MILDRED SMITH
I,MILDRED SMITH,of the City of Washington,Washington County,
Pennsylvania,do hereby make,publish and declare this to be my Last vii II
and Testament hereby revok i ng any other will or wi IIs by me at any time
heretofore made.
I.I direct my executor hereinafter named to pay all my just
debts and funeral expenses as soon as convenient after my decease.
2.AI I the rest,residue and remainder qf my estate of whatsoever
kind and wheresoever situate,I give,devise and bequeath to my sisters,
Dorothy McC.Remington and EI inor Martin,share and share alike.
3.I nominate,constitute and appoint my brother-in-law,V.H.
Remington,to be Executor of this my Last Wi II and Testament.

PETITION FOR SETTLEMENT OF A SMALL ESTATE
UNDER SECTION 202 OF THE FIDUCIARIES ACT
OF 1949,P.L.512,AS AMENDED.
TO THE HONORABLE,THE JUDGE OF SAID COURT:
The petition of V.H.Remington respectfully
represents:
1.That Mildred M.Smith also known as Mildred
McCollum Smith died a resident of the City of Washington,
Washington County,Pennsylvania.
2.That said decedent died February 19,1970,in
the Borough of Claysville,Washington County,Pennsylvania.
3.The entire estate of the decedent consisted of
household goods and personal effects which sold at public sale
for the sum of $1214.15,a Blue Cross refund in the amount of
$5.10,a refund from Hubert Post for invalid chair rental in
the amount of $11.00 and a checking account in Washington office
of Pittsburgh National Bank in the amount of $95.06,or a total
of $1,325.31 in cash.
4.That the said Mildred M.'Smith made a will dated
October 27,1969,which was admitted to probate by the Register
of Wills of Washington County,Pennsylvania,on March 3,1970.

A copy of said Will is attached hereto and made a part hereof
and marked Exhibit "A".The beneficiaries therein named are
both of age and sui juris.Dorothy McC.Remington resides at
690 LeMoyne Avenue Extension,Washington,Pennsylvania,15301,
and Elinore Martin resides at ,15?0 Shorb-North,West Canton,
Ohio 44703.
5.That your petitio~er has paid the following bills
out of the assets of the estate:Piatt Funeral Home,balance
for funeral services after credit for social sec~rity lump sum
payment $964.50;W.A.Prideaux,M.D.for professional services
$20.00;Joseph Horne Company,billof decedent $5.00;Church of
the Covenant,balance on pledge $16.00;Observer Publishing
Company,advertising personal property $28.56;Observer Publishing
Company,advertising sale -$3.75;Kurtz Monument Company lettering
marker $24.50 or a total of $1,062.31 leaving in your petitioner's
hands a net cash balance of $263.00.
6.That your petitioner paid out of his own funds
for the use and benefit oZ said decedent the following sums of
money:For prescriptions and medications from August 1969 to
January 1970,inclusive,$73.92;for maintenance in Washington
Manor Extended Care Unit,December 9,1968,through May 18,
1969,$1373.01;for nursing home care in Louise Burns Nursing
Home,Claysville,Pennsylvania,May 19,1969,to February 19,
1970,inclusive,$2440.00;to Hubert Post for appraisal fee
$5.00;Russell Marino,Register of Wills,probate of will $10.50
or a total of $3902~43.
7.That except for attorney's fees and costs of
these proceedings there are no other outstanding claims against
this decedent's estate.

WHEREFORE,your Petitioner prays that an Order be made
authorizing and directing your petitioner the costs of this
Petition in the amount of $8.00,attorney's fees in the amount
of $100.00 to McCreight,Marriner &McCreight,notary fee in
the sum of $1.00 and the balance to wit,$154.00 to your petitione
as a payment on account of the personal funds advanced by him
for the use and benefit of the decedent.
