REAL ESTATE UNDER SECTION 541 OF THE
FIDUCIARIES ACT of 1949
TO THE HONORABLE P. V. MARINO, PRES !DENT JUDGE OF SAID COURT:
The Petition of Raymond Quail respectfully represents:
1. That Theresa Quail died on the 5th day of May, 1970,
intestate, leaving to survive her as her only heir at law, her
son, your petitioner, Raymond Quail.
2. That Letters of Administration were granted to your
petitioner, Raymond Quail, on the 20th day of May, 1970, by the
Register of Wills of Washington County, Pennsylvania, upon the
filing of a bond in the sum of $25,000.00 with United States
Fidelity and Guaranty Company.
3. That the only real estate of which the decedent died
seized is described as follows:
ALL that certain tract, piece or parcel of
land situate in the Borough of Ellsworth, Washington
County, Pennsylvania, that is designated as Lot No. 22:
in Block G in a plan of lots laid out by Bethlehem-Cub,
Iron Mines Company, and recorded in the Office for the
Recorder of Deeds in and for said County and State in i
Plan Book No. 7, pages 133 and 134, (recorded July 5, 1
1945), said tract, piece or parcel of land having erect-
ed thereon a house known and referred to as No. 32
North Pine Street.
4. That attached hereto are affidavits of two responsi-

ble persons familiar with real estate values, giving the fair mar-
ket value of said property proposed to be sold at $4,400.00.
5. The decedent left personal property in the amount of
approximately $20,300.00. '
I 6. That petitioner has entered into an Article of Agree-!
I ment for the sale of the abowe real estate, subject to the approv-:
al of your Honorable Court, for the consideration of $4,400.00
with Paul Andrew Shriner and June E. Shriner, his wife, the sale
price to be paid on or before December 1, 1974, in installment pay1

ments, a copy of said Agreement being attached hereto, made a partl
hereof, and marked Exhibit C. 1
WHEREFORE, your petitioner, requests Your Honorable Court
to fix the amount of additional bond to be given by him, or to
excuse him from giving additional bond under the provisions of
Section 541 of the Fiduciaries Act of 1949.

ceased, late resident of South Strabane TO't.-Jnship, vJas hington· County,
Pennsylvania, --------------------------------------(hereinafter called "Seller") and
PAUL ANDRE~·7 SlL.T{INER and JUNE E. SHRINER, his wife, of R. D. lfl Coal Center

WITNESSETH, that for the consideration hereinafter set forth and intending to be legally bound the Seller and
j , Buyer mutually agree as follows:
1. Seller agTees to sell and convey to buyer on or before December 1, 1974-
by genera 1 warranty deed in fee simple absolute, clear of all mortgages, judgment liens
and tax liens. and other encumbrances affecting its marketability (except as hereinafter set forth) all the real property
described in Paragraph 8 hereof.
2. Buyer agrees to purchase said real property and to ·pay Seller therefor the sum of Four Thousand
four hundred and no/100-----($4.,400.00 )Dollarsasfollows: Five Hundred Dol-
lars ($500.00) downpa~nent upon the signing of the within Agreement, re-
ceipt whereof is hereby acknowledged, and the balance in the amount of
$3,900.00, payable as follows: Fifty ($50.00) Dollars, or more, on the
first day of December, 1970, and a like sum of Fifty ($50.00) Dollars, or
more, on the first of each and every succeeding month thereafter, the
monthly payment to be applied first to interest at the rate of seven (7%)
per centum per annum, and the balance to be applied to reduction of the
principal debt, said monthly payments of principal and interest as afore-
said to continue until December 1, 1974, when the entire debt shall be paid

Buyers hereby covenant and agree to secure fire insurance cover-

Buyers further covenant and agree, as a part of the.within
agreement, to pay to Seller, in addition to the $50.00, or more;· monthly pay-
ments on this agreement, ·to pay 1/12 of the annual real estate taxes on the
premises, which Seller agrees to hold in an EscrO't•7 Account and to pay the .
real estate taxes from the same when they become due and payable.
It is further understood and agreed bet~een the parties hereto
that this Agreement may be paid in full any date prior to December 1, 1974,
without penalty to the Buyers ..

8. The real property which is the subject of this Agreement is described as follows:
ALL that certain tract, piece or parcel efland situate in the
Borough of Ells\·lorth, Hasb.ington County, Pennsylvania, that is designated
as Lot No. 22 in Block G in a plan of lots laid out by Bethlehem-Cuba Iron·
Mines Company, and re.corded in the Office for the P~ecorder of Deeds in and
for said County and State on July 5, 1945, in Plan Book No. 7, at pages 133
and 134, csaid. tractr··piece or parcel of land having erected _thereon a house
known and referred to as No.~ 32 North Pine Street.

