The trust provides that on her death,the trust property is to be divided into three shares.One share is to be distributed to the issue of the deceased child of Anne Baker Weimer.The deceased child's n0me was Julia l I I J B.Weimer Kniseley.She was survived--- THE COURT: MR.PATTON: She passed away. She died prior to her mother's death. • She was survived by one child,Joseph Duncan Kniseley, and under the terms of the trust agreement,the one thir share for that grandchild of the income beneficiary is to be for Mr.Weimer.He has not reached the age of 4S and distributed outright.He is sui juris.The second share is to be distributed in trust for Walter Baker·U L·o~o· Weimer.There is an existing trust under the Will is therefore not entitled to distribution of any part of the trust principal at this tine. The third share is to be distributed in trust to the same trust under the Will for A~y Anne Weimer Ritter,the other surviving child of the income beneficiary.She has reached the age of 4S years, and therefore,under the terms of the trust,will receiv~ one fourth of the trust principal outright.And three fourths of the trust principal of her share will be helc in trust for the already existing trust for her benefit. They were named,in this case,I believe tley are named in the Will. THE COURT:Even though they were under the heading I named in the Will itself.Amy Anne Weimer and Julia v.Weimer and Walter Baker Weimer are named in the of issue.Were they named specifically?In other words, was Anne Baker Weimer's children living at the time of the testator's death? •MR.PATTON:Yes,they were,Your Honor.They are Will. The distribution in this case is subject to the payment of trustee's commissions a~d attorney's fees.The beneficiaries have requested that principal assets not be sold in order to raise cash,as they prefer to pay those expenses directly,and the Petition and Decree so provide.
