UNDER PROVISIONS OF SECTION 541
OF THE FIDUCIARIES ACT OF 1949
TO THE HONORABLE P.V.MARINO,JUDGE OF SAID COURT:
The petition of Edwin E.Dray,Administrator C.T.A.
of the Estate of Samuel C.Dray,deceased,respectfully
represents:
1.Samuel C.Dray,late of the Borough of Beallsville,
Washington County,Pennsylvania,died testate on April 25,1970.
2.Letters of Administration C.T.A.were awarded to
your petitioner by the Register of Wills of Washington County,
Pennsylvania,on May 4,1970.
3.The said decedent died seized of the following
described real estate which is the subject of this petition:
ALL that certain lot or parcel of land situate
in the Borough of Beallsville,County of Washington
and State of Pennsylvania,bounded and described as
follows,to-wit:Fronting sixty (60)feet on Gay
Street and extending back of even width one hundred
eighty (180)feet to Gay Alley,being bounded on the
North by Lot No.101;on the South by Lot No.99;
on the East by Gay Alley and on the West by Gay
Street.Being Lot No..100 in the General Plan of
the Borough of Beallsville,Washington County,
Pennsylvania.
Grantors reserve to themselves,their heirs
and assigns,the right to use,water from cistern
on the Southeast corner of said lot,together with
the right of ingress and egress to the same.
Said reservation to terminate when city water
is installed in the buildings on other property
of grantors now supplying water to said cistern.
BEING the same lot of ground conveyed to
Samuel C.Dray and Nannie M.Dray,his wife,
by deed of James B.Baker et ux.,dated August
5,1948,and recorded in the Recorder's Office
of Washington County,Pennsylvania,in Deed
Book 749,page 472.The said Nannie M.Dray
died on May 29,1969,leaving the said Samuel
C.Dray as the surviving tenant by the entireties.
4.Decedent died seized of no other real estate,but
left personalty,as follows:
(a)Savings Account in Gallatin
National Bank,Richeyville
Branch
(b)Social Security receipts
(c)Miscellaneous household goods
and furniture

5.Attached hereto and made a part hereof,and
designated as Exhibit "A"and "B",are the affidavits of two
(2)responsible persons familiar with real estate values in
said area,as to the fair market value of said premises.
6.Attached hereto and made a part hereof,and
designated as Exhibit flC",is the Assessment Certificate of the
Board for the Assessment and Revision of Taxes for Washington
County,Pennsylvania,showing the present assessed value of said
premises.
7.Attached hereto and made a part hereof,and
designated as Exhibit flD",is an agreement between Edwin E.Dray,
Administrator C.T.A.of the Estate of Samuel C.Dray,deceased,
and Helia E.Silander,dated May 4,1970,for the consideration
of Seven Thousand Five Hundred and No/IOO ($7,500.00)Dollars,

which is a fair and a full price for the subject real estate
and the furniture designated therein,and a better price,in
the opinion of your petitioner,than can be obtained at public
sale.
8.At the time your petitioner was awarded Letters
of Administration C.T.A.,he filed a bond in the amount of One
Thousand and No/100 ($1,000.00)Dollars with Travelers Indemnity
Company as surety.
WHEREFORE,your petitioner prays your Honorable Court
to fix such additional bond as it may require of your petitioner
as Administrator,prior to completing such sale,in accordance
with the provisions of the Fiduciaries Act of 1949,Section 541,
as amended.

first part,hereinafter referred to as remaindermen,

EDWIN E.DRAY,party of the second part,hereinafter referred to
as life beneficiary.
WHEREAS,Samuel C.Dray died on April 25,1970
leaving a Will of record in the Register of Wills Office of "
Washington County,Pennsylvania in Will Book 110,Page \
and,
WHEREAS,said Will provided that the remainder
of the estate of Samuel C.Dray was to be held in trust by
Alfred Elliott,as Trustee,who was to pay the Sum of One Hundred
~100.00)Dollars per month to the life beneficiary,Edwin E.Dray,
until the entire amount of the trust fund was paid out,and in the
event that the life beneficiary died before the payment of all of
the money from said trust fund,that the Trustee was to pay the
remaining balance,in equal shares,to decedent's three grand-
children,the said remaindermen;and,
WHEREAS,the said Alfred Elliott on May 6,1970
renounced his right to act as Trustee under said Will;and,

WHEREAS,Edwin E.Dray,the said life beneficiary,
is also Administrator C.T.A.of the estate of Samuel C.Dray;
and,
WHEREAS,a substituted Trustee will be appointed
by the Court at the time of the final distribution of the estate
of Samuel C.Dray;and,
WHEREAS,the .said Edwin E.Dray is in dire need
of funds in order to make payment of a delinquent balance due
on a mortgage to Pittsburgh National Bank,Charleroi Office,
Charleroi,Pennsylvania,in order to avoid foreclosure;and,
WHEREAS,the remaindermen have consented to an
advance to the life beneficiary of an amount sufficient to pay
the balance due on said mortgage from the aforesaid trust fund;
N~J,THEREFORE,it is hereby agreed as follows:
1.The remaindermen consent to and hereby
authorize Edwin E.Dray,Administrator C.T.A.of
the estate of Samuel C.Dray,deceased,to withdraw
the sum of $1,340.18 from the balance to be distributed
in the estate of Samuel C.Dray to a trust fund to be
established for the benefit of Edwin E.Dray as life
beneficiary,and to pay said sum directly to Pittsburgh
National Bank,Charleroi Office,Charleroi,Pennsylvania
as payment in full of a delinquent mortgage due and payable
by the said Edwin E.Dray to the said Pittsburgh National
Bank,and to receive from said bank acknowledgment of
receipt of payment and satisfaction in full of said
mortgage.

2.The remaindermen hereby consent and
authorize Edwin E.Dray,Administrator C.T.A.,
aforesaid,to withdraw from the balance to be
distributed in the estate of Samuel C.Dray the
Sum of $173.00 and to pay said sum to Kathryn
Dray,one of the remaindermen,who has advanced
said amount in payment of an installment on
said mortgage in order to avoid foreclosure,
said paYment to be in reimbursement for said
advancement.
3.The remaindermen hereby waive
all right and claim to the aforesaid sums of
$1,340.18 and $173.00 and agree to exonerate
and save harmless the Administrator C.T.A.
and the appointed Trustee from any liability
to account therefor as part of the trust
created under the Will of Samuel C.Dray,
deceased.
4.The life beneficiary agrees that
the paYments aforesaid be made to the Pittsburgh
National Bank and to Kathryn Dray from said
trust furid and hereby waives any further claim
thereto.The life beneficiary further agrees
to exonerate and save harmless the Administrator
C.T.A.and the appointed Trustee from any
liability to account therefor as part of the
trust created under the Will of Samuel C.Dray,
deceased.
