PETITION TO ADJUDICATE INCOMPETENCE
AND APPOINT GUARDIAN OF THE ESTATE
TO THE HONORABLE P.V.MARINO,JUDGE OF SAID COURT:
The petition of ALEXANDER McILVAINE,Attorney for the late
Samuel A.Foster,and his wife,Anna Nelson White Foster,the
alleged incompetent;respectfully represents:
1.The alleged incompetent,Anna Nelson White Foster,is
82 years of age,a widow,domiciled in Amwell Township,Wash-
ington County,Pennsylvania,and presently a patient in Wash-
ington Hospital,Washington,Pennsylvania.
2.The presence of the alleged incompetent in Court,
because of her physical and mental condition,would be detri-
mental to her welfare.
3.There are no next of kin,sui juris,and residing in
the Commonwealth of Pennsylvania,who would be entitled to share
in the estate of the alleged incompetent should she now die in-
testate;and further,the only known next of kin of the alleged
incompetent is a cousin living in Ireland.
4.The gross value of the alleged incompetent's estate is
estimated to be approximately $25,000.00,made up as follows:
Real Estate House and 20 acres,more or less,of
land situate in Amwell Township,Wash-
ington County,Pennsylvania.
Valued at approx.$12,500.00
Personalty 500 sh Lone Star Gas Corp.,Common
Stock
Valued at approx.
Savings Account in First Federal
Savings &Loan Association of
Washington

And the net annual income of the alleged incompetent is approxi-
mately $1,100.00,from the following sources:

5.The alleged incompetent was not a member of the Armed
Services of the United States and is not receiving and is not
entitled to receive benefits from the United,States Veterans
Administration.
6.The alleged incompetent,because of mental infirmities
of old age,mental illness and mental deficiency,is unable to
manage her property,including the payment of her bills,and the
payment of the obligations of her late husband,Samuel A.Foster,
and his funeral expenses.
7.The alleged incompetent has no guardian of her estate.
8.No other Court has ever assumed jurisdiction in any
proceedings to determine the competency of the alleged incompe-
tent,and no guardian of her person has been appcinted.
9.The proposed guardian of the estate is Pittsburgh
National Bank.
10.The proposed guardian of the estate has no interest
adverse to the alleged incompetent and is not a fiduciary of any

estate in which the alleged incompetent has an interest.
12.The petitioner respectfully requests the Court,pursuant
to paragraph 301 of the Act of February 28,1956,P.L.(1955)1154
as amended by Act of July 14,1961,P.L.634,No.328,para-
graph 1,50 P.S.3301,to award a citation directed to the
alleged incompetent,with notice to such other persons as the
Court may direct,to show cause why Anna Nelson White Foster
should not be adjudged an incompetent,and why Pittsburgh Nationa
Bank should not be appointe~guardian of her estate.

Firing the furnace and bringing her to town.An
it covered a period of one month,during which a nephew of Mr.Fo ter
was at the home.So that tlhat left about three weeks and they put in
a claim for $525.00.I do not dis pute the fact that they did some wo k
there.They probably are entitled to some compensation.But we
felt that the amount was a little high for the three weeks I work.

That Schedule 0 attached hereto and.made part hereof sets forth the names and addresses of all
persons beneficially interested in this estate at the time of decedent's d~ath,the nature of their res-
pective interests,their relationship,if any,to the decedent,together with the ages at the time of
decedent's death of all minors,annuitants and beneficiaries for life under decedent's Will.It also
contains a statement showing which of the beneficiaries named in the decedent's will,'if any,died prior
to decedent,the dates of their death,their issue,andthe relationship of such issue to the beneficiary.
That Schedule E attached hereto and made a part hereof sets forth all'property,real and per-
sonal,owned by the decedent jointly with another or others,including'intangible,standing in the name
of the decedent and others,plus the date and place of record of instruments.effecting the vestiture.of
real estate and the date of acquisition of personalty,plus the name,address .and relationship,if any,
of co-owners to the decedent.
That Schedule F attached hereto and made a part hereof sets forth.fully and in detail all debts
and deductions claimed for and on behalf of this decedent's estate,including funeral expenses paid;
family exemption,where applicable;costs of administration of this estate;counsel fees and fudiciary's
commissions paid or to be paid;cost expended for burial trusts,tombstones or gravemarkers,and reli-
gious services,in consequence of the death of the decedent;debts and claims owing and Impaid at time of
death;taxes accrued chargeable for period prior to decedent's death (except those allowed under Section
651 of the Inheritance and Estate Tax Act);together with a statement of collateral pledged for obliga-
tions,if any.It is agreed that the fiduciary will present proof of said 'Claimed obligations upon re-
quest,that if the amount actually paid in settlement of any fee,commi'ssioh 'or debt is less than the
estimated amount claiming and allowed,that the same will be reported to the Register of Wills,and that
the amount of tax assessed can be reassessed'in accordance therewith.
