Russell Marino , Register for the Probate of Wills and Granting
Letters of Administration in and for the County of Washington, in the Commonwealth of Pennsylvania,
the last Will and Testament of
Sara S s McBurney
late of Canonsburg in the County aforesaid, deceased,
(a true copy whereof is to these presents annexed), was duly admitted to probate; and
John R. McBurney
the Executor in said Will and Testament named, having appeared before me and taken and subscribed
the oath of office prescribed by law;
NOW, THEREFORE, I, Russell Marino , Register as aforesaid, do
grant these LETTERS TESTAMENTARY, unto the said
John R. McBurney
committing unto Him the administration of all and singular the goods and
chattels, rights and credits, which were of said deceased, and requiring Him
to exhibit a true and perfect inventory thereof into the Register's Office, at Washington, within ninety
days from the date hereof, and to r·ender a just and true account of said administration at the expiration
of six months from the date hereof, and to regard and comply with the provisions of the laws of this
Commonwealth relating to inheritance taxes.

Elizabeth McBurney, has filed her election to take in kind all of
the property of the estate. She is the sole distributee. The only
items in our suggested distribution to which we: call the Court's
attention, Miss Elizabeth McBurney is a substantial creditor
of the estate and it is our understanding that if the Court sees
fit to award the entire balance of the estate to her, her claim
would merge in that award. :?\:hdtthat the only other claims are
those of the Washington County Board for the assessment and
revision of taxes in the amount of $5~91, which has been admitted
I note that the Audit Petition does not state a claim of Internal
Revenue Service. There has been no fiduciary's return filed.
It is not likely that there will be any monies payable by reason of
tl:lis return. The payment of the Pennsylvania Transfer Inheritanc
Tax has not been paid, but the suggested distribution is made
to the sole distributee. subject to her payment of the Personal
Property Tax and any Inheritance or other taxes now and hereafte
found to be due. We therefore. under these circumstances, Your
Honor. respectfully request that the audit in this account be close~
as well.

PETITION
TO THE HONORABLE P. VINCENT MARINO:
The Petition of Elizabeth McBurney respectfully represents:
1. Sara S. McBurney died on April 16, 1970, resident of
Washington County, Pennsylvania, and letters testamentary in~her
~ estate were granted to John R. McBurney, as Executor, on May 22,
1970.
2. The said John R. McBurney filed his First and Final
Account in the Estate of said decedent, together with a Petition
sur Audit.
3. On April 19, 1971, the Orphans' Court Division of the
Court of Common Pleas of Washington County, Pennsylvania, confirmed.
the said Executor's account and entered an Adjudication and Decree,
a copy of which is hereto attached, incorporated by reference herein
and made part hereof, as Exhibit "A.n The said John R. McBurney,
Executor, died on April 23, 1971, a resident of Allegheny County,
Pennsylvania, but no administration has been raised in his Estate
nor is any administration contemplated.
4. The said John R. McBurney, Executor, died before he
was able to comply with the Schedule of Distribution which was
made a part of the aforesaid Adjudication and Decree.
5. The several share certificates referred to in the
Schedule of Distribution had been executed by the decedent in
blank in her lifetime but were never delivered and formed part of
her Estate.
6. In connection with said share certificates, certain
dividend checks have been issued to the order of Sara S. McBurney
in care of John R. McBurney as Executor which remain uncashed.
7. The payments specified in said Schedule of Distri-
bution to Washington County, Division of Personal Property Tax
and to Russell Marino, Agent, Transfer Inheritance Tax, have not
been paid for the reasons aforesaid.
8. There remains on deposit in the Mellon National Bank
and Trust Company the sum of $247.84 in the name of the Estate of
Sara McBurney, John R. McBurney, Exec., account No. 109-0693.
9. Your petitioner believes and therefore avers that
the Adjudication and Decree having been made as aforesaid, but not
having been carried out by reason of the ensuing death of the
Executor, that an administration d.b.n.c.t.a. is not required for
the purpose of carrying out the Adjudication and Decree of your
Honorable Court and that your Honorable Cour~ has inherent power
to enforce and direct the manner of distribution of all assets and
the payment of all claims herein referred to by your petitioner,
who is the sole interested party.
WHEREFORE, your petitioner, showing as aforesaid, prays
that your Honorable Court enter a decree directing that your
petitioner be permitted to do and perform the several acts and

DECREE AND ORDER OF COUR

AND NOW, to wit, this -'f~y of ~97-{,
foregoing Petition having been presented n open ~rt and
upon motion of Zeman and Zeman, the prayer of said Petition is
hereby granted and this Decree and Order shall constitute suffi-
cient authority to Elizabeth McBurney to do and perform the several
matters and things required to carry out the Adjudication and
Decree of this Court made in the above-entitled Estate under date
of April 19, 1971.
It is, further, Ordered and Decreed that this Order and
Decree shall constitute sufficient authority to the Mellon National
Bank and Trust Company to make payment of the balance in its
Account No. 109-0693 directly unto the said Elizabeth McBurney and
to said Bank and any other bank or corporation to accept the endorse-
ment of any presently uncashed dividend checks by the said Elizabeth
McBurney and to all corporations and transfer agents thereof to
accept the assignment and delivery of any share certificates now
standing in the name of Sara S. McBurney to the said Elizabeth
McBurney.
It is further Ordered and Decreed that the said Elizabeth
McBurney shall, and hereby is, authorized to make any payments to
any public body or public official of any amounts required by the
said Adjudication and Decree of this Court with any interest which may
have accrued thereon.
