MR.SANDERS:If the Court please~I have all of the necessary
papers in this estate.Similar to the Ward estate,thts decedent
died a resident of Florida.The only ass et in Florida was a car
which is being handled down there.The widow elected to take
against the will,which was made before the marriage to her.The e
are only two heirs:a son~who will take under the will,and the

widow.who would take under the Intestate Act by taking against the
will.She has not claimed a widow's exemption here.due to the
decedent dying in Florida.We are asking in this estate that the
Cou rt award all of the Pennsylvania estate direct to the two heirs

and nothing to the Florida estate,the re being nothing down there
except the automobile.And the heirs desire it to be done in this
way.
While the widow elected to take against the
will.she did this with the knowledge and consent,of COurse,of
the Executor and son who feelsshe should do that.All Known
claims·except audit costs and the balance of Inheritance Tax have
been paid.The 1970-1040 Income Tax Return has been filed and
no tax was due.The balance in the estate is all cash and sho uld
be awarded half and half to the widow and the son.

l'he Petition of Paul David O1rry,respectfully represents:
1.l'hat James William T.CUrry,late of caryville,
Florida,died testate,on November 30,1969,and Letters Testamen-
tary on his estate were granted to Paul David Curry,in Washin9to~
County,Florida.
2.That on April 6th,1970,the Register of Wills of
Washington County,Penna.,granted Ancillary Letters Testament~y
in the Estate of James William To Curry,to Paul David Curry,'and
-
he filed Surety Bond in the_amount of $1,000.00.
3.that.James Wil:l~am T.CUrry,at the time of his death,
o~Yned personalty in Florida valued.at $1,500.00,and realty in
Penna.,appraised as a whole at $12,400.00.He owned no person-
alty in Penna.,but did own the whole interest in realty in
Penna.,hereinafter described,valued at $12,400.00,for this
property.Under the terms of his Will,a copy of which is filed
in the Register of Wills Office of Washington O:?unty,Penna.,this
realty was devised as a part of the residuary estate to Paul Davie
Curry,his son,who survived him,and said real estate was not
specifically devised.
4.That Jean G.Olrry,widow,of the deceased,elected
to take against the Will of her husband,said Election being filed
in the Register of Wills Office of Washington County,Penna.,and
in the Recorder of Deeds Office for said County.Her consent to
the prayer of this Petition and sale of said real estate is hereto
cattached,marked Exhibit "A".Said real estate is more rUlly

ALL that certain lot of ground situate in the Seventh
Ward of the City of Washington,Washington County,Pennsylvania,
known and designated as Lot Number 109 in the Plan of Lots laid
out by Allison and Company,embracing lands purchased by them frOll'l
Catherine Shi~ls et al.,by deed dated December 17,1892,recorded
in Deed Book 177,page 373,which plan of lots is called "Allison
and Co's Addition to Washington",the lot of ground hereby conveye~
being thus described and bounded:
On the North by Lot No.110 in said Plan;On the South
by Lot No.108 in said Plan;On the East by Duncan Avenue,and on
the West by Alley uBn.Said lot fronts 50 feet on Duncan Avenue
and extends back Westwardly of the same uniform width a distance
of 150 feet to Alley 'B"0 Upon which is erected a dwelling known
as 415 Duncan Avenue..
CWVEYANCE of this lot of ground is made subject to
e~eptions,reservations,and conditioDS contained in or referred
to in prior deeds in the chain of title.
BEING same lot of ground devised to James William T.
Q1rry by Della Po Olrry,his mother,by Will probated in Will
Book 51,page 296,Washington County,Penna.,records.The said
James William T.Curry died~seised of said real estate on November
30,1969,a resident of caryville,Florida.Said Will was duly
probated in Washington County,Florida and Letters Testamentary
granted to Paul David Qlrry.Ancillary Letters Testamentary were
granted to Paul David CUrry by the Register of Wills of washington
County,Penna.,on April 6,1970,and an exemplified copy of the
Will filed in Washington County,Penna.,in Will Book 110,page 6.
This real estate was not specifically devised,but passed under
the residuary olause in the Will.'Jean G.Olrry,widOW,elected
to take against the Will of the deceased by Election filed at
Number 63-70-375 of 1970,Washington County,Pa.,records,and
therefor joins in this deed.This deed ,is made in pursuance of a
Decree of the Orphans'Court of Washington County,Pa.,under
Section 541,of the Fiduciaries Act of 1949,relative to Bond.
See Number of 1970,See also oeed Book 770,Page 686.
5.That deceased has no debts in the State of Pennsylvam iil,
except costs of administration and inheritance tax,both of which
will be paid in the due course of the settlement of the estate.
6.That on October 6,1970,Joseph D.Falvo et ux.,of
Washington,Penna.,offered to buy said real estate and Paul David
Qlrry,both Executor and Ancillary Executor of the James William
T.Qlrry Estate,agreed to sell and convey same,for the price or
sum of $12,400.00,cash,Subject to approval of Court,upon delive~y
of a proper deed.1'Wo Hundred ($200.00)dollars was paid down by
the Buyer.
7.That the part of the purchase price still to be

received by your Petitioner on behalf of the estate is $12,2000 00,
and he is already under Surety Bond in the amount of $1,000.00.
8.1'bat attached hereto and-made &.part hereof is the
affidavit of two responsible persons familiar with the value of
real estate in the vicinity of the real estate proposed to be
sold,giving the fair value of the real estate herein described
and proposed to be sold.
9.That the estate of James William T.Olrry is solvent
and the price offered of $12,400.00,is the best offer received,
,although it has been for sale for several months,and said offer
is agreeable to all owners and devisees of this real estate.A
real estate agent is involved in this transaction.
,10.1'bat the assessed valuation of this real estate for
1969 tax purposes is $3,675.00.
II.that your Petitioner desires to complete the proposed
sale and deliver a deed to the purchaser.
WHEREFORE,Your Petitioner prays your Honorable Court to