BEING the same premises conveyed by Bethlehem-Cuba Iron Mines
Company to Charles Quail and The·res'a Quail, his wife, by deed dated 'August
9, 19L:-5, and of record in ·the Recorder's Office aforesaid in Deed Book
707, page 173. The said Charles Quail died on Villrch 24, 1970, whereupon
by operation of law, the fee simple title in and to the within-described
tract of land vested in Tneresa Quail, widow, as surviving tenant by the
entireties.
The said Theresa, Quail died on May 5, 1970, intestate and.
Letters of Adminis-tration in her estate were granted by the Register of
Wills in and for Washington County, Pennsylvania, on May 20, 1970, to
her son and only heir at law, Raymond Quail.
' THIS CONVEYANCE is made under and subject to such exceptions,
reservations, rights of way, restrictions, easements, etc., as heretofore
granted and/or conveyed by the predecessors in the chain of title and of
record.

9. If Buyer defaults in payment or performance for thirty days, Seller may, at Seller's election,
use one or more of the following remedies in addition to or instead of any other remedies provided by law:
(a) rescind this agreement and retain all sums paid on account hereof as liquidated damages, in
which case Seller shall retain title to the real estate free and clear of any obligation or duty to Buyer and Buyer
shall surrender this Agreement for cancellation;
(b) eject Buyer from said real estate, for which purpose Buyer hereby .authorizes any attorney
of any Court of Record to appear for Buyer and confess judgment against Buyer in an amicable action of ejectment,
with immediate writ for possession of the real estate and for damages, to include attorney's commission of 10 %
or $ -----·and costs, hereby waiving stay of execution, exemption and inquisition, with release of all errors;
(c) affirm this agreement by delivery of deed to Buyer, declare all sums due hereunder to be
forthwith due and payable, and cause judgment to be entered therefor, for which purpose Buyer hereby authorizes
and empowers any attorney of any Court of Record to appear for Buyer and confess judgment against Buyer for
the whole balance due, together with interest, attorney's commission of 10 . % or $ ------, and costs,
and hereby agrees to immediate execution thereon, waiving stay of execution, exemption and inquisition, with re-
lease of all errors. _
10. This Agreement shall extend to and benefit and bind the heirs, executors, administrators, successors and
assigns of the parties. Whenever used herein, the singular number shall include the plural, the plural the singular
and the use of any gender shall include all genders.
NOTICE-THIS DOCUMENT MAY NOT SELL, CONVEY, TRANSFER, INCLUDE OR INSURE THE TITLE TO THE COAL
AND RIGHT OF SUPPORT UNDERNEATH THE SURFACE LAND DESCRIBED OR REFERRED TO HEREIN, AND THE
OWNER OR OWNERS OF SUCH COAL MAY HAVE THE COMPLETE LEGAL RIGHT TO REMOVE ALL OF SUCH COAL
AND, IN THAT CONNECTION, DAI\1AGE MAY RESULT TO THE SURFACE OF THE LAND AND ANY HOUSE, BUILD-
ING OR OTHER STRUCTURE ON OR IN SUCH LAND THE INCLUSION OF THIS NOTICE DOES NOT ENLARGE, RE-

That Schedule A attached hereto and made part hereof sets forth full v and in detail all the
real property in the Commonwealth of Pennsylvania of which decedent died having an interest therein. It
also sets forth the mortgage encumbrances upon each parcel of real property at the date of death, giving
the amount still due at death, name of mortgagee, date, rate of interest, and book and page of record
thereof. It also sets forth in the columns provided therefore the assessed valuation of each of said
parcels, the estimated market value thereof as of date of death of deced~nt.
That Schedule B attached hereto and made part hereof sets forth fully and in detail all personal
property wheresover situated owned by the decedent at the time of death; all moneys left by the decedent
at the time of death, whether in decedent's immediate possession, standing to decedent's credit in banks
of deposit, savings banks, trust companies, or other institutions, whether individually, or in trust for
any other person or persons giving also separately the accrued interest thereon, if any, down to the last
interest day prior to decedent's death in the case of savings banks, and to the date of decedent's death
in all other cases; all bonds, postal savings, treasury certificates or notes and other evidence of in-
debtedness of the United States to the decedent; all obligations, whether by statute or agreement they
are designated as tax free, of the United States, or any state, or political subdivision thereof, or of
any foreign country, which are owned at the time of death; all wearing apparel, jewelry, silverware, pic-
tures, books, works of art, household furniture, horses, carriages, automobiles, boats, and any and all
other personal chattels of whatsoever kind or nature, left bydecedent, together with the fairly estimated
market value thereof; all bonds and mortga~es held by decedent and of all claims due and owing decedent
at the time of death, and all promissory notes or other i~struments in writing for the payment of money
of which decedent died possessed, of whatsoever nature, with interest thereon, if any, giving the face
value and estimated fair market value thereof, and if such 'estimated fair market value b.e less than the
face value, it sets forth briefly the reasons for such depreciation as to each item; all moneys payable
to the estate froni life insurance polici-es carried by decedent; all annuity and endowment contracts the
proceeds of which were payable upon the death of the decedent; and all the corporate stocks and dividends
due thereon and unpaid as of the date of death, bonds and accrued interest thereon to the date of dece-
dent's death and other investment securities owned by the decedent at the time of death, with the market
value thereof at such time.

