PETITION FOR THE APPOINTMENT
OF A GUARDIAN FOR AN ALLEGED INCOMPETENT
TO THE HONORABLE,THE JUDGE OF THE SAID COURT:
The Petition of JAMES W.HENNING and FREDERICK E.MAXON
respectfully represents:
1.That the Petitioners are the son and stepson of the
said NATHAN W.HENNING,the alleged incompetent,and the said
Petitioners reside at 210 Fallowfield Avenue,Charleroi,washingto
County,Pennsylvania,and 240 Pittsburgh Street,Uniontown,Fayett
County,Pennsylvania,respectively.The alleged incompetent has
his legal domicile in the Borough of Charleroi,Washington County,
Pennsylvania at 810 Fallowfield Avenue where he made his home for
many years but is and has been for some time a patient at the
waddington Nursing and Convalescent Home,R.D.#1,Fayette City,
Fayette County,Pennsylvania.
2.That the said NATHAN W.HENNING,because of mental
infirmity caused by hardening of the arteries being presently 86
years of age is unable to manage:his property and is liable to
dissipate it,or become the victim of designing persons.
3.That the Estate of the said NATHAN W.HENNING is as
follows:Bank Accounts,Charleroi Office,Mellon National Bank &
Trust Co.,$12,000.00;Realty at 810 Fallowfield Avenue,Charleroi
Pennsylvania,having a value of approximately $8,000.00;Corning
Glass Company Stock.

4.That the following is a list of all persons residing
within the Commonwealth of Pennsylvania,who are sui juris,and
who will be entitled to share in the estate of the alleged incom-
petent if he died intestate at this time:

TO THE HONORABLE,THE JUDGE OF THE SAID COURT:
YOUR Petitioner respectfully re~resents as follows:
1..Tha,t"on April 23,1970,your Honorable Court declare
NATHAN ~v.HENNING an incompetent and appointed the Mellon National
Bank and Trust Company as Guardian of his estate.
2.The said Guardian has filed an Inventory in
accordance with the Provisions of Section 402 of the Incompetence
Act of 1955,as amended,and as per the Order of Court.,;
3.The said Incompetent,NATH/ili W.HENNING,is now and
has been a patient in the waddington Nursing Home,R.D.#1,
Fayette City,pennsylvania,and will continue to be confined to
that institution•
.~.James Henning is the only child of NATH.\N '..J.HE.l\ffiING
and is a cripple being unable to walk,unable to stand and is
totally and physically unable to care for himself,He 1S,however
in possession of all of his mental faculties.
5,The said James Henning is also a patient in the
Waddington Nursing Convalescent Home,for he has no other place
nor person to care for bim~
6~The responsibility for attending to the care of the
said James He~ning is that of the Incompetent,NATHAN W.HENNING,
his father.The only income of the said James Henning is a contri
bution from the Social Security Administration,which payment is
insufficient to meet the requirements of his care at Waddington
Nursing Home"
7,Prior to the peroid of incompetency and over a perioA
of at least a year prior thereto,the said NATHAN W.HENNING did
engage counsel,John E.Costello,Esquire,to draft a Voluntary
Trust Agreement.Various agreements were drawn,meetings were
held with representatives of the Mellon National Bank and Trust
Company and with the said Incompetent,but same were never execute
or were fees ever paid therefor.

Waddington Nursing Home for the care of NATHAN HENNING from
January 17,1970,through June 30,1970 -$2,720.34;and for the
care of James Henning,his son,$2,420.43,for a total bill throug
June 30,1970,of $5,140~77.
9.It is contemplated that the debts which will be
incurred for the Incompetent and his son are as follows:
waddington Nursing Home for NATHAN HENNING,365 days at $14.00 per
DAY or $5,110,00 per year;James Henning,365 days at $12 ..00 per
day or $4,380.00,for a total of $9,490.00"Miscellaneous expense~
for medicine and personal items is estimated at $1,000.00 per
annum.Insurance premiums for both NATHAN HENNING and James Henni g

