Dear Mr.Chaney:
We have your letter of July 13,1970,requesting guidance
on how to correct the records in the above estate inasmuch as
inheritance tax was paid to the Register of Wills of Washington and
it was subsequently found that the decedent was a resident of
Allegheny County.
Please be advised that our Receipts and Accounting Section
has instructed us in prior cases of this nature to correct the record
in the following manner:
"When inheritance tax has been collected in one county,which
should rightfully have been collected in another county,the
Register of Wills erroneously collecting the tax must certify
the amount collected to the Register of Wills of the County
in which the tax should have been paid.
If commission has been retained,the Register of Wills must
send his personal check to the Register of Wills of the
County in which the tax is rightfully collectible.
If no commission was withheld by the Register of Wills collecting
the tax and there is commission due the Register to whom the tax
'should have been paid,the only recourse the Register of Wills
would have would be to take up the matter with the Auditors at
the annual audit by the Auditor General Department."

Hr.Santicola,Chief Appraiser,Allegheny County,advises that
tax has been paid in Washington County on July 1,1970,as reflected by
receipt NO.A-085236 in the amount of $612.7p.Since this has been determined
to be an Allegheny County estate,the Register of Wills of Washington County
erroneously collected the tax.We have been advised by Mr.John H.Williams,
Supervisor Receipts and Accounting,that when inheritance tax has been erroneously
collected in one County when it should have rightfully been collected in another
county,the Refist',pt Will§that erred in malting the collection muDt certify
the amount collected to the Register ot wttls of the County in which the t,i;
should have been paid.
If the Register'ot Wills retained 8 commission,he must send his
personal ch="to the Register of Wills ot the County in which the Tax isrigh~ble~.----__
If no conw:dssion vas withheld by the Register of tills collecting
the Tax and there is cOl1lllission due the Register to whom the Tax should have
been paid,the only recourso available would be to confer with representatives
of the Auditor General's Department at the aDDual audit.
Upon completion of the adjUBbnents as set forth herein,the
records of the Jeannette Mary Berkebile cstate v:U1 be maintained in
