Pursuant to the provlslons of Section 1001(1)of the Inheritance and Estate Tax Act of 1961,a PROTEST is filed against the action of the Register of Wills of Washington County on October 9,1970,allowing the $1,000.00 family ex~mption claimed on the Statement of Debts and Deduct- '"ions filed in the subject estate. A review of the record in this estate discloses that the decedent, Eilo M.Beltz,died February 12,1970,possessed soley of three bank ac- counts jointly held with her three children.These assets were reported to the Commonwealth and subsequently appraised on October 9,1970,by the Commonwealth's appraiser at an aggregate sum of $5,174.50. It is the Protestant's position that the $1,000.00 family exemption claimed by Eilo Mae Gordon is not a proper deduction in this estate for the reason that it cannot be claimed against jointly held property.See Stevens'Estate,434 Pa.259. In view of the ab~ve cited facts,Protestant contends that the $1,000.00 family:exemption should be stricken from the record.
