of this date,we have not been able to agree upon who shall be the

handling this trust,is now away,but he will return shortly and we
think that upon his return and upon further discussions with the
beneficiaries we will be able to agree upon who shall be the succeSl:Or

Patton advised me that Your Honor had suggested June 15 as the
date for the continuance.But since that time,I tal ked with Mr.

the income beneficiary,died on February 11,1975.
The trust provides that on her death,the trust property
is to be divided into three shares.One share is to be
distributed to the issue of the deceased child of Anne
Baker Weimer.The deceased child's n0me was Julia

She passed away.
She died prior to her mother's death.

She was survived by one child,Joseph Duncan Kniseley,
and under the terms of the trust agreement,the one thir
share for that grandchild of the income beneficiary is to be
for Mr.Weimer.He has not reached the age of 4S and
distributed outright.He is sui juris.The second
share is to be distributed in trust for Walter Baker·U

Weimer.There is an existing trust under the Will
is therefore not entitled to distribution of any part
of the trust principal at this tine.
The third share is to be distributed in
trust to the same trust under the Will for A~y Anne
Weimer Ritter,the other surviving child of the income
beneficiary.She has reached the age of 4S years,
and therefore,under the terms of the trust,will receiv~
one fourth of the trust principal outright.And three
fourths of the trust principal of her share will be helc
in trust for the already existing trust for her benefit.

as follows:
(eJ The remal.nl.ng ONE-HALF (1/2)PART of my residuary
estate,and in the event my said wife should predecease
me,then a FOUR-FIFTHS (4/5,)PART of.the net residuary
estate,I give,devise and bequeath ur:to my said Trustees
to'be held by them IN TRUST as follows:'
(1)An equal ONE-FOURTH (1/4)PART thereof·shall
be held for my daughter,ANNE BAKER WEIMER,and the net
income therefrom shall be paid unto her in monthly or
other.convenient payments.during her lifetime,and,upon
her death,the .then principal,together'with any income
accrued or accumulated thereon and rem3.ining unpaid to
her,shall be divided in equal shares to and among my
three grandchildren hereinafter named3.nd shall be added
to the trust estates hereinafter creat-=d for them and the
income shall be paid and the principal distributed as
a part thereof.
Due to the fact that ample provision for my said
daughter has been made by other relatives of hers,including
her mother and myself,it has seemed to me advisable to
make provision for her herein upon the same basis as made
for my three grandchildren.
(2.)An equal ONE-FOURTH (1/4)PART shall be held
in trust for my granddaughter,AMY ANNE WEIMER,and equal
ONE-FOURTH (1/4)PART for my granddaug~ter,JULIA V.WEIMER,
and an equal ONE-FOURTH :(1/4.)PART for my grandson,WALTER
B.WEIMER,and during their respective minorities as much
of the net income as the Trustees in tteir discretion may
deem necessary may be used for their maintenance,support
and education.During such minority aQY excess income over
and above their reasonable needs may be accumulated and
invested by the Trustees until they shall have respectively
attained their majority,at which time the entire net
income shall be paid unto them.
(3)As and when each of the said grandchildren
shall.have attained the age of forty-five (45)years,the
Trustees shall distribute to him or her a ONE-FOURTH (1/4)
PART of the principal of their respecti7e share and a
further ONE-FOURTH (1/4.)PART thereof as and when they shall
have respectively attained the age of fifty-five (55)
years.Thereafter the income on the remaining portion of
their principal share shall be paid to ~hem for life.
(4.)Upon the death of any of m!said grandchildren,
that portion of his or her principal share then remaining
in trust,together with any income accrued or accumulated
and remaining undis~ributed,shall be divided per stirpes
into as many shares as there are issue him or her surviving
and each share shall be held and admini~tered as a separate

trust until the surviving issue attain the age of twenty-
one (2.1)years respectively whe:'1 the principal shall be
distributed to them.Should any of such surviving issue
die before having attained the age of twenty-one (21)
