Being the same lot of ground conveyed by George Shearn, et ux., to Jas. G. Shearn by deed dated May 23, 1883 and recorded in the office of the Recorder of Deeds in and for Washington County aforesaid, in Deed Book 5-Y, page 343, and which is also a part of Lot No. 1 in a Plan of Lots laid out for A. G. McPherson, said Lot No. 1 having been conveyed by the said A.G.Mc- Pherson to George Shearn by deed recorded in said Recorder's Office in Deed Book Vol. 4-U., page 42; and being the same premises conveyed to Charles C. McVicker by the Citizens Trust Compa,ny of Canonsburg, Executor of the Last Will and Testament of the said James G. McVicker died February 28, 1936, leaving a Last Will and Testament' dated April 19, 1924, duly probated March 3, 1936 and remaining of · record in Will Book Vol. 54, page 85, wherein he devised his whole estate, including the above described realty, to his widow., Anna Mary McVicker. 2. ALL that certain lot of ground situate in the Second Ward of the Borough of Canonsburg, Washington County, Pennsylvania, bounded and described as follows: 11 Beginning at an iron pin and which was a point in the center of the Cemetery Road; thence south 2° 451 West 50 feet to a point in the center of the present Oak Spring Road; thence by the center of the present Oak Spring Road, in a northerly direction a distance of 7 3. 6 feet to a point; thence through said road North 24° 501 East 2 feet to a point; thence through said road and along property of Anna M. McVicker and Emma J. Shearn, South 68° 45 1 East 40 feet to an iron pjn the place of beginning; according to survey prepared by H. M. Day, Engineer, in April., 1928.11 Being a small triangular piece of ground contiguous to Tract described at 11 1." hereof, conveyed by D.Roy Clyde and Grace H. Clyde, his wife, to Anna M. D. 19 70, before me, Russell Marino , Register for the Probate of Wills and Granting Letters of Administration in and for the County of Washington, in the Commonwealth of Pennsylvania, the last Will and Testament of Anna Mary McVicker late of Canonsburg in the County aforesaid, deceased, (a true copy whereof is to these presents annexed), was duly admitted to probate; and Carl YN.. Upon the death or marriage of my said daughter, whic.hever shall first occur, I direc~ my hereinafter named Executors, or the survivor· of them, to sell my said home property and after deducting the expenses incident to such sale, to divide the net proceeds thereof, in equal shares, among such of my children who shall be living at that time, including my said daughter, Minnie McVicker, if the termination of her estate in said property is caused by reason of her having married. PROVIDED, HOWEVER, that if my said daughter · during her lifetime and prior to her marriage shall notify, in writing, my here- inafter named Executors, or the survivor of them, that l.t is no long.er her desire to reside in said home, then and in such event I authorize, empower and direct my hereinafter named Executors, or the survivor of them, to sell my said home property and after deducting the expenses incident to the sa:ld sale to divide the net proceeds thereof equally among all of my said children, in- cluding my said daughter, Minnie McVicker, who shall be living at the time of such sale. , .. J FOURTH: All the rest, residue and remainder of my estate, real, personal and mixed, of whatever nature and wheresoever situate, which I may own or shall have the right to dispose of at the time of my death, I give, devise and bequeath in equal shares to all of my children who shall survive me. I direct that all Estate, Transfer, Inheritance and like taxes, and any interest or penalties thereon, imposed or assessed by the Federal or State governments, or any other duly constituted authority, upon or with respect to property passing under this, my Will, and with respect to any property passing outside of my Will, which is required to be included in my taxable estate, be paid out of my residuary estate, and that no portion thereof shall be apportioned to or collected from any legatee, devisee or other recipient of property constituting part of my taxable estate. FINALLY, I nominate, constitute and appoint my said daughter, MINNIE McVICKER, and my son, CARL W. McVICKER, to be Executors of this my Last Will and Testament, and further direct that my said Executors shall not be required to give bond in any jurisdiction in which they may be r~quired to act. Beginning at a point on the northern boundary line of Oak Spring Road and-in line of lot of land formerly of John W. Shearn., now of Emma J. Shearn, et al.; thence along the line of land of said Emma J. Shearn., et al., North 43 1/4• East 177 feet to the southern boundary line of an alley; thence along said alley North 69• West, 100 feet to other property of said James G. McVicker died February 28, 1936, leaving a Last Will and Testament dated April 19, 1924, duly probated March 3, 1936 and remaining of record in Will Book Vol. 54, page 85. ·wherein he devised his whole estate, including the above described realty, to his widow, Anna Mary McVicker. McVicker, co-executors, and to whom Letters Testamentary on her estate were duly issued by said Register of Wills, and in which Will, in paragraph "THIRD" thereof, she devised her "home property" consisting of the two hereinabove described parcels of ground, as follows: "THIRD: I give and devise my home property., situate at 108 Oak Spring Road, Canonsburg, Washington County, Pennsylvania, to my daughter, MINNIE McVICKER, for and during the term of her natural life, or until such time as she shall marry. Upon the death or marriage of my said daughter, whichever shall first occur, I direct my hereinafter named Executors,.' or the survivor of them., to sell my said home property and after deducting the expenses incident to such sale, to divide the net proceeds thereof, in equal shares, among such of my children who shall be living at that time, including my said daughter, M!nnie McVicker, if the termination of her estate in said property is caused by reason of her having married.
