Borough of Donora,Washington County,Pennsylvania,being of sound
and disposing mind and memory,do hereby make,publish and declare •
this to be my Last Will and Testament,hereby revoking any and all
former wil~or testamentary writings heretofore made by me.
FIRST.I appoint my beloved son,Nestor Theo~ore Kuzemka,as
IExecutor of this,my Last Will and Testament.In the event that
Ifor any reason my aforesaid appointee shall not assume or continue
Ihis office as Executor,I appoint in his place or stead my belo~ed
IdaUghter,Pauline Hajostek.I direct that no bond shall be reqUire
of any of the persons named in'this paragraph.
SECDND.I direct that all my just debts and funeral expenses
be fully paid and satisfied as soon as conveniently may be after my
death.I further direct that my funeral shall be similar to the
funeral held for my late wife and that no less than an approximate
equal price be paid for my funeral.
THIRD.I give,devise and bequeath all of my property,real,
personal and mixed to my two sons,Nestor Theodore Kuzemka and
Leonard Kuzemka,in equal shares.
FOURTH.It is my desire,not to be construed as a condition,
Ilthat my beneficiaries namerl in paragraph THIRD above permit those
IOf my children who now live in the family home,namely Marie
Kuzemka,Betty Ann Kuzemka and Daniel Kuzemka,to continue to live
in said home.
FIFTH.In the event that either of the beneficiaries named
in paragraph THIRD above shall not survive me,I direct that the
other beneficiary shall receive the estate devised in Paragraph
ITHIRD.If both of the beneficiaries named in paragraph THIRD fail
lito survive me,I give,devise and bequeath all of my estate to

a Will.The sole asset was a piece of real estate.And two devisee
have signed elections to take this real estate in kind.The money
to take care of the expenses in the eSj;ate was advanced by the two
legatees.There are no problems indicated on the Audit Petition.
The Will did provide that the funeral should be similar to the one
held for the decedent's wife,and for no less a price.And the funerc 1
was similar and the price of the decedent's funeral was $1747.00.
His wife's funeral,which had taken place in 1959,was $1467.00.
So we feel that that has been complied with.There is a precatory
request in the Will that $3.00 be permitted to remain in the ho uS e,

So I do not feel that that is anything that the Court has to interpret.
Although the daughters are in the house and will undoubtedly continue