10~The Incompetent owns real estate situate in the
Borough of Charleroi on which there is due the 1969 taxes totaling
$226.10 and an insurance premium estimated to be $100.,00 for a
total of $326.10.
ll~section 644 of the Incompetents Estate Act of 1955,
as amended,provides that the Court,for cause shown,may authorizE
payment of income or principal of the Estate of an Incompetent for
the care and maintenance of the children of the Incompetent.
WHEREFORE,Your Petitioner respectfully prays that your
Honorable Court:

he shall remain a patient in the Waddington Nursing
Home;

1.Your petitioner is the Mellon National Bank and
Trust Company,the GUardian of the Estate of Nathan W.Henning,
an Incompetent duly appointed by the Orphans'Court of Washington
county,pennsylvania~.
2.Your Petition has heretofore filed in the Office of
the Register of Wills of Washington County,pennsylvania,an
Inventory and Appraisement of the assets of the said Natfian W.
Henning,an Incompetent,and a copy of the Inventory and Appraisem t
is attached hereto and made a part hereof.
3.Among the assets listed in the estate of the said
Incompetent was certain real estate situate at 810 Fallowfield
Avenue,in the Borough of Charleroi,Washington County,PennsylvanOa,
having erected thereto a five (5)room frame dwelling house.The
same is more particularly bounded and described in the Agreement 0
Sale which is attached hereto and made a part hereof.

spallino,have entered into an Agreement of Sale for the said real
estate interest of the Incompetent,which agreement is sUbject to

6.There is attached hereto Affidavits of two competent
realtors setting £orth that the price £ixed in the Agreement o£
Sale is fair and represents the market price for the said property

field Avenue,Charleroi,Pennsylvania,for a consideration of $8,000.00 and
do further enclose our hand money deposit of $100.00 herewith.It is under-
stood that the seller will pay all real estate transfer taxes required on the deed
and that real estate taxes will be prorated to the date of delivery of the deed.
It is also understood that you may solicit additional bids for this property and
if you should receive same we shall be granted an opportunity to match any
such offer.In addition,on signing of this agreement we will forward an
additional check in the amount of $900.00 to be added to the sum as noted
above as additional hand money.The terms as set forth above and the accept-
ance of same are based on the Orphans l:Court approval of the sale of this
property and its decision is final.

Article Sixth (a).These items had been delivered to Mr.Maxon by the decedent
prior to his death.
Earl Blevins,Sr.was bequeathed "heavy squirrel rifle and lar~e deer head trophyll
under Article Sixth (c).Mr.Blevins predeceased Mr.Henning~having died
April 24,1965.I
Florence Blevins was bequeathed limy cedar chest,empty,and [my mother's gold
watch"under Article Sixth (d).The cedar chest was offered to :Mrs.Blevins by
the guardian at liquidation of Mr.Henning's household goods but was declined by
her.The gold watch was delivered to Mrs.Blevins by Mr.Hel}ning before his
death.
Estella Piper was bequeathed limy chest of silverware and my sister's small gold
watch,and my gray deer head"under Article Sixth (e).The gold watch was the
only item located and was subsequently advanced to Mrs.Piper as noted in the
account.

the Last Will and Testament of Nathan W.Henning,deceased•
.2.Nathan W.Henning died March 6,1971 and the residual
estate was awarded to the bank by Decree of the Orphans'Court of
Washington County,Pennsylvania and was in the amount of $33,324.00.
3.James Henning,the beneficiary of the trust,is 62 years
of age and a patient at.the Waddington Convalescent Home in Fayette
City,Pennsylvania.
4.Mr.James Henning has been physically incapacitated
slnce birth.
5.Your petitioner,Mellon Bank N.A.as Trustee,has used
the income and principal from the trust for the comfort,support and
maintenance of the said James Henning since the inception of the
account.
6.The account,Mellon Bank N.A.Account No.202-743,is
terminating due to exhaustion of funds with the present cash.balance