In the case of securities of close or family corporations, the values reported are as far as
possible substantiated by financial statements of the corporations, showing the assets and liabilities
thereof as of the date of death. The schedule also sets forth the interest of decedent at the time of
death in any co-partnership or business, and in support of the value of such interest there is annexed to
1 l said schedule, financial statements showing the assets and liabilities of said co-partnership or business.
A copy of the co-partnership agreement, (if oral, a statement setting forth the nature of the agreement)
together with a statement setting forth the character of the business, its location, and such other facts
pertaining to the business as may be pertinent to a fair and just appraisal, of t~e decedent's interest
therein must be submitted. It should also set forth in itemized form, together with the fair market value
thereof, any other property owned or bequeathed by the decedent at the time of death.
The Schedule C attached hereto and made part hereof sets forth a true answer to each inquiry
contained therein and in the case of transfers ofproperty, real or personal, within two years of decedent's
death, in contemplation of decedent's death, or intended to take effect in possession or enjoyment at or
after death, said schedule sets forth the nature and value of such property, to whom transferred, the
relationship of the transferees to the decedent, the proportionate share received by each transferee and
all other facts of a pertinent nature regarding said transfers. In the case of transfers intended to
take effect in possession or enjoyment at or after death, there is also attached to the schedule a co~y
of the deed, trust agreement or other instrument creating the trust. Thert~ is also set forth in said
schedule a list of all property, real and personal, with its value, which passes at decedent's death by
virtue of the exercise by decedent, either individually, or jointly with another, or any power of appoint-
ment vested in decedent, either individually or jointly, by the will, deed, or other instrument of another,
with a copy of the instrument creating such power attached to the schedule.
That Schedule D attached hereto and made part hereof sets forth the names and addresses of all
persons beneficially interested in this estate at the time of decedent's death, the nature of their res-
pective interests, their relationship, if any, to the decedent, together with the ages at the time of
decedent's death of all minors, annuitants and beneficiaries for life under decedent's Will. It also
contains a statement showing which of the beneficiaries named in the decedent's will, if any, died prior
to decedent, the dates of their death, their issue, andthe relationship of such issue to the beneficiary.
That Schedule E attached hereto .and made a part hereof sets forth all property, real and per-
sonal, owned by the decedent jointly with another or others, including intangible, standing in the name
of the decedent and others, plus the date and place of record of instruments effecting the vestiture of
real estate and the date of acquisition of personalty, plus the name, address and relationship, if any,
of co-owners to the decedent.
That Schedule F attached hereto and made a part hereof sets forth fully and in detail all debts
and deductions claimed for and on behalf of this decedent's estate, including funeral expenses paid;
family exemption, where applicable; costs of administration of this estate; counsel fees and fudiciary's
commissions paid or to be paid; cost expended for burial trusts, tombstones or gravemarkers, and reli-
gious services, in consequence of the death of the decedent; debts and claims owing and tmpaid at time of
death; taxes accrued chargeable for period prior to decedent's death (except those allowed under Section
651 of the Inheritance and Estate Tax Act); together with a statement of collateral pledged for obliga-
tions, if any. It is agreed that the fiduciary will present proof of said claimed obligations upon re-
quest, that if the amount actually paid in settlement of any fee, commission or debt is less than the
estimated amount claiming and allowed, that the same will be reported to the Register of Wills, and that
the amount of tax assessed can be reassessed in accordance therewith.
That the totals of the appropriate columns in Schedules "A", "B", "C", "E", and "F" as directed therein,
have been carried forward and properly registered in the Summary.
