PETITION FOR SETTLEMENT OF SMALL ESTATE
The Petition of Raymond E.Cottrell respectfully
represents:
1.The decedent,Ella P.Cottrell,who died on
January 9,1970 resided in Claysville,washington County,
Pennsylvania.
2.Your Petitioner,whose address is 524 Central
Avenue,Washington,Pennsylvania,is the son of decedent.
3.Decedent left a Will dated August 1932,which
will is attached hereto.The three (3)children named as
legatees in said Will are all alive.John W.Cottrell,husband
of decedent,died in 1943.
4.The only persons ~entitled to share in this
estate are the Petitioner,his brother Roy V.Cottrell,and his
sister,Marjorie R.Cottrell McNeel.
5.The only property of the decedent is a checking
account in the Mellon National Bank and Trust Company,Claysville,
Pennsylvania Office,which bears No.356-9340.The balance in said
account as of the date of death was One Thousand Eight Hundred
Fifteen and 95/100 ($1,815.95)Dollars.
6.All creditors of the decedent have been paid
except Ray A.Brownlee,Claysville,Pennsylvania,to whom
is owing the sum of One Thousand Four Hundred ($1,400.00)Dollars
for the funeral and burial of decedent.
7.The inheritance tax owing to the Commonwealth of
Pennsylvania will not be in excess of Twenty-Five ($25.00)Dollars,
and Petitioner will pay same promptly upon the disbursement of
the proceeds in the aforesaid checking account.Petitioner further-
more will distribute the net balance from said checking account in
equal shares among himself and his aforesaid brother and sister.
8.Roy V.Cottrell and Marjorie R.Cottrell McNeel
join~in this Petition and specifically join in the prayer herein-
after stated.
WHEREFORE,Petitioner prays that your Honorable Court
direct distribution of the aforesaid checking account as follows:
One Thousand Four Hundred ($1,400.00)Dollars to Ray A.Brownlee,
Claysville,pennsylvania and the balance to

This is the last will and testament of Ella.Cottrell,of
Claysville,Washington Ccmlnty,Penns)rlvania..
Being of sound mind and of ~~own free desire I hereby
give,devise and bequeath to'my husband,John W;Uottrell,and
to my three children,namel¥:Raymond E.Cottrell,Roy V.Cottrell
and Marjorie F..Cottrell McNeel,all my estate,real,personal or
mixed,of whatsoever nature it may be and wherever it may be
found,the same to be divided equall¥among the surviving heirs
of those named herein,after all fees and costs of execution are
paid.

It 1s hereby further provided that~if,prior to my decease,
the mineral resources of u~farm,in Paint Township,Clarion Cou~
Pennsylvania,should be developed to such an extent tha.t it wouldapp~to be of advantage to hold said property in tact,I hereby
direct that,by mutual agreement and consent of the surviving
heirs,the Executor herein named,shall collect such rentals,
royalties or revenues as may be derived from the development.oper-
ation and sale of said minerals,such proceeds to be divided equ-
alq.:among the surviving heirs of those named herein.

named Ella Cottrell to be her last will and test~entt in the
presence of us,who at her request and in her presence and
in the presence of each other,we hereunto set hands and

It is further provided that,if at any t~e after ~
decease,the surviving heirs of those named herein should mutually
agree to the sale of the above mentioned far.m,in whole or in
part,the Executor,herein named,shall proceed with such sale and
execute such agreements,contracts and deeds as may be necessary
and upon receipt of the proceeds of such sale and aft~r deducting
the costs of such sale,said proceeds to~edivided equally among
the sur~iving heirs of those named herein.
