PETITION BY NATURAL GUARDIAN FOR
AUTHORITY TO SELL AND CONVEY MINOR'S
INTEREST IN REAL ESTATE
To The Honorable, the Judges of said Court:
The petition of MARY MARKINACK, respectfully represents:
1. That your petitioner is the mother and natural guardian of John A.
Markinack, a minor, seventeen (1 7) years of age, having been born on
March 7, 1953, and who resides with your petitioner at 122 Walnut Street,
Donora, Washington County, Pennsylvania.
...... ·-
2. That your petitioner, Mary Markinack, and her son, John A. Markinack,
are the sole surviving heirs of John Markinack, Jr., who died, intestate, on
December 13, 1965.
3. That at the time of his death, John Markinack, Jr., was seized of an
undivided one-sixth (1/6) interest in and to lots numbered 272 and 274 in the
Jenisee Land Company's Plan of South Donora, Washington County, Pennsyl-
vania, as awarded to him by certification of real estate at No. 308 of 1959 A.A
records of this Court, at a distributive value of $333.34.
4. That your petitioner and the remaining co-owners of said real estate,
other than the minor, have agreed with the Commonwealth of Pennsylvania,
Department of Highways, to accept the sum of Six Thousand Two Hundred and
No/100 ($6, 200. 00) Dollars as a result of the taking of said real estate for
right of way purposes of which the minor would receive the sum of $516.66
being one-half (1/2) of undivided one-sixth (1/6) interest.
5. That the real estate in question is assessed for taxation purposes in the
sum of $810.00 as appears from certificate of assessment attached hereto as
Exhibit "A".
6. That your petitioner believes and therefore avers that the total sum of
$6,200.00 to be a fair and reasonable price for said premises and greater
than can be obtained by appealing from the Commonwealth's offer with ensuing
legal fees and costs.
WHEREFOR.E, your petitioner requests the Court pursuant
to Section 1001 of the Fiduciaries Act of 1949, as amended, to authorize her
to convey the interest of her minor son, John A. Markinack, in the real estate
herein described and to join with the other tenants in common in executing
and delivering a deed for said real estate to the Commonwealth of Pennsyl-
vania, without the appointment of a Guardian or the entry of security.
