DURONIO,a minor ) ) ) PETITION FOR THE APPOINTMENT OF A 'GUARDTANOF THR ESTATE:OF A 'MINOR The Petition of Ethel C.Giannamore respectfully represents: 1.Carolyn D.Duronio is a minor,age 12,having heen horn on February 22,1958.Said minor resides with her sole surviving natural parent,Rthe.l C.Gianriamore,the Petitioner herein,at 542 McKean Avenue,Donora (15033),Washington County, Pennsylvania. 2.ThB natural father of Carolyn D.Duronio was A. John Duronio,who died intestate September 18,1969,a resident of Allegheny County,Pennsylvania,survived by four children of his marriage to your Petitioner,including the subject minor.The other three children of said A.John Duronio by his marriage to your Peti- tioner are all living and sui juris.Letters of administration on the Estate of A.John Duronio,deceased have been granted to his eldest son,Richard B.Duronio at No.4119 of 1969,Orphans'Court Division of the Court of Common Pleas of Allegheny County,Pennsylvania. 3.Your Petitioner and A.John Duronio were divorced on December 8,1961.Thereafter,said A.John Duronio married Isabelle B. Duronio who had two children by a prior marriage,both of whom are liv- ing and sui juris.No children were born of the marriage of A.John ------------------- Duronio and Isabelle B.Duronio which terminated on September 18, 1969 when hoth persons.were ki.lled simultaneously in an automobile accident. 4.As a result of the death of said A.John Duronio and Isabelle B.Duronio,Carolyn D.Duronio has become the beneficiary of certain insurance on the life of her late father and step-mother and is also an heir of her latefatherts intestate estate. 5.No Guardian has previously been appointed for the estate of said minor. 6.The minor is not a child of a veteran. 7.Your Petitioner proposes that the First National Bank .&Trust Co.Wash~ngton,Pa.be appointed Guardian of the Estate of Carolyn D.Duronio,a minor. 8.The proposed Guardian has no interest adverse to the minor and is not a fiduciary of any estate in which the minor has an interest nor is it surety of such a fiduciary. 9.The assets of the minor's estate for which a Guardian is required include the follow~ng: (a)A one-sixth (1/6)share of the death benefits accruing under Washington National Insurance Company Policy Certifi- cates 21875 and 215875Al,being accidental death poli6ie's on the lives of A.John Duronio and Isabelle B.Duronio,his spouse,re- spectively,through memeership and associate membership in the West Penn Motor Club of which the beneficiaries are a group composed of the children and step-children of the insured.Since said A.John Duronio was,survived by four children and said Isabelle B.Duronio -2- ------------------------------------------ .... by two children,the total de.ath benefits of $14,200.0.0 will be divided equally amongth.e six surviving children and step-children of the insureds.with each child and step-child including the sUbj ect minor receiving the sum of $2,366.67.Said sum is.presently being held by the ins.urance.company pending appointment of a Guardian for Carolyn D.Duronio. (b)A one-fourth (1/4)share of the death benefits accruing under Metropolitan Life Insurance Company Policy No.12 216 654 A on the life~of A.John Duronio which is presently being held by th.e insurance company pending appointment of a Guardian for Carolyn D.Duroni.o and whi.ch amounts to $448.33. (e).A one-·fourth (1/4)share of the death benefits accruing under New England Mutual Life Insurance Company Policy No.G-6992of whi~ch.A.John Duronio held Certificate No.C:"6,which' is also presently held by the insurance company pending appointment of a Guardian for Carolyn D.Duronio and which amounts to $2,500.00 plUS interest. (d)A one-fourth (1/4)share of the Estate of A. John Duronio,deceased,presently being administered by Ri.chard B. Duronio,Admi.nistrator,at No.4119 of 1969,Orphans'Court Division of the Court of Common Pleas of Allegheny County,Pennsylvania.Your Petiti.oner avers on information and belief that sai.d Estate may be insolvent.
