1949 FOR LEAVE TO MAKE PUBLIC
JUDICIAL SALE OF REAL ESTATE
TO THE HONORABLE,THE JUDGES OF SAID COURT:
1.Your Petitioner is Mollie Lee Halstead,who is
the Executrix of the Estate of Anna H.McCann,deceased,and who
resides at 414 Crest Avenue,Charleroi,Washington County,
Pennsylvania.
2.On February 17,1970,Anna H.McCann,deceased,
died testate,domiciled in the Borough of Charleroi,Washington
County,Pennsylvania.
3.On March 4,1970,the Will of the decedent was
admitted to probate and Letters Testamentary were granted by
the Register of Wills to Mollie Lee Halstead under the terms of
the Last Will and Testament.A true and correct copy of said
Last Will and Testament is attached hereto and made a part
hereof as Exhibit "A".
4.Your Petitioner has not filed any bond.
5.The decedent owned real estate,the exact
description of which appears attached hereto and marked Exhibit
"B"and upon which there is erected a three-story brick
dwelling,containing seven (7)rooms and bath of ancient
origin and containing a frame garage at the rear.The lot size
is 44 feet by 100 feet.
6.The real estate is subject to the following liens
and charges:
Commonwealth of Pennsylvania,No.489 March
Term 1969 D.S.B.,in the amount of $2,000.00
Commonwealth of Pennsylvania,No.347 May
Term 1968 A.D.,~n the amount of $2,000.00
(this is a revival of No.60 September Term
1963 A.D.)
Commonwealth of Pennsylvania,No.402 July
Term 1965 A.D.in the amount of $2,000.00
7.The total amount due the Commonwealth of Penn-
sylvania is represented by Exhibit "c"which is a letter from
the Department of Public Welfare stating that the sum of
$10,594.37 is due.
8.In addition to the foregoing debts and obligation ,
there exists administrative costs and expenses and preferred
debts in the nature of fune~expenses and expenses of the last
illness of the decedent.
9.Your Petitioner wishes to sell the real estate
hereinbefore described at a public sale which shall have the
effect of a judicial sale.Such sale is advisable and

desireab1e for the pr9per administration and distribution of
the estate because the real estate is vacant,incapable of
rental and its present appraised value will not permit it to be
sold for an amount in excess of the debts and liens lodged
against the decedent or for which the Executrix has become
obligated.
10.Your Petitioner does not have the authority to
make such a sale under the Fiduciaries Act of 1949 and although
the decedent authorized the Executrix,Mollie Lee Halstead,to
sell any of her real estate at either public or private sale,yOU]
Petitioner deems it advisable and desireab1e to procure an
order of court to accomplish such purpose.
11.The real estate which the Peitioner desires to sell
was devised generally to the Roman Catholic St.Jerome's
Parochial School,presently located at the corner of Sixth Street
and Washington Avenue,Charleroi,Pennsylvania,as the same is
specifically set forth in Paragraph Third of the Last Will and
Testament of the decedent.
12.Your Petitioner avers and sets forth that the
parties in interest as distributees or creditors are the Common-
wealth of Pennsylvania,Department of Public Welfare,Bureau of
Administrative Services as set forth in Paragraph 6,and the
Roman Catholic St.Jerome's Parochial School,located at the corner
of Sixth Street and Washington Avenue,Charleroi,Pennsylvania,
whose headmaster is Father William J.Maher.

13.All of the parties in interest are sui juris
and no necessity exists to appoint a fiduciary for interests
which are unrepresented.
14.There appears attached hereto and made a part
hereof a notice to all parties in interest of the date and
time of presentation of this petition by certified mail.
15.The Petitioner requests your Honorable Court
pursuant to Section 543 of the Fiduciaries Act of April 18,
1949,P.L.512,20 P.S.Section 320.543,to grant leave to
sell the real estate as is more fully described in Exhibit "B"
attached hereto and made a part hereof,at a public sale which
shall have the effect of a judicial sale.

