not sufficient to warrant administration and filing of inventory,

AND NOW,comes JOHN BOSAK,Administrator of the
Estate of STEVE BOSAK,a/k/a STEPHEN BOSAK,deceased,by his
attorney,THOMAS J.TERPUTAC,ESQ.,and files this Petition under
Section 3351 of the Probate,Estates and Fiduciaries Code,and avers as
follows:
1.The petitioner,John Bosak,is an individual who reside

in the City of Washington,Washington County,Pennsylvania,and files this
Petition as Administrator of the Estate of Steve Bosak,a/k/a Stephen Bosak,
deceased.
2.The said Steve Bosak,a/k/a Stephen Bosak,died
unmarried and intestate on March 13,1970.
3.Petitioner filed a Bond with the Register of Wills of
Washington County on June 11,1976,in the amount of $2,000.00,issued by
United States Fidelity &Guaranty Company.No real estate has been
previously sold in this estate.
4.The property to be sold is the only real estate in this
estate.Said property is more fully described and bounded as follows:
ALL that certain lot of ground situate in the
Seventh Ward of the City of Washington,County of
Washington,State of Pennsylvania,being Lot No.114
in the Allison Land Company Plan,which Plan is recorded
in the Recorder's Office for said county and state in Plan
Book 2,page 110,and being more particularly bounded
and described as follows:
BOUNDED on the North by Lot 115;on the South
by Lot 113;on the East by Duncan A venue and on the
West by Alley B,being 50 feet in front and extending
back westwardly of even width 150 feet to Alley B.
BEING the same lot of ground which was conveyed
by deed of Evangeline Hunter,formerly Evangeline
Frangoulis and Robert 1.Hunter,her husband,to John
R.Bosak and Steve Bosak,dated May 15,1953 and of
record in Deed Book 864,page 616.
5.At the time of his death,the decedent left to survive
him his father,Michael Bosak,as his only heir at law.
6.At the time of his death,the property was titled in
the names of Steve Bosak and John R.Bosak,brothers,as tenants in
common.John R.Bosak individually and John Bosak as Administrator of

the Estate of Steve Bosak,a/k/a Stephen Bosak,deceased,have agreed 1
to sell said real property to Eugene W.Klaber and Tanya M.Klaber,his wif ,
for the price of $37,500.00.A copy of said agreement of sale is attached
hereto,made a part hereof and marked Exhibit "A".
7.After diligent attempts to sell said property,
petitioner entered into the proposed Agreement marked Exhibit "A",which
is the highest and best price obtainable under the circumstances.Appraisals
made by J.C.McCleery and Loren W.Carl are attached hereto,made a
part hereof and marked Exhibits "B"and "C".

8.The 1976 assessment for this property at a total
valuation of $3,965.00 is attached hereto,made a part hereof,and marked
Exhibit "n".
9.In view of the fact that Bond in the amount of $2,000.00
with United States Fidelity &Guaranty Company has already been filed,
and since the only heir at law is the father of decedent,and further since
John Bosak individually is the owner of a half interest in said property,your
petitioner requests your Honorable Court to require the postir_g of an
additional Bond in the amount of $18,000.00,making a total eEtate bond of
$20,000.00.
10.After the sale is completed and the purchase money
paid,petitioner will proceed with the filing of the account and close out the
estate.Such bond is more than sufficient to guarantee payment of the costs
of administration,inheritance taxes and to protect the distributee.
WHEREFORE,the petitioner,John Bosak,Administrator
of the Estate of Steve Bosak,a/k/a Stephen Bosak,deceased,respectfully
requests your Honorable Court to require him to post the additional bond in
the amount of $18,000.00 and to approve said sale.
