Orphans'Court Division,by Mary P.Zeman and Rob~rt L.Zeman,her
.husband,praying for the approval of the sale to them of the real
property of said Estate situate in Chartiers Tovmship,Washington
County,Pennsylvania,located on the "Valley Road,"having a mailing

$6,900.00,payable in cash upon the consummation of the sale by said

PETITION OF EXECUTRIX FOR LEAVE TO PURCHASE
UNDER SECTION 546 OF THE FIDUCIARIES ACT OF 1949
TO THE HONORABLE P.V.MARINO,JUDGE OF SAID COURT:
The Petition of Mary P.Zeman and Robert L.Zeman,her
husband,of the Borough of Canonsburg,Washington County,
Pennsylvania,respectfully represents:
1.Frank B.Dove,a resident of Chartiers Township,
Washington County,Pennsylvania,died testate on June 13,1966,
leaving his Last Will and Testament dated JUly 21,1965,probated
in the Office of the Register of Wills of Washington County,
Pennsylvania,in Will Book 102 page 103 Letters Testamentary
were thereupon granted to Mary P.Zeman,one of your petitioners
herein,by the Register of Wills of Washington County,
Pennsylvania.A copy of said Last Will and Testament is hereto
attached and marked Exhibit "A.l1
2.The devisees and legatees of said decedent,all of
whom are sui juris,and their respective addresses are as follows:
Charles Dove,R.D.#1,McDonald,Pa.
Katherine Baker,R.D.#2,Canonsburg,Pa.
Ruth Perrine,R.D.#1,Canonsburg,Fa.
Mary P.Zeman,620 Alpine Drive,Canonsburg,Pa.
Lois Camerson,R.D.#1,Canonsburg,Pa.
3.There are no unpaid creditors of the Estate of said
decedent except the Commonwealth of Pennsylvania for Inheritance
tax and Mellon National Bank and Trust Company for the balance due
on the mortgage hereinafter mentioned.There are no other unpaid
claims against the Estate of said decedent except the foregoing
creditors,and
a)The family exemption claim of Mary P.Zeman;and
b)The customary final administration costs,the
Executrix's commission and attorneys'fees.
4.The only real estate of which the decedent died
seized and which is proposed to be sold hereunder is described as
follows:
ALL that certain lot of ground situate in Chartiers
Township,Twashington County,Pennsylvania,being known and
designated as Lot No.1 in a proposed plan of lots surveyed
for C~arles F.Dove and Bert C.Perrine by B.E.Neill,
C.E.,of Canonsburg,Pennsylvania,dated July 13,1953,and
being more particularly bounded and described as follows,
to wit:
BEGINNING at a point on the southerly side of the
Valley Road leading from Canonsburg to Venice,at the
dividing line between Lots Nos.1 and 2 in said proposed
plan of lots;thence along said Lot No.2,South 36°32'
West 180.72 feet to a point on the northerly line of a proposed -
forty foot drive as shown in said proposed plan of lots;thence
along the northerly line of said proposed forty foot drive,
North 53°28'West 122.0 feet to a point at or near the west-
terly line of a forty foot street'or"drive originally reserved
to and contained in the deed of C.W.Patsch et ale to Charles
F.Dove et ale dated September 23,1948,and recorded in
Deed Book Vol.745,page 437;thence from said last mentioned
point and extending to and along the westerly side of said
reserved forty foot street,North 360 32'East 180.72 feet to
a point on the southerly side of the.Valley Road leading from
Canonsburg to Venice aforementioned;thence along the south-
erly side of said Valley Road South 53°28'East 122.0 feet
to a point,the place of beginning.Containing an area of
~50 acre,according to the survey and plot of said proposed
plan of lots made and prepared by B.E.Neill,C.E.,of
Canonsburg,Pennsylvania,dated July 13,1953,a copy of
which is attached to a deed recorded in Deed Book 87$page /8
in the Recorder's Office-of said County.
TOGETHER with a right of way or easement in common
with Charles F.Dove and Bert C.Perrine,their heirs and
assigns,and such others as may now or hereafter"have the right
to the use of the same,for foot and vehicular passage over
and along the.abutting roads,streets or driveways mentioned
in the above description for the purposes of ingress and egress
to and from the,premises hereinabove described.

Being the same premises conveyed to Frank B.Dove
and Priscilla D.Dove,his wife,by Charle~F.Dove et ux.
et al.by deed dated July 31,1953,of record in Deed Book
873 page 18 -in the Recorder's Office of Washington County,
Pennsylvania.The said Priscilla D.Dove predeceased Frank
B.Dove,in whom the entire title to said premises vested,
as the surviving tenant by the entireties.The said Frank
B.Dove died on June 13,1966 seized of said premises,
testate,his Last Will and Testament-being probated and
on file in the office of the Register of Wills of Washington
County,Pennsylvania in Will Book 102 page 103 ,in
which he appointed Mary P.Zeman as Executrix and to whom
Letters Testamentary were issued by the Register of Wills of
Washington County,Pennsylvania,as by reference to the
records in the Office of said Register of Wills will more
fully appear.
TOGETHER with the right of way or easement and use
of a certain water line in common with such others 'who may
now or hereafter be thereunto entitled,said right of way
or easement being more particularly referred to in a
certain grant and conveyance from Charles F.Dove et ux.
to Bert C.Perrine dated September 17,1963,of record in
Deed Book 1165 page 101.
THERE is erected upon the above described parcel
of ground a two-story brick house and a garage.
UNDER AND SUBJECT to such rights of way,exceptions,
reservations,etc.as may appear of record.
5.The assessed valuation of said property is $1350.00.
6.Attached hereto and marked Exhibits "BTl and ftC"are
Affidavits of Arthur E.Morris and Willard H.Bryant (both of whom
are duly licensed Real Estate Brokers and both of whom maintain an
office as a Realtor in the City of Washington,Washington County,
Pennsylvania),setting forth that they have inspected the real estate
proposed to be sold,that they are acquainted with the value of real
estate in the locality of such real estate,that they are not
employees of the fiduciary of the decedent's estate nor personally
interested in the proposed sale,and that in their opinion the price
to be paid at the proposed private sale is greater than can be obtained
at public sale.
7.An Inventory has been filed in the Estate of said

decedent,a copy of vvhich is attached hereto and marked Exhibit flD.1t
8.There are no liens of record against the said property
ex~ept a mortgage from Frank B.Dove,widower,to'Mellon National
Bank and Trust Company,dated February 24,1966,recorded February
24,1966,in Mortgage Book 677 page 352 in the principal amount
of $2100.00 on V'Thich there is a balance of $402.82 (\'1hich includes a
satisfaction fee of $1.00)through the month of June,1970.
9.Mary P.Zeman,who is the Executrix of the Estate of
Frank B.Dove,and Robert L.Zeman,her husband,of the Borough of
Canonsburg,Pennsylvania,desire to purchase the aforesaid real
estate .:..for the price of $6,900.00,payable in cash upon consumma-
tion of the sale by this Court;that such price is greater than can
be obtained at a public sale.
10.Attached hereto and marked Exhibit "Eff is a proposed
sales agreement for said premises,which is subject to the approval
thereof by the Court.
WHEREFORE,your petitioners pray for the approval of the
sale to them upon the terms set forth in this Petition and further
pray that the Court make an Order directing that the Clerk of the
Orphans'Court Division of the Court of Common Pleas of Washington
County,Pennsylvania,execute and deliver a deed to them.