1.Your Petitioner,Mollie Lee Halstead,Executrix
of the Estate of Anna H.McCann,deceased,caused the real estate,
subject matter of the Petition of Executrix for Leave to Make
Public Judicial Sale of Real Estate filed at the above number and
term,to be sold.
2.The sale occurred after due and proper advertise-
ment on the premises on February 6,1971,at 1:00 P.M.A true
and correct copy of the sales notice is hereto attached and marked
Exhibit "A".
3.The highest bidder at the public sale conducted
by the Executrix was Andrew Coulson and Beatrice L.Coulson,his
wife,who purchased the premises subject to the approval and con-
firmation by the Court in accordance with the agreement entered
into,a copy of which is attached hereto and made a part hereof,
for the sum of Seven Thousand One Hundred and 00/100 ($7,100.00)
Dollars.
4.The successful bidders 'Paid the sum of $700.00
which is in the possession of the Executrix.

of the intent to sell by previous petition filed.
6.It has come to the attention of the Executrix
that there are other persons who are desirous of paying an amount
in excess of that which the successful bidder has bid••

so that they may appear in Court and offer a bid in excess of
that which the Executrix accepted in the public sale.
8.The Executrix,at such sale,reserved the right
to accept higher bids upon presentation of this petition,if the
same were presented in Court and were at least 10%more than the
bid of the successful bidder at the public sale.
WHEREFORE,your Petitioner prays your Honorable
Court to accept such additional bids,in such cases made and
provided,upon presentation of this petition and in the event
none other are presented,to confirm the public sale by
direction of the Executrix to make,execute and deliver a deed

asset of a parcel of real estate;it was the only asset in the estate,
really.The furniture which is referred to in paragraph two of the
Will was really either non-existent or of Euch character that it was

to the Salvation Army.The decedent herself resided in a private
nursing home during the last year of her life.The asset of the esta e
was valued at less than the amount of the claims against the estate.
The principal claim against the estate was the lien of a judgment
entered by the Commonwealth of Pennsylvania,who,through the
Department of Welfare,had provided ass istance for Miss McCann
for a very long pe riod of tim e.The amount of the judgment was in
excess of $10,000.And the value of the real estate at public sale
was $7,000.We filed a petition with the Court to make a judicial
sale of real estate,notifying the Commonwealth and also the residuary
legatee,who happened to be the Roman Catholic St.Jerome's Pa'rachial
School,of our intention to do so~and notifying them that the value
of the asset was less than the claim of the Commonwealth and we
would sell it for the best price obtainable at public sale.That sale
was later confirmed by the Court for $7,000.00.
We have a number of claims in the estate,Your
Honor.I would like to call the Court's attention to the fact that
there are administration claims amounting to $862.63,representat ve
all of administrative expenses which are set forth in the account.
In addition to thos e at audit,there is claimed by the attorney for
the estate and the Executrix for auctioneer services an additional
sum of $450.00.We list preferred claims in the amount of $896.2
There was a matter of about:eight months,Your

Honor,before we were able to sell the property.And most of these
preferred claims were required because of the rat her disreputable
nature in which the house,--deteriorated nature which the house fel
during the years which Miss McCann was unable to keep it up.
For example,we had to spend money in removing rubbish,cutting
grass,insurance,and delinquent 1970 County Taxes,repairing
windows;and particular attention is called to the fact that under
preferred claims,although the funeral expense was $1244.00,
the largest part of that was paid by the Executrix out of insurance
proceeds,leaving the funeral director a preferred claim in the arne unt
of $295.80.

for distribution,or determination of distribution to the Commonwel:lth,
and also to the residuary legatee who is not presently represented in
Court today,the sum of $4,722.53,for which we request the Court

distribution,of cours e,is totally in cash.
We have made no payment,obidously,on Inheritance
Tax.And there are no outstanding claims of any other kind exceptiI g
those which I have enumerated to the Court.
