The Petition of Mrs.Herbert (Maxine)R.Clements,
Executrix of the Estate of George B.Harper,deceased,
respectfully represents:I
1.That George B.Harper,unmarried,died,testate,on
July 26,1969,a resident of Somerset Township,Washington
County,Pennsylvania.Letters Testamentary on said estate
were granted by the Register of Wills of this County to your
petitioner,Mrs.Herbert (Max:.ne)R.Clements,on April 15,
1970.A copy of the Last Will and Testament of the decedent
is attached hereto and marked Exhibit "A"and is of record in
Will Book 110,page 48.
2.That the only party interested in the decede~t's
estate is the Masonic Home of Elizabethtown,Pennsylvania.
Stanley Baldwin having died on October 2,1968.
3.The decedent died seized of real property,to-wit the
real estate herein petitioned to be'sold,which real estate is
described as follows:

ALL that certain tract of land situate in Somerset
Township,Washington county,Pennsylvania,bounded
and described as follows:
BEGINNING at a point on the dividing line between
the property herein conveyed and the property of
Andy Chamaj,et ux.,and the property now or formerly
of Mitchell:thence North 42°0'West,195.12 feet
to a point:thence by lands now or formerly of the
VanVoorhis Heirs,South 68°18'West,2240 feet to
a point:thence South 22°52'East,200.25 feet to a
point:thence along the line of property of Andy
Chamaj,et ux.,North 67°52'20"East,2303.68
feet to the place of beginning.CONTAINING 10
acres more or less.
UPON which is erected a 1 story brick house
and a block garage.
EXCEPTING and RESERVING all of the coal of the
Pittsburgh Seam or River Vein,together with the
mining rights as heretofore conveyed by Isaac
VanVoorhis,to John Simpson,by deed dated April 7,
1899,and recorded in Deed Book Vol.224,page 64.
EXCEPTING and RESERVING all other coal,except.
the Top or Hill Vein of coal,together with the
mining rights and privileges heretofore conveyed.
EXCEPTING and RESERVING the oil and gas in and
under the above described premises,together with
the right to drill and operate for the same,and
the right to lay the necessary pipe lines for conveying
the oil and gas from the premises,but no wells shall
be drilled within 200 feet of the buildings now on the

shall be entitled to compensate for all damage
caused to crops,fences or improvements in the
location or drilling of wells and laying of pipe
lines.

page 607.

decedent at the time of his death and no real estate has been
sold without petition to the Court.
5.That the real estate described in paragraph 3 is

6.The aforesaid real estate described in Paragraph 3
is subject to a Mortgage given by George B.Harper to Peoples
Union Bank and Trust Company,dated June 20,1967 and recorded
on June 22,1967,in Mortgage Book 692,page 492.in the amount
of $9,650.00,payable within one year from the date hereof,
with inte=est at the rate of 6%per annum,payable monthly.
The balance due on said mortgage is $9,027.25.
7.That your petitioner proposes to sell said real estate
described in Paragraph 3,at public sale under Sectior-543 of
the Fiduciaries Act of 1949,because of the aforesaid mortgage

and debts of the decedent and to complete the orderly
administration of the decedent's estate.
8.That under the terms of the Last will and Testament
of the said decedent,your petitioner is given no auth~rity
to sell said real estate.Therefore,leave of Court is
requested to make said sale.
WHEREFORE,your petitioner prays your Honorable Court,
under Section 543 of the Fiduciaries Act of 1949,for
authority to make public sale of the aforesaid premises at
Circle Road,R.D.#1,Scenery Hill,Somerset Township,
Washington County,Pennsylvania,and fully described in
Paragraph 3 of this petition.

Court directed the said Mrs.Eerbert (Maxine)R.Clements to
expose at Public Sale,premises at Somerset Township,Washington
County,Pennsylvania,described as follows:
ALL that certain tract of land situate in
Somerset Township,Washington County,Pennsylvania,
bounded and described as follows:
BEGINNING at a po~nt on the dividing line
between the property herein conveyed and the property
of Andy Chamaj,et ux.,and the property now or

2.That pursuant to said Order,your Petitio~er,after
due public notice by advertisement 'and'by the posting of hand-
bills in accordance with the Act of Assembly and Rule of Court,
did expose the said real estate to public sale by public
auction on Saturday,MaY,30,1970,at 2:00 o'clock P.M.,E.D.S.T.
on the premises.
3.That a copy of the handbill and proofs of advertise-
ment of Notice of said sale in compliance with the Act ~f
Assembly and Rule of Court,are annexed hereto.
4.That more than ten (10)days previous Noti=e of the
time and place of the sale had been given to all parties
interested.Copies of said Notices and proof of mailing by
certified Mail,Return Receipt Requested,are annexed hereto.
5.Affidavit of Posting of handbills,more tha~five
(5)in number,one in a conspi'c\:ous place on the real estate
and the others in prominent places in the vicinity of ~aid real
estate is annexed hereto.

6.That at said sale,the above described real estate
was sold to william B.stout 3.nd Mary W.stout,·his wife,for
the price or sum of Thirteen Thousand One Hundred ($13,100.00)
Dollars,~hey being the highest bidder,and that being the
highest and best price bid fo=said real estate at said sale.

On closer exam ination of the policy,the estate was n·)t the ben~HGi:~yy.
There was a named beneficiary in the policy and it has been turned

over to the Prudential Insurance Company.That is nu:nbertotle.
Oh,incidentally,that is not included in the Inventory.Number two,
the decedent has had title or has title to a 1964 Chevrolet Corvair
which at the time of death had a value of approximately $200.00.
We have been una ble to locate this automobile.Our laat wordi.of it,
it was left---it broke down,it was left on the streets :lown at Pittsburgh.

On July 14,1970,George B.Stegenga filed a claim on behalf of
Ruth Bayer,who is a stepdaughter,for services,for nursing servi es,
the total amount which a:nounted to $2,125.00.This claim is being
cieilci~d by the estate.On July 17,1970,I requested Mr.Stegenga
for an itemized statement fof the dates and the type of services
performed.I did not receive the statement.the itemiled statemen
And again on August 5,1970,again in writing,I requ=sted an
itemized statem ent of th=services performed and did not receive
a reply.On numerous occasions I have requested orally to Mr.
