IN RE:SALE OF REAL ESTATE UNDER SECTION 541
AS AMENDED,OF THE FIDUCIARIES ACT OF 1949
The Petition of ANNA C.MOLEK,Administratrix of the Estate
of Anna Swidron,deceas ed,respectfully repres ents:
1.Anna Swidron,late of Fredericktown,East Bethlehem Town-
ship,Washington County,Pennsylvania,died intestate on the 13th day of
February,1970.
2.The Register of Wills of Washington County,Pennsylvania,
did on the 5th day of March,1970,grant Letters of Administration upon her
estate to your petitioner,Anna C.Molek.
3.That at the time of her death,the said Anna Swidron was
seised in fee of a certain lot of land,situate in East Bethlehem Township,
Washington County,Pennsylvania,upon which is situate a one-story frame
dwelling,which said land is more particularly bounded and described as
follows:
ALL those certain lots or parcels of land situate in
the Township of East Bethlehem,County of Washington,
State of Pennsylvania,and designated and known as Lots
Number Ten (10)and Eleven (11)in Block Number Nine-
teen (19)in a certain plan of lots known as '1MILFRED
TERRACE",which is recorded in the Office of the
Recorder of Deeds in and for Washington County,afore-
said,in Plan Book Volume 2,Page 198,bounded and
described as follows:Each fronting thirty (30)feet on
Fourth Street and extending back of an even width,one
hundred twenty (120)feet to an alley,and being Lots,
Nos.Ten (10)and Eleven (11)in Block No.Nineteen (19).
EXCEPTING and RESERVING from out the operation
of this Deed,the Pittsburgh vein of coal and such other
express reservations and exceptions as are fully set out in
a certain Deed of conveyance from John J.Doebert and
Carl J.Crawford,Trustees,et aI,to the Monongahela
Realty Company recorded in the Office for the Recorder
of Deeds in Washington County,in Deed Book 312,
page 506.
BEING the same two lots of ground as were conveyed
by Freda H.Powers and Matthew A.Powers,her husband,
to John Swidron and Anna Swidron,his wife,by deed
dated November 21,1945,and recorded in the
Recorder's Office in Deed Book 70 I,Page 113.
4.Attached hereto and made a part hereof are two affidavits
concerning the fair and reasonable market value of the property to be sold,the
valuation being placed at Two Thousand Six Hundred ($2,600.00)Dollars.
5.The amount and nature of the estate of Anna Swidron,decease,
consists solely of the property above described;the decedent having died
possessed of no personal estate.
6.That the Letters of Administration were issued in this estate
to your petitioner upon the filing of bond in the sum of Three Thousand ($3,000.00)
Dollars with the United States Fidelity and Guaranty Company as surety.
8.The Administratrix has entered into an agreement for the
rivate sale of said real estate with Charles Gould and Katheryn M.Gould,
his wife,dated July ,1970,for the full consideration of Two Thousand

purchasers to the Administratrix upon approval by the Court of the bond

Dear Mr.Chaney:
We have your letter of October 20,1970,requesting permission to
deduct funeral bill expenses from the Debts and Deductions in the above-
titled estate.
Your letter is not clearly understood,however,we have gathered
from the text of your communication that this estate is attempting to
claim funeral expenses twice,once against jointly held assets and once a-
gainst the probate estate.
If our understanding is correct,the answer is quite obvious since
no deduction can be declared twice in the same estate.
