Bernice Bice Morrow died June 7,1970.She would have been entitled I
or was to ha ve a half of the fourl:n.-She was a child of Mabel Gray Bice,

a sister who died in 1935.Mrs.Morrow died in June and her husba d
died in August of 1970.They had no children.And they had no estat
Bernice Morrow had a sister.This sister,who is Juanita Bice,
paid the funeral bill of Bernice Morrow and also herhusband ..They
had nothing.Those funera~bills.in the case of Bernice Bice.whic~
is the only one I think is material.Bernice Bice Morrow.was $166 .35.

The husband's bill was less but it's not material here.I have set

Now I have a letter from the sister who paid
the funeral bill of Bernice Bice Morrow.I have the funeral direeto ~'s
receipt for both funerals.The Administrator feels that Juanita BicE
should be awarded.as far as it would go.the share of Bernice Bic,.
Morrow in this'estate,which would amount to something like $1200
It's less than the funeral bill she paid for her sister.And asks that
that be awarded to.her.That would mean that the one sister who
.
survived.Juanita Bice.would be entitled to a half of the fourth in
her own right and a half of the fourth as reimbursement'for paying
the funeral bill of 'her sister.Bernice Morrow.or a total of one

fourth,which wo,.ld amount to approximately $1200.00.And the
funeral bill was sixteen something.
I think there is sufficient proof.both the Admin s-
trator and mys elf are satisfied that she did pay it and I have aaphotclstat
here.I saw the original receipt but she 'wanted it back so I took a
photos tat and sent it back.
THE COURT:I think it would be preferable to present a Petiti n

for the Settlement fof a Small Estate.Whatever is coming to her,
she can stand the deduction of the attorney's fee for presentation of
that petition.That puts it in legal shape.Because after all,when
these people die,we can't simply take it for granted that so and so
is the heir or so and so i.s entitled to distribution.I think that shoul:l
be brought to the attention of tlte Court in a proper petition under t e
SmallEs tates section and then we are authorized to act accordingly.
'II/hen you have som ethi.ng that has legal shape to it,and anyone tha t
wants to object to it,is authorized to do s'o within one year after
the Petition is pres.ented.But for us to make an outright award
not knowing anyof the facts except what have been detailed by you
to the Cou rt,I don't think that we should do it.
