Hospital,seems to be'signed by Mr.Rager,who~I know persona ly and presumably the account and the request is correct. Your Honor,very briefly;,I think the Common , ,wealthts attorney and I can agree on the,facts.'My discussions, with Mr.Duff on the telephone led me to believe that really ther e ~, ,was no factua~dispute and it was a question of law and perhaps of interpretation'.Very briefly,when Anna Kostelich diedin.'1970, ~..~ she left the children surviving,which'appear in the estate'papers. She left-a hundred dollars each to these named sons and daughters And the balance of the estate .was left to Albert and Thomas Kostel'ch. -.Thomas Kostelich,the executor,is also a son and he is in Court'., at this time.Now when she ~ied i~1970 and she left a small es ta ~ of around $10,000,a't that time the son,Frank Kostelich,was,. already out of Torrance,State Hospital.The records show that he was in there from about 1966 to 1969.There was some reason 3 to believe that he was in ther e perio~ically and was not in there three years steady. We filedour))rief with Your Hon~r.And • •I basically,it is ourcohtention that under the cas\e law,and .. particularly the Act of 1906,being 50 P.S.4501,that the primar),' responsibi~ity is imposed upon the person receiving the service " or benefit.Therefore,we conte'nd now and in our brief that the \' 4 Commonwealth,s inc e Frank Kostelich was not an inmate at the tiTle of her death and is not now an inmate,that the Commonwealth sho ld first have gone agai'ns t Frank Kostelich as being primarily liable. Not only theca~e law in the Act of 1966,b~t plair;justice and equ'ty ¥(ould seem to command this result,because what happens is that, the Commonwealth takes a shot at the estate without making any ,detE;rm:ination of whether or not Frank can pay for this and attempts to.take money out of the estate,and .this money would go to the two residuary legatees,that is Thomas and Albert Kostelich, ~,.I", who,incidentally,are the pers ons who :r:nainly took'care of their mother in her many declining years. The papers will show that Frank Kos telich, .the former inmate,would be entitled to a legacy of $100.00,as wclLild the other heirs.
