realty or personalty owned by the decedent
at the time of his death situate in the State of Pennsylvania.
7.The Petitioner has entered into an oral contract with Con-
solidation Coal Company,Library,Pennsylvania,to sell this coal to Con-
solidation Coal Company,Library,Pennsylvania,for the total sum of Four
Thousand and no/100($4,000.00)Dollars,and hence is the reason for the
application of ancillary letters and this Petition.
8.The Petitioner at the time of grant of ancillary letters was
required to post a bond in the amount of Four Thousand and no/100 ($4,000.00)
Dollars with the U.S.Fidelity and Guaranty Company as surety.
9.There are no liens assessed against this property.
10.The funds for the purchase price will be held in the hands
of Peacock,Keller,Yohe and Day and all estate expenses and inheritance 'tax
will be paid by this firm.
11.The Petitioner therefore requests that the filing of additional
security be waived because the bond as originally filed is adequate to protect
other heirs and creditors.
12.The only unpaid debts of the estate are the administrative
costs and any inheritance tax as far as Pennsylvania is concerned.
13.By Affidavit attached and filed in the Register of Wills the
Petitioner acknowledges his duty to pay Federal Estate Taxes and taxes levied
under West Virginia law.
14.It was required of the Petitioner that he file a bond in the
amount of Twelve Thousand and no/100 ($12,000.00)Dollars when letters were
originally issued in West Virginia.
15.The Petitioner requests the court,pursuant to section 541
of the Fiduciaries Act of April is,1949,P.L.512,20 P.S.§320.541,to
waive the filing of additional security before he may receive the proceeds from
the sale of the real estate above described or to fix the additional amount of
security.