7.James Henning has given his approval and consent to the

In the case of securities of close or famil,y corporations,the values reported are as far as
possible substantiated by financial statements of the corporations,showing the assets and liabilities
thereof as of the date of'death.The schedule also sets forth the interest of decedent at the time of
death in any co-partnership or business,and in support of the value of such interest there is annexed to
said schedule,financial statements showing the assets and liabilities of said co-partnership or business.
A copy of the co-partnership agreement,(if oral,a statement setting forth the nature of the agreement)
together with a statement setting forth the character of the business,its location,and such other facts
pertaining to the business as may be pertinent to a fair and just appraisal of the decedent's interest
therein must be submitted.It should also set forth in itemized form,together with the fair market value
thereof,any other property owned or bequeathed by the decedent at the time of death.
The Schedule C attached hereto and made part hereof sets forth a true answer to each inquiry
contained therein and in the case of transfers ofproperty,real or personal,within 'two years of decedent's
death,in contemplation of decedent's death,or intended to take effect in possession or enjoyment at or
after death,said schedule sets forth the nature and value of such property,to whom transferred,the

all other facts of a pertinent nature regarding said transfers.In the case of transfers intended to
take effect in possession or enjoyment at or after death,there is also attached to the schedule a cony

That Schedule D attached hereto and made part hereof sets forth the names and addresses of all
persons beneficially interested in this estate at the time of decedent's death,the nature of their res-
pective interests,their relationship,if any,to the decedent,together with the ages at the time of
decedent's death of all minors,annuitants and beneficiaries for life under decedent's Will.It also
contains a statement showing which of the beneficiaries named in the decedent's will,if any,died prior
to decedent,the dates of their death,their issue,and the relationship of such issue to the beneficiary.
That Schedule E attached hereto and made a part hereof sets forth all property,real and per-
sonal,owned by the decedent jointly with another or others,including intangible,standing in the name
of the decedent and others,plus the date and place of record of instruments effecting the vestiture-of
real estate and the date.of acquisition of .personalJ".Y,plus the name,address and relationship,if any,
of co-owners to the decedent.
That Schedule F attached hereto and made a part hereof sets forth fully and in detail all debts
and deductions claimed for and on behalf of this decedent's estate,including ~lneral expenses paid;
family exemption,where applicable;costs of administration of this estate;counsel fees and fudiciary's
commissions paid or to be paid;cost expended for burial trusts,tombstones or gravemarkers,and reli-
gious services,in consequence of the death of the decedent;debts and claims owing and unpaid at time of
death;taxes accrued chargeable for period prior to decedent's death (except those allowed under Section
651 of the Inheritance and Estate Tax Act);together with a statement of collateral pledged for obliga-
tions,if any.It is agreed that the fiduciary will present proof of said claimed obligations uponre-
quest,that if the amount actually paid in settlement of any fee,commission or debt is less than the
estimated amount claiming and allowed,that the same will be reported to the Register of Wills,and that
the amount of tax assessed can be reassessed in accordance therewith.

He is a young man who is a handicapped person.The Petition seeks

the appointment of the Mellon National Bank and Trust Company as
the guardian.The estate is,as nearly as we can deterrn me,a bank
account in the Charleroi Office of Mellon Bank of approximately
$12,000;real estate in the Charleroi Borough at &i,12Cl1 Fallowfield,
which we estimate to have a value of $8,000,and Corning Glass
$1.5,OOOCto $20,000 current value.

'A 'Yes,'I do.
Q Do you know wheth~r or not arrangements have been maae and

A My stepfather made that request him self on several occasions,but

never proceeded to have it finalized.And he told me that,/that he
wanted that.
Q Over the c~rse of the last several years,have you and I,together
with officers of Mellon Bank,met on a number of occasions with
your stepfather on this same subject?
A Yes.
Q And this is how we came to choose Mellon as the guardian?
A That is correct.

A I don't know if it's the Post Office of Wickhaven or Fayette City,

A No.Not named in so far as completion,but he did talk to the Melll:>n
